All provisions in the basic agreement remain in effect except as expressly modified by this supplement. Agen igna re Date / Co ul nt Signature Date a o6 I OONSULTANT SUPPLEMENTAL AGREEMENT 03.00C PAGE iOFi C06 -23 EXHIBIT B2 Scope of Work for Construction Management and Inspection Services for the Barker Road Improvements Project — Boone Avenue to Spokane River City of Spokane Valley, Washington TIB Project No. 8- 3- 208(001) -1 1.0 Introduction The purpose of this Scope of Work is to establish the specific scope of construction management and inspection services to be performed by CH2M HILL during the, construction phase of the Barker Road Improvements project. The project, to be constructed by an independent contractor selected by the City of Spokane Valley (Spokme Valley), extends from Boone Avenue to the Spokane River. The project will reconstruct the existing two -lane rural roadway into a three -lane urban street, which will include sidewalks, bike lanes, curb and gutters, drainage collection and infiltration systems. Traffic signals and illumination will be installed at the Mission Avenue intersection. The project also includes construction of a sanitary se• wer system for Spokane County, Linder a separate bid schedule from the roadway work. Other publicly -owned and privately -owned utilities will be installed, relocated, or adjusted by the respective utility owners during this project. Spokane Valley may make or approve changes Nvithin the general scope of this agreement. if such changes affect ChI2M HILL's cost of or time required for performance of the services, an equitable adjustment will be made through an amendment to this agreement. CH2M HILL will notify Spokane Valley in writing of the occurrence of a change and an estimate of the cost impact. Spokane Valley will provide written approval of change. A 10 percent contingency fund has been established for minor changes to the Scope of Work. Use of the contingency fund requires written authorization from Spokane Valley. 2.0 Assumptions Construction is anticipated to begin in April 2006 and to be substantially complete by the end of October 2006. CH2M HILL's services and level of effort are based upon the schedule or duration of constriction anticipated at the time that these services are agreed upon. Deviations from the anticipated schedule or duration of construction will materially affect the scope of these services Supplemental Agreement 03 Scope of Work.doc Page 1 of 7 and CH2M HILL's compensation for the services, and will require an adjustment to CH2M HILL's compensation. CH2_1M HILL. will serve as the center of communication between Spokane Valley and Spokane Valley's Contractor. It is intended that Spokane Valley staff will provide direction to CH2M HILL for decisions related to extra work and major changes to the project - however, a signature of an authorized member of Spokane Valley staff will be required to bind Spokane Valley to a change order. Commu.n.ications between Spokane Valley and the Contractor without CH214 HILL will be avoided to maximize CH2\4 HILL's effectiveness. Spokane Valley will contract separately with Spokane County for additional inspection services relating to the signal and illumination systems. Spokane County will provide inspection services for the sanitary sewer construction activities including inspection of backfill and compaction testing up to the roadway subgrade. CH2M HILL will coordinate with Spokane County to obtain quantities, change order approvals, and other information from Spokane County as necessary to process monthly progress payments for the sanitary sewer work. Utility work performed by publicly-owned and privately -owned utility agencies will not be inspected by CH2-v1 HILL. CH2M HILL will work with the Contractor to ensure that utility work to be performed by others is coordinated appropriately. CH21N4 HILL will perform only a cursory review of Traffic Control Plans submitted by the Contractor. Spokane Valley will provide formal review and reject or approve Traffic Control Plans. CH2M HILL will not be responsible for the means, methods, techniques, sequences, procedures, or health and safety precautions of the Contractor, nor shall CH2M HILL be responsible for the Contractor's failure to perform in accordance with the Contract documents. Quality assurance /quality control field and laboratory testing services will be provided by CH23M HILL's authorized subconsultant(s). Any labor and expenses required to address construction claims, unforeseen subsurface considerations, or additional construction requested by the Contractor or O'Wner may require additional level of effort beyond the established budget. Any claims resolution or litigation assistance requested of CH_2M HILL will constitute additional services that are not included in this Scope of Work. The presence or duties of CH2M HILL's personnel at a construction site, whether as onsite representatives or otherwise, do not make CH2M HILL's personnel in any way responsible for those duties that belong to Spokane Valley and /or the Contractor