City Staff- Dave Mercier, City Manager Mike Jackson, Deputy City Manager Mike Connelly, City Attorney Mike Stone, Parks & Rec Director Ken Thompson, Finance Director Kathy McClung, Community Development Dir Neil Kersten, Public Works Director Scott Kuhta, Senior Planner Steve Worley, Senior Engineer John Whitehead, Human Resources Manager Sara Richardson, HR Tech Jennifer Papich, Recreation Coordinator Greg Bingaman, IT Specialist Chris Bainbridge, City Clerk INVOCATION: In the absence of a Pastor, Councilmember Taylor gave the invocation. PLEDGE OF ALLEGIANCE: Mayor Munson led the Pledge of Allegiance. ROLL CALL: City Clerk Bainbridge called roll; all Councilmembers were present. APPROVAL OF AGENDA: It was moved by Councilmember Taylor, seconded and unanimously agreed to approve the agenda. INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS: Mayor Munson read the "National Hunger & Homelessness Awareness Week" Proclamation. COMMITTEE, BOARD, LIAISON SUMMARY REPORTS: Councilmember Schimmels: stated he had no report. Councilmember Taylor: stated he had no report. Deputy Mayor Denenny: reported he attended the Health Board Meeting where they confirmed the offer made to the candidate, who is still considering the offer, and added that the Board passed their budget but due to underfunding by the State, ten people were laid off who were funded through the general funds, and he mentioned the removal of the Drug & Alcohol Abuse Assessment Program as well. Councilmember Dempsey: said she attended the labor rally several weeks ago at the Fairgrounds, which rally was plush with political candidates including the Governor; attended the Association of Washington Cities (AWC) meeting; went on a field trip to Vantage with the International Trade Alliance; attended a "hire- ability" luncheon celebrating what people with disabilities can do; attended the Convention & Visitor's Bureau (CVB) workshop which explained the function of the CVB. Councilmember Gothmann: mentioned he attended the AWC meeting and complimented AWC on their informative meeting; attended the City of Spokane Public Safety Commission where he spoke concerning Council Regular Meeting: 10 -28 -08 Page 1 of 11 Approved by Council: 11 -18 -08 panhandling; and attended a SNAP retreat where they were in the process of trying to determine what they might look like in the future in addition to their heating assistance and other current programs. Councilmember Wilhite: said she also attended the AWC Meeting; a Chamber of Commerce Transportation Committee meeting; the Greater Spokane Substance Abuse Alcohol Awareness Month presentation; and she chaired the Hotel /Motel Advisory Committee where they discussed allocation of funds to various community entities which recently submitted their funding applications. MAYOR'S REPORT: Mayor Munson reported that he attended the AWC regional meeting where he commented about the possibility of a building moratorium if we can't get the wastewater treatment plant issue resolved, and where he asked AWC to help in that resolution; he participated in the Spokane Transit Authority (STA) Board meeting where his motion was accepted to start the preliminary planning for bus rapid transit, as the Board agreed this is the more sensible routc to go as it is Tess expensive and more flexible than light rail; and he attended the final Community Trade and Economic Development (CTED) meeting on climate change. He mentioned he attended the 911 Board meeting this morning and reported that progress is being made to update to the 911 communication system, and it is anticipated having Crime Check operational around the first of the year. He said he also attended a few Greater Spokane, Inc. events such as a luncheon where they discussed employment of the handicapped. Mayor Munson asked Council for their preference on a winter retreat as it has been determined that the January 10 date will not fit with all schedules; and suggested Councilmembers look at their calendars for a possible week night meeting of perhaps 5:00 p.m. to 9:00 p.m., or even hold two meetings if needed. From brief council discussion, it appeared that a Wednesday night is the least preferred night to hold such retreat; but it was decided a date would be determined later. Council also discussed the procedure of the SAIU) (Sprague Appleway Revitalization Plan) discussions, in order to have more focused deliberation; and it was suggested not having as many items on the agenda so that more time could be spent on SARP discussions; to analyze parcels with accompanying comments; to perhaps focus on "chunks" of pages at a time or systematically move through the document front -to -back; of the desire to have specific goals and to act upon those goals and move on; and of the need to prioritize these discussions to hold them earlier on the agenda for a specified time period, then move on to other agenda items. Mayor Munson said he will meet with staff to discuss the needed procedures to accomplish these suggestions. PUBLIC COMMENTS: Mayor Munson invited general public comment. Ed Mertens. 