NON - EXCLUSIVE BORDER EASEMENT
IN THE MATTER OF 5004 EAST SPRAGUE AVENUE ( "GVD RETAIL ") RF NO.: 2100
KNOW ALL MEN BY THESE PRESENTS, that the Grantor(s), SPRAGUE PARTNERS, LLC,
a Washington limited liability company, for and in consideration of Mutual Benefits, the receipt
of which is hereby acknowledged, grants to the public and to Spokane Valley, a political
subdivision of the State of Washington, a NON - EXCLUSIVE BORDER EASEMENT to use the
following described real property situated in the City of Spokane Valley, the County of Spokane,
and the State of Washington, to wit:
AFFECTS ASSESSORS PARCEL NO(S).: 35232.0105
Pursuant to the Legal Description set forth in Exhibit "A" herein affixed and
made a part of this document hereof.
The Non - Exclusive Border Easement as described in Exhibit "A" and illustrated in Exhibit `B"
attached hereto is hereby granted to Spokane Valley and its authorized agents, and to the Public
for Road purposes, including but not limited to curbs, sidewalks, grading, drainage, signage and
other usage deemed necessary by the Spokane Valley Public Works Department for the safety
and welfare of the Public. Grantor retains its access rights for ingress and egress across the Non -
Exclusive Boarder Easement area for the benefit of Grantor's appurtenant land. No fence or
portion thereof will be constructed within said Easement without permission of the Spokane
Valley Public Works Department nor will any objects be placed in said Easement that would
obstruct the sight distance necessary for safe and efficient vehicular movement.
The Easement and the agreements and duties provided for herein shall run with the land and shall
be binding on, and shall inure to the benefit of the parties referenced herein, their heirs,
successors and assigns.
The Grantor(s) or their successors in interest agree to maintain in good repair the sidewalks,
driveways and landscaping to be installed in such property, and when so doing shall not be
considered agents of Spokane Valley. The Grantor(s) or their successor in interest shall further
maintain all drainage inlets, grates, pipes, catch basins, drywells and other drainage structures
and appurtenances used for the disposal of private and public Road drainage.