or other entities, and do not relieve the Contractor or any other entity of their obligations, duties, and responsibilities, including, but not limited, to all construction methods, means techniques, sequences, and procedures necessary for coordinating and completing all portions of the construction work in accordance with the construction Contract Documents and any health or safety precautions required by such construction work. Supplemental Agreernetit 03 Scope of Work.doc Page 2 of 7 CH2M HILL's personnel have no authority to exercise any control over any Contractor or other entity or their employees in connection with their work or any health or safety precautions and have no duty for inspecting, noting, observing, correcting, or reporting on health or safety deficiencies of the Contractor(s) or other entity or any other persons at the site except CH2M HTLL's own personnel. The presence of CH2-1\4 HILL's personnel at a construction site is for the purpose of providing to Spokane Valley a greater degree of confidence that the completed construction work will conform generally to the construction documents and that the integrity of the design concept as reflected in the Construction Documents has been implemented and preserved by the Contractor's). CH2M HILL neither guarantees the performance of the Contractor's), nor assumes responsibility for Contractor's failure to perform work in accordance with the Construction Documents. 3.0 Scope of Services CH21\4 HILL will provide the following services: Project Management PM.1 Oversee CH2M HILL's services for the project. PM.2 Supervise the Resident Observer defined herein. PM.3 Supervise review of submittals. PM.4 Provide periodic site visits during construction. Typically these visits will occur on the day of the scheduled construction coordination meeting. PM.5 Oversee construction Change Order process. PM.6 Review and approve Contractor progress payments. PM.7 Review, approve and issue CH2M HILL invoices. PM.8 Document communications associated with the Project. PNI.9 Coordinate Project Closeout Activities Resident Observation RO.1 Meet and /or consult with Contractor's representatives and Spokane Valley to assist in implementing the construction process. CH2AM HILL's Resident Observer will meet with Contractor's representative (superintendent) daily or every other day as needed during active construction. RO.2 Spot check the layout and final position of the work. Supplemental Agreement 03 Scope of Work.doc Page 3 of 7 RO.3 Provide observation of construction activities to help assure conformance to the requirements of the contract documents. If non - conforming work is found, CI I1\4 HILL will notify the Contractor that the work needs to be corrected. However, CH2M HILL will not have the authority to stop work and will not direct the Contractor as to means and methods of construction, in accordance with the Contract Documents. RO.4 Attend construction coordination meetings. These meetings will generally be planned for each week of active construction and will be scheduled on the same day and time each week. RO.5 Recommend the amounts of payments due the Contractor as set forth in the Construction Contract. RO.6 Coordinate materials testing activities. Arrange and schedule quality assurance /quality control field and laboratory testing services. Coordinate the work of an inspection service for the observation and tests of materials used in the construction; receive and evaluate reports by such service. Refer to Table 1, for the Quality Assurance /Quality Control tests and level of effort assumed for the Project. Actual testing requirements may vary based on Contractor performance but minimum testing requirements will be met. Costs of testing services will be per test or per hour of testing technician at the actual rates charged by CH2M HILL's subconsultant. CH2M HILL's services shall not include an independent verification of the quality of work conducted and information provided by testing laboratories or other independent contractors retained by CH2M HILL in connection with CH2M HILL's services provided to Spokane Valley. RO.7 Assist Spokane Valley is responding to concerns of the general public. RO.8 Inspect Contractor and Spokane Valley supplied materials for conformance with the Contract Documents. RO.9 Identify and tabulate installed quantities identified in the bid schedule. RO.10 Identify and tabulate mate rial~ -on -hand for payment to the Contractor. R0.11 Accept materials delivery tickets. RO.12 Keep a daily construction diary and provide a daily construction report. 80.13 Review Contractor's Traffic Control activities and compare to approved Traffic Control Plan and notify Project Manager of compliance status. Office Engineering Services OE.1 Schedule, prepare an agenda for, conduct and prepare a record of the pre - construction conference to be held in Spokane Valley's offices. Supplemental Agreement 03 Scope of Work.doc Pate 4 of 7 0E.2 Meet and /or consult with representatives of Spokane Valley and appropriate regulatory agencies when requested and as necessary for consultation or conferences in regard to construction of the Project. 