1310 N Pierce Road: Mr. Mertens read his statement concerning a four -way stop sign at Boone and North Pierce Road as an appeal to the City Traffic Engineer's declination of July 25, 2008. Mr. Mertens' statement included mention of a serious accident he was involved in a block away from his home on December 26, 2007; he mentioned he had about 28 homeowners sign a petition to have the four - way stop sign put in place; and said he was not pleased with the response from lnga Note concerning this issue, and he read Ms. Note's response to him of July 25, 2008 of why the City would not install the four - way stop sign. Mr. Mertens said the corner is dangerous; said his plea is accurate and it better happen as he has other ways to go if needed. Jack Moad, 206 N Sunderland: also spoke to the issue of wanting a four -way stop sign at Boone and North Pierce and said it is difficult to see people corning west on Boone; and going the other way he said he tries to avoid it when possible; but said that something needs to be done. Phyllis Lehr, 823 N Pierce: she also spoke to this issue and said the area is a terrible intersection, is dangerous; there is a church on one side, a through- street on the other, and coming down the hill, people slide right into them; and she hopes for a four -way stop. Council Regular Meeting: 10 -28 -08 Page 2 of 11 Approved by Council: 11 - - Councilmember Gothmann requested that the staff traffic folks provide traffic collision data; and Mayor Munson said the procedure is not to comment on requests as many times those requests require research, and he said Council will ask staff to look into this and report back to the people and to Council. Jack Bean 11717 E 25 Avenue: said he previously wrote a letter and he called inga Note complaining about 16 Ave, Pines and Highway 27; that it is all one big intersection with a combination of signs, lights, and sixteen lanes going in various directions; that there are a lot of accidents there including a severe accident about two weeks ago; he mentioned he was not satisfied with inga Note's professionalism as he was told that the intersection was studied for years; but Mr. Bean said citizens shouldn't have to wait if a known intersection that is highly traveled, is hazardous. Mayor Munson noted that Ms. Kimberly Rasp was in attendance, and staff provided Ms. Rasp the original proclamation read earlier tonight. Ms. Rasp gave her apologies for being late, but said that she was stuck in traffic, and he thanked Council for their recognition of the issue of National Hunger and Homelessness Awareness Week. 1. CONSENT AGENDA: Consists of items considered routine which are approved as a group. A Councilmember may remove an item from the Consent Agenda to be considered separately. a. Approval of Claim Vouchers 15452 — 15827 totaling $2,600,748.03 b. Payroll for pay period ending October 15, 2008: $239,407.54 c. City Hall Site Planning Contract Amendment It was moved by Councilmember Taylor, seconded, and unanimously agreed to approve the consent agenda.. NEW BUSINESS: 2. Second Reading Proposed Ordinance 08 -023 Adopting 2009 Budget — Ken Thompson After City Clerk Bainbridge read the ordinance title, it was moved by Councilmember Taylor and seconded to pass Ordinance 08 -023 adopting the 2009 budget. Finance Director Thompson explained that this is the second reading to adopt the 2009 budget, that Council has reviewed this item for many months, that the only change is that sales tax will be down about. 6% for the current year, but he explained that will likely not present a problem as there are reserves built into the budget. Mayor Munson invited public comment; no comments were offered. Vote by Acclamation: In Favor: Unanimous. Opposed: None. Abstentions: None. Motion carried. Mayor Munson and several Councilmembers expressed appreciation to staff and the finance department for presenting a balanced budget, particularly in these tough economic times; adding that Council and staff have planned ahead for a number of years for a possible economic downturn, by adding funds in reserve accounts, that this takes a lot of planning along with prudent spending in order to keep our services at appropriate levels. PUBLIC COMMENTS: Mayor Munson invited general public comments; no comments were offered. ADMINISTRATiVE REPORTS: Items were discussed in the order shown, in order to give Commissioner Mielke, who was not present at the time but attending a hearing elsewhere, an opportunity of possibly commenting on theIMDL. 4. STA Bus Service — Steve Blaska, Director of Operations Mr. Steve Blaska, Director of Operations for Spokane Transit, explained he was asked to present STA's decision concerning not having bus service while the .Barker Road Bridge is undergoing construction. Per his PowerPoint presentation, Mr. Blaska explained that STA coordinates with local jurisdictions in the construction planning process in order to access impact and develop options; and after showing the area concerned via his map, he explained that the route itself is not affected and there is no re- routing option; that there have been low boardi.ngs at that area totaling fourteen riders per day; that the option of having a Council Regular Meeting: 10 -28 -08 Page 3 of 11 Approved by Council: 11-18-08 special shuttle route or dedicated vehicle would necessitate one to two operators per day at a cost of $125,000 for a weekday split peak; and having that route would necessitate having a paratransit service