PE-1091-77 (2)PRELIMINARY SUBDIVISION AND ZONE CLASSIFICATION UPGRADING PE- 1091 -77 - WALKER SUBDIVISION: WOLFLAND, INC. ZE- 58 -77 - AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL AND /OR TWO FAMILY RESIDENTIAL Planning Commission Decision: Anarove.subiect to findings and conditions listed below: Vote was unanimous. A. FINDINGS: MINUTES APRIL 15, 1977 The proposed subdivision is located within the Spokane Metropolitan Area. Specifically, the proposal is located in the Spokane Valley at the Northwest corner of Evergreen Road and Valley Way Avenue. 2. Walker Subdivision is situated within an area designated as suitable for residential development by the approved map of the Park and Recreation element of the Spokane County Comprehensive Plan and its accompanying text. The Comprehensive Plan for the Spokane Metropolitan Area, as approved by the Spokane Regional Planning Conference, also designated the area as a residential neighborhood. Boundaries of said neighborhood are Evergreen to the east, Sprague to the south, Pines to the west, and Interstate 90 to the north. 3. The applicant requests preliminary approval for the subdivision of approxi- mately two (2) acres into five (5) lots for duplexes, thereby creating a gross density of about five (5) units per acre. 4. The lots in the proposed subdivision have been designed to accommodate either single family dwellings or duplexes with a typical lot size of 11,700 square feet and a minimum frontage of ninety (90) feet. 5. The proposed subdivision appears to be a compatible extension of existing development in the area. Development to the north of the proposed sub- division includes the administration offices of the Vera Water and Power and the church of the First Church of Christ Scientist. Development to the east, south and west includes the residential subdivisions of Evergreen Acres Addi- tion, Birketts Subdivision, Lonalee Addition and Loita's Subdivision. 6. The site in question is currently vacant and the USDA has classified its crop- land potential as fair. 7. Public facilities and utilities are available within the area to serve the pro- posed subdivision to the following extent. - 5 - (font' d) PE- 1091 -77 - WALKER SUBDIVISION (Cont'd) A. Water & Power: Vera Water and Power has stated that the district can supply both power and water to the proposed subdivision providing the developer complies with the District's policies, rules and regulations. B. Sewage Disposal: The site in question is located over the aquifer that served both the City of Spokane and Spokane Valley. The Spokane County Health District has approved the proposed subdivision for on -site sewage disposal. The District states "the topography and soils in the plat are suitable for installation of individual on -site sewage disposal systems. Such systems will have negligible immediate impact on the environment in the area but continued urbanization in the area in this density historically pollutes groundwater under the development at some time in the future." C. Schools: D. Parks: E. Police Protection: The Spokane County Sheriff's Department has been contacted and no comment has been received regard- ing this proposal. F. Fire Protection: Spokane County Fire Protection District 4#1 has been contacted and the District states hydrants need to be installed to provide for adequate fire protection. G. Roads: The proposed subdivision lies within the boundaries of the Central Valley School District. The District has stated that in their view the proposed subdivision will not have any impact on the District's facilities if the proposal is approved. No improved county parks are located within the area and the County Parks Department has no present plans for either site acquisition or major park improve- ments. . Adequate county roads appear to be available at the site to handle the increased automobile traffic if the proposal is approved. The Spokane Regional Planning Conference's adopted transportation plan has desig- nated Evergreen Road (to the east of the proposal) as a principal arterial, while Valley Way Avenue (to the south of the site) has been designated as a collector. 8. The staff of the Planning Department has reviewed the environmental checklist as submitted by the applicant, and the staff recommends that a declaration of non - significance be issued. - 6 - (Coned) 1- .Z PE- 1091 -77 - WALKER S.,LiDIVISION (Cont'd) B. CONDITIONS: 1. That the plat be designed as indicated on the revised preliminary plat of record and/or attached sheets as noted. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. ,That appropriate provision be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1' strip at the ends or edges of all streets that terminate or border the plat boundary. (Temporary cul de sacs are required when streets terminate at the plat boundaries.) 5. That appropriate street names be indicated. 6. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. 7. That a plan for water facilities adequate for fire protection be approved by the water supplies and fire protection district. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor), and fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certi- ficate will be drafted on a transparency suitable for reproduction. The purveyor will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The contractual arrangements will include aprovision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. - 7 - ( Cont'd) PE- 1091 -77 - WALKER .BDIVISION (Cont'd) The Plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and purveyor will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot. 8. That a certificate of title be furnished the Planning Department prior to the filing of the final plat. 9. That the preliminary plat be given conditional approval to May 1, 1978. 10. That a declaration of Non - Significance be issued, in accordance with Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior to approval of this recommendation by the Board of County Commissioners; or that any approving action of the Board be conditioned upon issuance of Final Declaration of Non - Significance in accordance with SCEO 11.15.340. 11. The Spokane County Health District has determined that the soil condi- tions in the plat are suitable for on -site sewage disposal systems on each lot. 12. An on -site management system shall be approved by the Health District prior to filing of the final plat. 13. That conditional approval of the plat is given subject to dedication of right of way to the public and approval of the road system in the plat by the County Engineer. 14. That plans, profiles, and cross sections showing proposed street center- line and curb grades be submitted to the County Engineer for approval prior to construction and filing of a final plat. 15. That drainage plans and design calculations showing the grades and alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and the filing of a final plat. 16. Construction within the proposed public streets and easements shall be performed under the direct supervision of a li censed land surveyor, who shall be responsible for perpetuating all evidence of the location of survey monuments which may be distrubed during construction and who shall furnish the County Engineer with "As Built" plans and a certi- ficate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 17. No construction work is to be performed within the public right of way until a permit has been issued by the County Engineer. All construction within the public right of way is to be completed prior to filing the final plat or a bond in the amount estimated by the County Engineers to cover the cost of construction of improvements, construc- tion certification, "As Built" plans, and monumenting the street center- lines shall be filed with the County Engineers. 19. The dedication shall contain a statement prohibiting individual lot access to Evergreen Road and Valley Way Avenue. 20.
