06-050.00 Spokane County: 2006 Sewer Construction Drainage Improvement Costs~~'l ~ \ Amended Memorandum of Understanding Between the City of Spokane Valley and Spokane County Pavement Replacement Cost Sharing and llrainage Improvement C~-sts for the 2006 Sewer Construction Program NrHER~AS the City of Spokane Valley (the CITY) anti Spokane County (the COUN"l'Y) desire to work collaboratively to construct portions of the COUN`[`Y's 2006 Sewer Construction Program together with CITY paving and drainage improvement: projects; and WI-[ERl~AS the CIT Y desires that the roads impacted by the construction of sewers in the. 2006 Sewer Construction Program be reconstructed to the full prcconstruction width for an improved roadway surface; and WHrRIAS the Cl`I"Y also desires that pavement replacement work he extended iri some areas beyond the. limits of sewer construction; and WHEREAS the CITY also desires that certain drainage improvements be constructed in areas that will be impacted by the COUNTY'S 2006 Sewer Construction Program; and WH:F_REAS the costs of such full width repaving, additional length of road reconstruction; and miscellaneous drainage improvements are not funded by the COUN1`Y's Sewer Construction Program, and said costs will need to be paid by the CITY; and WHEREAS the 2006 Sewer Construction Program includes the Veradale Heights, Vera Terrace, and C.lectric Railroad Sewer Projects within the limits of the CTTY, as identified in the COUNTY'S adopted Six-Year Sewer Capital Improvement Program 2006-201 l; and 1V1-ll;}ZFAS the CITY and COUNTY entered into a Memorandum of Understanding on February 24; 2006 based on engineering estimates of the paving and drainage costs; and 1~Vi-LrRT'AS the bid costs for paving and drainage for each of the 2006 sewer projects exceeded the engineers estimates; and WH.I~RL~"AS the CITY and COUN'T'Y desires to amend the February 24, 2006 Memorandum of Understanding lc; rct'cct the increased costs for full-width repavin; and drainage improvements; and V1'NI:ItP.AS the CITY also desires to receive monthly imroices for paving and drainage costs rather than waiting for the substantial completion of each project. NOW TI-[ETtF.FOR);, the CITY and the COUNTY do hereby agree as follows: I. Prior to the bid of each project, the COUNTY shall provide the C1`fY with a set of project plans; together with cost estimates indicating the extent of pavement removal and replacement to be paid for by the COUN`I"Y as a part of the sewer project. The Cl`["Y shall review the plans and estimate, and shall advise the COUNTY regarding the extent to which the CITY desires to add pavement removal and replacement, as well as the specific drainage improvements That the CI"1'Y would like to make in conjunction with the project. The COUNTY shall prepare bid documents that include the additional work that is requested by the C1'f Y. °I'he CITY' may request that the COUTr'fY include a Base Bid Schedule and an Alternate Bid Schedule in the bid documents to allow for a more accurate determination of the true cost impact of the additional work requested by the CITY. 3. After the bids for a project are opened, the COUN1"Y shall prepare the bid tabulation and provide a copy to the CITY on the day of the bid, together with a calculation of the CI°I'Y's estimated share of the project cost based upon the unit prices submitted by the low bidder. If the CITY then clecides to proceed with the desired improvements; the CITY shall provide a written notice to the COUNTY within three days of the receipt of the bid tabulation. 4. `fhe CI"C'Y's maximum cost for the three projects shall not exceed $875,000 for road impro~cements and $200;000 for drainage improvements without written authorization by the CITY. The COUNTY shall not proceed with any work that would increase the CITY'S cost to an amount greater than the total amount authorized. The estimated CTTY costs by project are presented in Table I belo~+~. If the CITY subsequently elects to make additions to the scope of the project, the Cl`I'Y shall request such additional work in writing. A corresponding adjustment shall then be made to the CTTY's share of the cost based upon the resulting increase in pay quantities and the assaciatcd contrjct bid prices. Fnr work items requested by the CITY that are not covered by the contract bid prices, the COUNTY shall prepare a change order for the Cl"fY's review and acceptance prior to work items being eonst.rueted. 6. `f'he COUNTY will send a monthly invoice to the CITY for the CI'CY's portion of the cost of roadway and drainage improvements. Upon execution of the final pay estimate with the contractor, the COUNTY shall prepare and send a final invoice for any additional amounts payable by the CTTY.