as well, which led to the conclusion that the high cost with the low public benefit does not justify the use of the resources needed to accommodate that area. In response to questions from Councilmember Dempsey concerning the recently enacted ballot issue, Mr. 13laska explained that voters passed that initiative which was to sustain the current level of funding; and to move funding to this area would mean taking the need from elsewhere, and would therefore result in a zero -sum gain. Mayor Munson and Council thanked Mr. Blaska for his presentation, and Councilmember Schimmels added his thanks as well, and said that he sees six to eight people walking in and out of the industrial area going cast daily, and said he feels Mr. Blaska's figures are justifiable, and he understands the cost. 3. TMDL Report — Neil Kersten /Bruce Rawls Spokane County Utilities Director Bruce Rawls extended his apologies that Commissioner Mielke could not be in attendance as he is attending a public hearing regarding use of conversations future's tax money for purchase of the YMCA downtown, which is apparently running long. Mr. Rawls then explained that TMDL is an acronym for Total Maximum Daily Load, and really means Spokane River Clean up Plan; and said that as Yogi Berra once said: "Predictions are very hard to make, especially when they apply to the future." Mr. Rawls then explained the following: approximately ten years ago, the Spokane River was listed as impaired for dissolved oxygen; which launched a River clean up plan through the Department of Ecology (DOE), which gave their conclusion that the there were excessive nutrients such as phosphorus and nitrogen; that the DOE conducted a scientific model and a study which commenced in 1998 with the first version completed in 2004. The dischargers, those who discharge into the Spokane River, including City of Spokane, Spokane County, Liberty Lake, Inland Empire Paper, Kaiser Aluminum, Post Falls, Hayden, and city of Coeur d'Alene, were all concerned about that and undertook an alternative study called a "Use Attainability Analysis" (UAA) which dealt with discovering the basis for the clean up plan, and to determine what it is we are trying to protect; and submitted that to DOE late 2004. The result of that was that DOE withdrew their draft TMDL report and the Dischargers withdrew the UAA, and everyone pulled together to collaborate. The Environmental Protection Agency (EPA) was involved in that collaboration beginning January 2005; and although the collaboration was expected to be accomplished in ninety days, it wasn't completed until June 2006. In the meantime, discussion was held on performing a collaborative watershed -wide approach to include Idaho and Washington. In late 2005, the EPA announced they were going to issue separate permits for the Idaho side regardless of how Washington's side cleanup was accomplished; and the EPA said they felt justified in doing so. At that time, the Sierra Club, the Dischargers and the State of Washington all objected to that approach as they felt all pollutants should be examined including those discharged into the watershed from Idaho and Washington; but EPA persisted and the group finally relented to that persistence. In June 2006, a plan was formed called a Foundational Concepts Plan, which provided a path forward to at least clean up the River on the Washington side. On that basis, Spokane County proceeded with a facility plan to build a new treatment plant, examined how to meet the requirements for the nutrients into the river; got approval, purchased a site for the plant, received $73 million dollars of SRF loans from the State, and proceed through the process to hire a company under the design -built operate approach. A firm was selected July 8, 2008 and began negotiations. in June of this year, the Serra Club wrote a letter to the EPA in which they objected to the EPA's approach to issuing separate permits on the Idaho side, with the essence of the argument that Washington law allows 0.2 milligrams per liter of impact to water quality, but it doesn't specify if it is across the state line or not. The Sierra Club said that the EPA is allowing the same load on the Idaho side as allowed on the Washington side but the Clean Water Act does not allow for duplicating the load; which means only one load is allowed, and not two plus two. The EPA went back to Washington, D.C. to deliberate and ultimately in early September decided that their decision three years earlier was flawed; and they issued a statement September 26, 2008 stating that the previous decision was flawed and they Council Regular Meeting: I0 -28-08 Page 4 of 1 I Approved by Council: 11-18-08 were going to reverse that decision and that the TMDL needed to be re -done with one computer model that considers the entire water shed, which is what we wanted January 2005. Mr. Rawls further explained that in September, the EPA did not give a clear path forward; as they said they were going to re-do the decision and stated it would likely take six to twelve months. The Discharger group wrote a letter asking for a clearer explanation and plan for how the EPA and DOE would proceed, as there is much at stake and hundreds of millions of dollars. We have learned that the DOE model provided 0.2 