elecVical power and control winng in underground conduit. The Grantor(s) hereby agree nol M obstruct
access to the storm drain pipe, irtigafion line and wiring to the above-0escribed lands. The Grantor(s)
hereby agrees to limit the improvements within the easement to landsraping consisting of gresses,
shallow-rooted shrubs, but not trees or deeply rooted plants. TOe Grantee will not be responsible for
replacement or repair of any improvemenfs that the Grantor may place within the drainage easement, nor
shall the Gran[ee be responsible to repair, maintain, or replace any tlamage to improvements, olher than
replacement of grasses antl shallow-rootetl shrubs [hat are damagetl by work of Grentee in the easemen[
area, that the Grantor(s) or assignees may place in the dreinage easement if the Grentee, at iPS sole
discretion, replaces or repairs the sWrmdrain piping and outfall; stormwater treatment swale including
catchbasins and drywells; future inslallation or maintenance of underground irtigation wateAine; and
electrical power and control wiring in underground wiring.
The City of Spokane Valley accepts wmplete and total responsibility for the construction and perpetual
maintenance of the public drainage fadlilies lorated within said Easement per Prqect # 0113 pWns on file
in the office of the City of Spokane Valley Public Works Department and as amended by the Director of
Public Works. The Grentee shall not be responsible to replace, repair, or maintain any other
improvements.
The Easement and the agreements and duties provitled for herein shall run wkh the land and shall be
binding on, and shall inure to the beneft of the paNes referenced herein, their heirs, successore and
assigns until such time as the temporary drainage easement is no bnger needed by the Ciry.
