A. FINDINGS: 1. The proposed subdivision is located within the Spokane Metropolitan Area. Specifically, the proposal is located in the Spokane Valley north of Mission Avenue between Felts Road and Woodruff Road. 2. Mission Hills 1st Addition is situated within an area designated as suit- able for residential development by the approved map of the Park and Rec- reation Element of the Spokane County Comprehensive Plan and its ac- companying text. The Comprehensive Plan for the Spokane Metropolitan Area, as approved by the Spokane Regional Planning Conference, also designates the area as a residential neighborhood. The neighborhood in question is bounded by Sprague to the south, University to the east, Argonne to the west and Interstate 90 to the north. 3. The applicant requests preliminary approval for the subdivision of appro- ximately 4.7 acres into twelve (12) lots for single family dwellings; creating a gross density of less than three (3) units per acre. 4. The lots in the proposed subdivision have been designed to accommodate single family dwellings with atypical lot size of 10,875 square feet and a typical frontage of eight -seven (87) feet. 5. The proposed subdivision appears to be a compatible extension of exist- ing development in the area. Plats in the area include Mission Hills Subdivision which is located directly north of the proposed subdivision. 6. The site in question is currently vacant and the USDA has classified its cropland potential as fair. 7. Public facilities and utilities are available within the area to serve the proposed subdivision to the following extent: A. Water and Power: Modern Electric Water Company states that "upon completion of satisfactory arrangement with the Modem Electric Water Company, the utility is capable of providing water for domestic use and fire protection, and electricity for residential consumption." B. Sewage Disposal: The site in question is located over the aquifer that serves both the City of Spokane and Spokane Valley. The Spokane County Health District has approved the pro- - 15 - PE- 1092 -77 - MISSION HILLS FIRST ADDITION (Cont'd) posed subdivision for on -site sewage disposal. The Dist- rict states "the topography and soils in the plat are suitable for installation of individual on -site sewage disposal systems. Such systems will have negligible immediate impact on the environment in the area but continued urbanization in the area at this density historic lly pollutes groundwater under the development at some time in the future." C. Schools: The proposed subdivision lies within the bounderies of the East Valley School District. The District's facilities are currently at capacity levels and any increase in student enrollment will have to be absorbed by present facilities un- til their current building program is completed in two or three years. D. Parks: The Spokane County Valley Mission Par'; is located approxi- mately one half mile to the east of the proposed subdivision. The County Parks Department has no present plans for future site acquisition in the area. E. Polic Protection: The Spokane County Sheriff's Department has been contacted and no comment has been received regarding this proposal. F. Fire Protection: Spokane County Fire Protection District 411 has been contacted and the District states hydrants need to be installed to provide for adequate fire protection. G. Roads: Adequate County roads appear to be available at the site to handle the increased traffic if the proposal is approved. The Spokane Regional Planning Conferences' adopted transpor- tation plan has designated Mission Avenue as a principal arterial. 8. The staff of the Planning Department has reviewed the environmental check- list as submitted by the applicant, and the staff recommends that a declar- ation of non - significance be issued. If the Planning Commission feels approval of this proposal would be appropiate, the department staff recommends the following conditions: 1. That the plat be designed as indicated on the revised preliminary plat of record and/or attached sheets as noted. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. PE -1093 -77 - MISSION HILLS FIRST ADDITION (Cont'd) 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate provision be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1' strip at the ends or edges of all streets that terminate or border the plat boundary. (Temporary cul de sacs are required when streets terminate at the plat boundaries.) 5. That appropriate street names be indicated. 6. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Flanning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. 7. That a plan for water facilities adequate for fire protection be approved by the water supplier and fire protection district. Said water plan must also have been approved by the appropriate health authorities. The health auth- orities, water supplier (purveyor), and fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for 'building permits within the plat. The contractual arrangements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and purveyor will be installed within this plat, and the subdivider will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot. 8. That a certificate of title be furnished the Planning Department prior to the filing of the final plat. 9. That a declaration of Non - Significance be issued, in accordance with Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior to approval of this recommendation by the Board be conditioned upon issuance of Final Declaration of Non - Significance in accordance with SCEO 11.15.340. 11. That a name be indicated before the final plat is filed; such name to be approv- ed by the County Assessor and the Planning staff. 12. The Spokane County Health District has determined that the soil conditions in the plat are suitable for on -site sewage disposal systems on each lot. 13. That conditional approval of the plat is given subject to dedication of right of way to the public and approval of the road system in the plat by the County Engineer. 14. That plans, profiles, and cross sections showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to construction and the filing of a final plat. 15. That drainage plans and design calculations showing the grades and alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and the filing of a final plat. 16. Construction within the proposed public streets and easements shall be per- formed under the direct supervision of a licensed land surveyor, who shall be responsible for perpetuating all evidence of the location of survey monu- ments which may be disturbed during construction and who shall furnish the County Engineer with "As Built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 17. No construction work is to be performed within the public right of way until a permit has been issued by the County Engineer. All work is subject to inspec- tion and approval by the County Engineer. 18. All construction within the public right of way is to be completed prior to filing the final plat or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans, and monumenting the street centerlines shall be filed with the County Engineer. 19.