milligrams of impact to water in Washington, and the EPA model added another .15; so that is how far over the limit we are, and he explained that EPA and DOE need to revise the scientific model, lower the allowable loads for the Idaho dischargers; look at things referred to as "non- point" sources, such as stormwater runoff, fertilizers, agricultural practices, septic tanks, to see if that load can be further reduced to reach the limits. Although the indication is six to twelve months to accomplish this, Mr. Rawls said he feels this will more likely take at least twice that long, based on their historical progress, the complexity of issues, and number of involved players. Meanwhile, regarding Spokane County's new wastewater treatment plant, which is proposed to serve the Valley, negotiations have been completed on a draft service agreement with CH2M Hill; the County adopted a hearing notice for November 1 8, and under state law a hearing is required on the draft service agreement; they anticipate signing that contract in December, and they would complete construction of the new plant at the end of 2011, and have it operational January 2012. In answer to a question some might pose of why move forward with a very expensive treatment plant not knowing the TMDL outcome, Mr. Rawls said that they think that a membrane- filter treatment is going to be a part of the solution regardless of the TMDL outcome; it is suitable for river discharge, for aquifer recharge, for water that would go to a wetland restoration project, and for irrigation of golf courses, so Mr. Rawls said they feel this is the right solution and it is an adaptable solution. However, he said there is a risk that once 2011 arrives and if the TMDL is not resolved, we could not get a permit to operate; and the risk would be mothballing the treatment plant for a time and perhaps do modifications for an ultimate resolution. The cost to carry the debt and pay for mothballing the plant is roughly the same cost as the inflation cost of delaying the treatment plant. lithe decision was made now to withdraw and not sign a contract and come back later and start the process over; the monthly cost of inflation is roughly $400,000, which is roughly the same cost to carry debt service and mothball the plant. Mr. Rawls said he believes the plant should be built and we should proceed on a variety of options for disposal of effluent once we get to that point. Regarding capacity and whether a moratorium might be forthcoming, Mr. Rawls said that this is the second reason why he feels we should proceed with the treatment plant. It takes approximately three or four years from the time to start until a plant is operational. Mr. Rawls said he performs trend analysis about every three to six months on how we are doing with our remaining capacity; that we currently have about 1.6 to 1.8 million gallons per clay of unused treatment plant capacity; that our increase in flows has diminished due to the economy forcing less new homes thereby resulting in substantially less growth; in 2004 mandatory sewer connections on the septic were no longer enforced until the plant could be completed; so the growth rate has gradually tapered off. On the current growth rate, Mr. Rawls said he predicts we will hit the ten million gallon limit in approximately 2014 if' there is no change in the economy which would increase the growth rate, and if there are no new large customers such as a processor or industry needing a lot of capacity. if all the septic tanks were suddenly connected, and if all subdivisions currently vested or approved had to be served, the flow committed to would amount to eleven million gallons, and we own ten. If we did not proceed with this treatment plant now because of the uncertainty, Mr. Rawls said he would recommend to the elected officials that we have a moratorium, as the risk starts of eventually having significant liability. The liability comes about when you approve a plat, and if you don't have capacity, there is potential liability to developers who would expect such capacity to be provided. Mr. Rawls said he remains cautiously optimistic this whole thing will be completed without the need for a moratorium. The treatment plant proposed to be built is the most sophisticated treatment plant in the United States, with the most stringent limits; it would remove over Council Regular Meeting: 10 -28-08 Page 5 of 11 Approved by Council: 11 -18 -08 90% of the current nutrient Toad that is going into the Spokane River; as once the plant is completed, it would remove 99% of the phosphorus that comes in; and the discharge would be fifty parts per billion; which means if there were fifty billion balls, fifty of there would be phosphorous. Mr. Rawls said that the UAA could do two things: look at thc existing and obtainable uses in the river, which means what kind of fish are there or what kind of fish could be there for the habitat currently in place; then set water standards which are protective of those uses; and the other approach is that it could set a site specific criteria which could be different from the state -wide criteria we are currently operating under. Mr. Rawls said the challenge of doing a UAA is it is very complex with numerous variables, and it takes a long time to