The following is the title and summary of Ordinance No. 11-018 passed by the Spokane Valley City
Council on the 15th day of November,2011:
AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY, WASHINGTON,
GRANTING A NON-EXCLUSIVE FRANCHISE TO THE UNITED STATES OF AMERICA,
ACTING BY AND THROUGH THE UNITED STATES DEPARTMENT OF ENERGY,
BONNEVILLE POWER ADMINISTRATION FOR A NONEXCLUSIVE FRANCHISE TO
CONSTRUCT, MAINTAIN, AND OPERATE ELECTRICAL TRANSMISSION FACILITIES UPON,
OVER, UNDER, ALONG, ACROSS, AND THROUGH CERTAIN CITY ROADS AND PUBLIC
HIGHWAYS, OR PARTS THEREOF.
Section 1 grants a non-exclusive franchise to the U.S. Department of Energy, Bonneville Power
Administration, to install, locate, construct, maintain, repair, reconstruct, upgrade, operate, use, patrol,
and, if necessary, remove electrical transmission facilities along with lines of poles or structures and
appurtenances thereto, supporting conductors of one or more electric circuits of any voltage and any
communication lines or equipment and appurtenances thereto ("Transmission System"), in, on, under,
upon, over, along, across or through the roads, highways, streets, alleys, bridges, rights-of-way, which lie
within the legal subdivisions within the City of Spokane Valley, Washington. Section 2 explains that the
cost of construction, repair, alteration, relocation or removal of any part of the Transmission System will
be paid by Grantee. Section 3 sets out that the franchise is not exclusive, and Section 4 states that prior to
commencement of any new construction, Grantee will provide work plans and specifications to the City.
Section 5 states that all work will be done in accordance with current standards and codes; and Section 6
states that the City reserves all rights it has or may have regarding City roads, rights-of-way, or other city
property. Section 7 explains that if the City road changes,the Grantee, upon written notice from the City,
will make the necessary readjustment. Section 8 states that the Grantee shall comply with applicable state
laws relating to protection of monuments. Section 9 addresses Vacation of City Roads, Section 10 states
that the Grantee is subject to the Federal Tort Claims Act, Section 11 deals with renovation for non-
compliance, Section 12 gives the Grantee's address, Section 13 states that the agreement will expire
twenty-five years from the effective date, and Section 14 states that the ordinance will be in effect five
days after publication of the ordinance or a summary, in the City's official newspaper.
