BORDER AND UTILITY EASEMENT
IN THE MATTER OF Indiana Avenue Extension Project, Project File No. 0112,
KNOW ALL MEN BY THESE PRESENTS, that the Grantor(s), Centennial Properties, Inc., for and in
consideration of mutual benefits, the receipt of which is hereby acknowledged, warrants and conveys to
the City of Spokane Valley, a municipal corporation of the State of Washington, a Border and Utility
Easement over the following described real property, situated in the City of Spokane Valley, Spokane
County, State of Washington, to-wit:
See attached Border and Utility Easement No. 3 Legal Description
The Border and Utility Easement as shown hereon is hereby granted to the City of Spokane Valley and its
authorized agents, and to the public for road purposes, including but not limited to the construction,
reconstruction, maintenance, protection, inspection and operation curbs, sidewalks, grading, drainage,
signage; and other usage deemed necessary by City of Spokane Valley for the safety and welfare of the
public. No fence or portion thereof will be constructed within said Easement without permission of the
City of Spokane Valley, nor will any objects be placed in said Easement that would obstruct the sight
distance necessary for safe and efficient vehiculaz movement. Any other Easements, except right-of-way
granted or dedicated within this Border and Utility Easement, are subject to Spokane Valley permit
process prior to usage.
The Border and Utility Easement is also dedicated for the use of serving utitity companies for the
construction, reconstruction, maintenance, protection, inspection and operation of their respective

facilities; water, fiber aptics, cable, phone, natural gas and electric. The rights granted herein prohibit the
grantor from making changes in grade that decrease the coverage of installed underground facilities.
Utility companies shall have the right to trim or remove trees, bushes, landscaping, without compensation
to the grantor, when they are situated within the border and utility easement, provided the utility
companies shall return any property so affected by removal to a neat and clean condition, including, but
not limited to, the planting of grounds and grading as appropriate. This provision shall not prohibit fences
or any lateral crossing of the easement strips with water or sewer lines.
The Easement and the agreements and duties provided for herein shall run with the land and sha11 be
binding on, and shall inure to the benefit of the parties referenced herein, their heirs, successors and
assigns.
The Grantor(s) or their successors in interest agree to and shall maintain in good repair the sidewalks,
driveways and landscaping to be installed on such property by Grantor or its agents, and when so doing
shall not be considered agents of the City of Spokane Valley.
The City of Spokane Valley shall maintain all drainage inlets, grates, pipes, catch basins, drywells and
other drainage structures and appurtenances used for the disposal of public road drainage within said
border easement.