perform; and might not be accepted by DOE; and if the UAA were to be brought back out, it would likely need substantial revision. Mr. Rawls mentioned that James Bellatty, Section Manager of the DOE's Water Quality Program is in attendance tonight to answer questions. Councilmember Taylor asked about plant capacity and if there are any plans to ration the space and /or set priorities for the remaining space; and Mr. Rawls answered that that issue has not been discussed; that policy and practice has always been that if there is capacity, they would provide service to everyone who needs service within the Urban Growth boundary; but said a prioritization schedule or system has not been considered. Councilmember Taylor then asked if the County is currently providing capacity or transference capacity for the Liberty Lake Sewer and Water District because of the troubles they are experiencing in their plant expansion; and Mr. Rawls replied no; and said he believes Mr. Taylor is referring to an interlocal agreement which was executed perhaps 1994 that said that should they need capacity, they would be able to connect into the County system; but Mr. Rawls said when he saw this issue beginning to appear around 2001 or 2002, he wrote there a letter seven or eight years ago telling them there would be no capacity for them. Councilmember Taylor further mentioned that most of thc funds that have been allocated toward severing Spokane Valley have primarily been for the purpose of septic tank elimination, and to get the nutrients out of the groundwater by connecting the houses with septic tanks, to sewer; and he asked if that would be a possible prioritization rather than going into currently undeveloped areas. Mr. Bawls said he hesitated to answer that as it is more of a policy decision, and he would be glad to pass those concerns to Commissioner Mielke. Councilmember Taylor continued that we want to ensure that the City's growth is not shut off at the expense of someone else; and if there is no more capacity, everyone will be vying for what little capacity remains. Mr. Rawls said that at Spokane County, they have had no discussions on how to implement a moratorium, or what order the areas would be served, i.e. county first or cities first; but Mr. Rawls said they feel they will have a solution; and there will be places to go with the extra effluent in the future. However, if challenges continue, and if delays continue, and if a permit would not be forthcoming, Mr. Rawls said that even as a plant is being built, a decision could also be rendered whether to have a moratorium. Mr. Rawls said regarding the STEP (septic tank elimination program), when they switched from mandatory connection to voluntary in 2004, they have seen a fairly dramatic decrease in changing out of the septic tank system; with only about 25% to 30% of those households voluntarily moving forward to sewer connections. Mayor Munson asked about the availability of CDBG (Community Development Flock Grant) funds to help with connections, and Mr. Rawls said that those funds are available depending on household income, and in some cases it helps pay for the mainline connection in the street, and in other cases helps pay the home connection; and for those people, Mr. Rawls said they recommend not waiting but getting connected while the funds are eligible in that neighborhood; as those funds are only available for a limited time period. Regarding meeting the standards of river discharge, Mayor Munson said that today's technology does not meet the standards, which makes one consider if the standards should be changed, or shut down specific areas; and he asked about thc possibility from DOE's perspective, of gaining the required momentum to get those standards changed. Mr..lim Bellatty responded that changing the standards is a difficult if not impossible task; and said DOE has been told that by the EPA, which is the agency that reviews and Council Regular Meeting: I0 -28 -08 Page. 6 of 11 Approved by Council: 11 -18 -08 approves DOE's proposed changes; that that road is a bumpy one with slim possibility for change; that there were numerous conversations with the EPA and there was no agreement if the proposal would make it, which is the point where the DOE decided to pull back and try something different. Mayor Munson said that the EPA clearly stated in a previous presentation, that the standards adopted by Washington State are not attainable with current technology; and they recommended going with the UAA as an alternative; which is simply another way of suggesting the standards be re- visited; and he asked since the standard is ours, why can't we change it. Mr. Bellatty said the door is still open on the UAA procedure; and said when they went through the foundational concepts exercise referenced earlier by Mr. Rawls, they agreed if all the necessary steps are taken to achieve the standard, and we still can't meet it, that is when they would be willing to entertain the UAA approach; and said it is not on the first year of the ten -year compliance program, but is more toward the end of that period; and that DOE wants to do everything possible to reduce the pollution load to the river before going the - UAA procedure; and the details are being worked out now among the