013.3 Provide up to 7 copies of approved full- sized Drawings, Specifications, and Contract Documents to the Contractor. Providing additional copies will be considered an additional service beyond the established budget. OEA Provide technical interpretations of the Drawings, Specifications, and Contract Documents, and evaluate requested deviations from the approved design or specifications. OE.S Participate in Weekly Construction Progress Meetings OE.5.1 CH2M HILL will schedule, attend and conduct one construction coordination meeting each week during active construction (or bi- monthly if appropriate). A standard agenda will be set and used to prepare for the work in the period ahead; to discuss the work completed in the last period; and to discuss other issues of importance to Spokane Valley, CH2M HILL, Contractor, and other parties as appropriate. 0E.5.2 CH2M HILT will prepare minutes from each construction coordination meeting and will route them to all attendees weekly. CH2M HILL will prepare and submit the weekly statement of working days for the contract along with the meeting minutes. OE.6 CH2h1 I-IILL's Project Manager, or other designated CH2M HILL staff as deemed appropriate by the Project Manager, will make periodic visits with the Resident Observer to the site of the Project to observe the progress and quality of the work and to determine if the work is proceeding in accordance with the intent of the Contract Documents. These visits will typically occur on the same day as the construction progress meeting. If non - conforming work is found, CH2M HILL will notify the Contractor that the work needs to be corrected. However, CH2M HILL will not have the authority to stop work and will not direct the Contractor as to means and methods of construction, in accordance with the Contract Documents. OE.7 Submittals and Materials Coordination OE.7.1 During construction, CH2►N4 HILL will review and reject or approve shop drawings, diagrams, illustrations, catalog data, schedules and samples, the results of tests and inspections, and other data which the Contractor is required to submit. These shall be reviewed for conformance with the information given in the Contract Documents. Such review is not intended as approval of the submittals if they deviate from the Contract Documents or contain errors, omissions, and inconsistencies, nor is it intended to relieve the Contractor of his full responsibility for Contract performance, nor is the review untended to ensure or guarantee lack of inconsistencies, error, and /or omissions between the submittals and the Supplemental Agreement 03 Scope of Work.doc Page 5 of 7 Contract requirements. Traffic control plan submittals will be reviewed and rejected or approved by Spokane Valley, as noted in the Assumptions section of this Scope of Work. OE.7.2 CI-12M HILL will keep a log to track the status and disposition of each submittal. OE.7.3 CH2M HILL will report the results of the testing to Spokane Valley and Contractor, as necessary. OE S Assist Spokane Valley in negotiating with the Contractor the scope and cost of up to three (3) contract change orders. Prepare and process such change orders as may be required and submit to Spokane Valley for approval. OE.9 Contractor's Progress Payments (Pay Estimates). OE.9.1 Progress payment requests shall be initiated by the Contractor. OE.9.2 CH2M HILL's Project Manager or other designated staff will work with the Resident Observer, and with the Contractor to reach an agreement on items to be recommended for payment. CH2M HILL will prepare a spreadsheet to summarize the quantities due for payment from worksheets submitted by the field engineer and the Contractor. OE.9.3 C112M HILL will review and approve each progress payment application after complete review and concurrence from the Resident Observer. CH2M HILL will submit the completed package to Spokane Valley for approval and payment. Spokane Valley will prepare all funding source reimbursement forms and requests. OEA0 Make a final review of the construction to determine if the work has been completed in general conformance with the Contract Documents. Review final payment for construction. Prepare and submit a letter recommending acceptance of the work when it appears that the Contractor has met the Contract requirements. Spokane Valley and appropriate regulatory or funding agencies may furnish a representative to jointly make the final observation of the construction. Project Closeout Services PC.1 Assist Spokane Valley in closing out the project. Assistance with audits performed by funding agencies or other outside sources is considered an additional service requiring additional level of effort beyond the established budget. PC.1 CH2M HILL will prepare one (1) reproducible set and electronic AutoCAD record drawings and submit to Spokane Valley, upon completion of the work, using available information supplied by the Contractor, the Resident Observer, suppliers, and other sources.
