IN THE MATTER OF Indiana Avenue Extension Proiect # 0112
KNOW ALL MEN BY THESE PRESENTS, that the Grantor, Centennial Properties, Inc., for and in
consideration of Mutual Benefits, the receipt of which is hereby acknowledged, grant(s) to the City of
Spokane Valley (Grantee), a municipal corporation in the State of Washington, an Easement over, under,
upon and across the hereinafter described lands situated in the City of Spokane Valley, County of
Spokane, State of Washington:

AFFECTS ASSESSORS PARCEL NO(S)• 45131 0112
The Drainage Easement granted to the City of Spokane Valley and its authorized agents is for the sole
purpose of allowing construction, operation, and maintenance of a stormwater culvert. The Grantor(s)
hereby agree not to obstruct access to the storm drain ditch and culvert inlet to the above-described lands.
The Grantor(s) hereby agrees to limit the improvements within the easement to landscaping consisting of
grasses, shallow-rooted shrubs, but not trees or deeply rooted plants. The Grantee will not be responsible

for replacement or repair of any improvements that the Grantor may place within the drainage easement,
nor shall the Grantee be responsible to repair, maintain, or replace any damage to improvements, other
than replacement of grasses and shallow-rooted shrubs that are damaged by work of Grantee in the
easement area, that the Grantor(s) or assignees may place in the drainage easement if the Grantee, at iYs
sole discretion, replaces or repairs the stormwater ditch, culvert piping and inlet.
The City of Spokane Valley accepts complete and total responsibility for the construction and perpetual
maintenance of the public drainage facilities located within said Easement per Project # 0112 plans on file
in the office of the City of Spokane Valley Public Works Department and as amended by the Director of
Public Works. The Grantee shall not be responsible to replace, repair, or maintain any other
improvements.
The Easement and the agreements and duties provided for herein shall run with the land and shall be
binding on, and shall inure to the benefit of the parties referenced herein, their heirs, successors and
assigns.

COMMENCING at the Northeast corner of said Section 13; thence N89°57'44'W along the
North line of said Section 13 a distance of 678.49 feet; thence S00102' 16'W a distance of 421.12
feet to the POINT OF BEGINNING, from which point the Northeast corner of said Section 13
bears N58°12'41"E a distance of 798.55 feet said point also being the beginning of a non-tangent
curve concave to Northwest and having a radius of 532.50 feet (from which point a radial line
bears N48°10'41"W); thence Northeasterly along said curve through a central angle of