interagency group of EPA, DOE, State of Idaho, and the Spokane Tribe. Mayor Munson added that there is a significant time limitation, that there have already been four years of negotiations and we cannot afford waiting another four years. Mr. Bellatty agreed, and said his best guess as to how much more time it will require according to his staff's report, is they feel by the end of 2009 they should be able to have a new and improved water quality improvement proposal that can be submitted to EPA; and that we have to figure out a way to meet the standard. Mayor Munson reiterated his question if the technology does not exist, how does one get there'? Mr. Bellatty said the technology can get us a long way down the road, and they believe there are other complimentary ways of accomplishing that same thing; and one of the concepts thcy came up with during collaboration was the delta elimination concept, whereby if you can't get to meeting the stringent standards, are there other ways to get pollution out of the river; which is where they are now in trying to determine how to find other sources, account for them, and remove them from the river to make up the difference; and he said his agency is open to input and suggestions. Mr. Bellatty said they now have a bigger group to work with including the State of Idaho, Spokane Tribe, and the EPA; with the goal also of getting all those involved updated on the progress and issues to date; and said the immediate goal is to get to the implementation stage of all this planning, and to get there as soon as possible. Councilmember Taylor asked who sets the standards for water quality, and Mr. Bellatty responded that the DOE does the legwork for the science that puts packages of this information together, but ultimately the legislature approves the standards. Mr. Rawls added that the water quality standards are prepared by the DOE but the ultimate approval is by the EPA; and the State of Washington on their water quality standards had a large challenge getting the EPA to approve those the last go- around. M.r. Rawls added that EPA has written a guidance manual for how to do a UAA, in their policy their encourage UAA, but there are some staff in Region Ten, which is our region, who are not very receptive to UAA; and said in the past they have tried to resolve this problem as mostly a science problem, and if as a group they decide to move forward with the UAA, then he feels it should also be treated as a political problem because it is a policy issue as well as a scientific issue. Deputy Mayor Denenny asked if a wetland were discovered in which the problems of low water flow were worked out, what would be the cost involved? Mr. Rawls said they are looking at Saltese Flats, had a meeting a few weeks ago, it is 340 to 500 acres, they performed a reclaimed water study which is on the County's website; and they are doing a study now to quantify the benefit to the low flows into the Spokane River, and they will be modeling that; and regarding cost, the current estimate for the treatment plant and the pump stations and pipelines is S170 million; and in order to dispose of the effluent at Saltese Flats, that is an estimated additional $40 million; which would mean a cost of over $200 million to get eight million gallons a day of treatment capacity; and the cost of doing such six years ago was $73.4 million, or $100 including the pump stations so the price has doubled; and the reasons for that increase is due to large construction inflation during the last few years on treatment plants; and the technology has become more stringent under this river clean up plan. Mr. Rawls said the County has not studied how Council Regular Meeting: 10-28-08 Page 7 of 11 Approved by Council: 11 -18-08 much the extra $40 million would cost citizens, but said they will bring their rate consultant back within the next two to three months; and said when they received the bid from CH2M Hill, the bid substantially exceeded the previous estimate, so a new rate analysis needs to be determined on that new bid; and without going to Saltese Flats, the rate structure will need revision just to build the project; and if a pipeline has to be built to Saltese Flats and improve that area, it would be another increment higher. Mr. Rawls added that one could take a scientific approach on UAA, and can also take an affordability approach; and if the threshold is exceeded by 2% of the median household income for water, sewer and garbage, then you may have some relief from the technology requirements; and have also discussed doing an economic analysis for hardship, and said they may be getting close to that. When the County did their facilities plan, Mr. Rawls said they looked at delta elimination, and the County is doing a STEP, and each tank eliminated reduces phosphorus loading into the. aquifer, and said they were fortunate to come up with a robust delta elimination; so they know where theirs will be, but added that the City of Spokane and Liberty Lake and all the other dischargers do not have a STEP; and it would be millions and millions of dollars for the City of Spokane, perhaps hundreds of millions; so it is not about whether one can build the treatment plant and get good technology, but where do you get the delta elimination