Department of Corrections Agreement
This Letter of Agreement is made and entered into this 25th day of March, 2011, by and
between the Washington State Department of Corrections, Spokane Community
Restitution Work Crew ( SCRWC) and The City of Spokane Valley, Herein referred to as
"CITY"
This Agreement is between the CITY OF SPOKANE VALLEY and WASHINGTON
STATE DEPARTMENT OF CORRECTIONS, whose address is c/o Community Justice
Center, 715 East Sprague Avenue, Suite 107, Spokane, Washington 99202, herein
referred to as "DOC."
The parties agree as follows:
The Washington State Department of Corrections (DOC) agrees to provide a Community
Restitution Work Crew as agreed below.
A. The Department of Corrections, SCRWC shall
1) Provide grounds maintenance along roadsides, City right of Ways, Non -
maintained swales or other specified areas and projects to include: mowing,
trimming, edging and litter control as needed or by request. SCRWC will, in
most cases, provide the necessary tools and equipment to complete
"landscaping" projects including mowers, brush cutter's (trail blazer),
trimmers, blowers, trailers and miscellaneous yard work tools.
In addition, SCRWC will also assist in snow removal by mutual agreement
and request. (crews are restricted from participating in snow removal that
would require them to be elevated off the ground ie. ladders or roof tops)
SCRWC can also provide labor services including but not limited to:
- Small building projects and community gardens
- Event and Festival set up such as Valley Fest
- Painting
- Litter control and/or Removal and hauling of unwanted debris
- Janitorial
- Clean Green program assistance
2) Provide a Corrections Office (C.O. -2) to supervise participants while on crew.
The C.O. -2 shall be trained in CPR, first aid, and infectious disease and record
keeping.
3) Coordinate work with a designated City of Spokane Valley employee who
will specify the areas to be addressed throughout the Spokane Valley and or
Spokane County.
4) Offer availability of the DOC SCRWC seven (7) days a week, excluding state
holidays. All crew offenders are pre- screened and covered by the Department
of Corrections under State Labor and Industries Insurance.
B. City of Spokane Valley shall
1) Provide by separate letter a current designee or liaison to communicate with
the DOC Work Crew Supervisor on project locations and specifications.
2) Be responsible for maintaining access to a local designated transfer station for
DOC to dispose of any debris collected on behalf of the CITY.
3) Provide the DOC with any additional equipment or tools needed to
accomplish larger more complicated projects.
4) Compensate the DOC with a mutually agreed gas stipend for larger or long
term projects usage. The CITY shall also provide any bags needed for litter
and or debris collection.
1. COMPENSATION The City shall pay DOC TWO HUNDRED FIFTY AND
NO /100 DOLLARS ($250.00) per day, per crew, as compensation for labor furnished
and completed under this agreement. Additionally the CITY shall pay a predetermined
gas stipend as mutually agreed for larger or long term projects.
2. PAYMENT DOC shall send monthly invoices for payment to the City, 11707 E.
Sprague Avenue, Suite 106, Spokane Valley, Washington 99206. The invoice shall detail
the work completed to include dates, locations, mileage covered, gas stipend, if
appropriate and any other additional mutually agreed upon reimbursement costs. Invoices
shall be submitted no later than the 25 of the monthly following "delivery of services."
Payments shall be made within thirty (30) days after receipt of DOC's invoice.
3. COMPLIANCE WITH LAWS Each party shall comply with - all applicable
federal, state, and local laws and regulations.
4. INSURANCE For the duration of this agreement, it is mutually understood and
agreed by each party that the State of Washington and its agencies, including DOC, are
self - insured except as outlined in RCW 43.19.361. It is further understood and agreed by
both parties that the agreement contained herein is excluded from the statutory
exceptions, and therefore the City of Spokane Valley accepts DOC as self - insured and
shall not require public liability and property damage insurance.
