electncal power and mntrol wiring in underground conduit. The Grantor(s) hereby agree not to obstruct
� access to Me storm drain pipe, irtigation line and wiring to lhe above-described lands. The Grantor(s)
hereby agrees to limd ltie improvements witliin ihe easement to Wndscaping consis6ng of gtasses,
shallow-rooted shn�bs, but not hees or deepy rooted plants. The Grantee vnll not be responsible for
replacement or repair of any improvements that the Grentor may place within the drainage eaument, nor
shall the Grentee Oe responsible to repair, mainfain, or replace any damage to improvements, other than
replacement of gresses and shallow-rooted shmbs that are damaged by work ot Grantee in the easement
area, that the Grantor(s) or assignees may place in the drainage easement rf the Grantee, at iPs sole
discretion, replaces or repairs the stormdrain piping and ouNall; sWrtnwater ireatment swale including
catchbasins and tlrywells; future installation or maintenance of underground irriga6on waterline; and
electrical power and conirol winng in underground wiring.
The Ciry of Spokane Valley accepts complete and toMal responsibility for lhe consWCtion and perpetual
mainlenance of lhe public tlrainage facilities located within said Easement per Prqect # 0113 plans on file
in the office of the City of Spokane Valley Public Works Department and as amended by the Director of
Public Works. The Grantee shall not be responsible M replace, repair, or maintain any other
improvements.
The Easement and the agreements and duties provided for herein shall run widi the land and shall be
binding on, and shall inure lo the benefil of Me parti�es referenced herein, their heirs, successors and
assigns until such time as the temporary tlreinage easement is no bnger needed by ihe Ciry.
