in consideration of $10.00 and consideration of mutual benefits in hand paid, in lieu of and
under threat of the exercise of eminent domain, convey and warrant to the City of Spokane
Valley, a municipal corporation of the State of Washington, THE GRANTEE, for public use
forever, the following described real estate:

SUBJECT TO all easements, restrictions, covenants and encumbrances of record.
It is understood and agreed that delivery of this deed is hereby tendered and that the
terms and obligations hereof shall not become binding upon the City of Spokane Valley unless
and until accepted and approved hereon in writing for the City of Spokane Valley, by the
Spokane Valley Director of Public Works. Also, the undersigned hereby requests the
Assessor and Treasurer of said County to set -over to the remainder of the herein described
parcel, the lien of all unpaid taxes, if any, affecting the property hereby conveyed, as provided
by RCW 84.60.070.

That portion of the South Half of the Northeast Quarter of Section 13, Township 25
North, Range 44 East of the Willamette Meridian described as follows:
BEGINNING at the northwest corner of Tract 131 of VERA, as per plat thereof recorded
in Volume "A ". of Plats, Page 30; thence East, along the north line of said Tract 131, 262
feet to a point of intersection with the northern line of Spokane and Inland Empire
Railroad Company right of way; thence Northeasterly, along the northerly line of said
Railroad right of way, 474 feet, more or less, to a point on the west line of Tract 132 of
VERA; thence North, 39 feet to a point on the south line of the Spokane Valley Irrigation
Company main canal right of way; thence West, along the south line of said Irrigation
Company right of way, 848.2 feet to a point; thence South, 521 feet to a point of
intersection with the said northerly line of railway company right of way; thence
Northeasterly, along the northerly line of said right of way, 213.5 feet to a point on the