to get down to that low standard; and said he does not know if that will be achievable by some dischargers. City Manager Mercier asked Mr. Rawls if he anticipates that the County will sign a contract for the construction of the new plant prior to the rate consultant's analysis of' impact; and Mr. Rawls said he does. Mr. Mercier also asked when is the projected completion date for the STEP, and Mr. Rawls responded that it is hoped to accomplish such in 2011 or 2012; and that there is a meeting tomorrow with the financial advisor regarding bonding, bank loans, and funding issues; and said there are several economic issues present now which were not present four months ago. Mr. Mercier also asked about plant construction financing, if the County signs a contract in December, when would a bond activity be required to acquire funds necessary to pay for construction costs? Mr. Rawls said he would likely have a better answer at noon tomorrow after they meet with their financial advisor, that the initial idea four months ago was to take out interim bank financing; then have one large bond issue toward the end of the project; and added that he is not motivated to sign a contract for $140 million just to discover later of the inability to borrow funds to build. Mayor Munson asked if Mr. Rawls would share with the commissioners, Mr. Munson's personal opinion; in that he feels we arc headed for a recession, and if we are forced to have a building moratorium, this area would not be in a recession, but rather a depression, and one way out of a recession is to build your way out; but if that is impossible, we would lose many developers who would simply develop elsewhere; and he said we want to work with everyone, including the DOE, to ensure this does not happen. Mr. Rawls said he is not recommending a moratorium, but said he would be remiss if he did not advise the policymakcrs of all factors which could come into play; and if we get to the point where it appears we will not get a permit or we actually do not get one, then we would be facing a moratorium; or come up with an alternative solution to move this issue forward, and perhaps by even engaging the Governor; and that this needs to be handled now as a policy issue. Mr. Mercier asked if there is a possibility where we could come to a point where it is unlikely we will be able to open a plant, and he concerning the remaining capacity, he encouraged Mr. Rawls to work with the County Commissioners to start thinking about how to stretch that capacity by prioritizing use; and said that if that work is not undertaken now, we will all be caught by surprise should the notice come that we cannot build; which would then create a crisis to preserve even thinner reserves. Mayor Munson and Councilmembers thanked Mr. Rawls and Mr. Bellatty for corning tonight to address this important issue. 5. Fee Resolution Amendments — Ken Thompson Finance Director Thompson explained that the draft resolution shows suggested changes; that most changes arc moving the items within the resolution from one place to another; that departments continue to review the changes; and that staff continues to work on comparative figures showing our fees Council Regular Meeting: 10 -28 -08 Page 8 of 11 Approved by Council: 11 -18 -08 compared with Spokane County and the City of Spokane, and will also flag which fees have changed over the last five years; and will bring that information at the next iteration of this resolution. Regarding the cost of living increase, Deputy Mayor Denenny said he would be willing to look at that increase on those items which have not changed over the last few years; Mayor Munson stated his preference to cover costs if fees are not meeting costs, but was not in favor of raising all fees. Mr. Thompson brought council attention to his PowerPoint where it shows the average fee increases in other cities, and that our departments which provide the services, in the last three years, our costs in those departments has increased 16% per year; so an overall 10% increase would still be prudent. Councilmember Taylor also stated his preference not to have a cost of living fee increase as these costs are examined annually; that each fee should be tested on its own merits; and as we move into a recession, he said now is not the time to have a general fee increase; and stated regarding the pre - application meeting fee, as the meeting is sct to help streamline the process and ward off potential problems, that he feels the mandatory meeting should not be accompanied by a fee. The Fire Code fees were also mentioned and Mr. Thompson explained that these figures, which represent a 10% increase to cover costs, arc supplied by the Fire District; that the fees go to the fire district and the City receives a $35.00 fee each time a fee is charged as we handle the fee for the fire district. Councilmember Gothmann mentioned something to keep in mind is that rather than raise fees substantially in future years to catch up on rising costs, it might be better to initiate a small fee increase now instead of a more substantial fee later. 6. Universal Playground Site Recommendation — Mike Stone Parks and Recreation Director Stone went through his PowerPoint presentation, he explained the purpose of a Universal Playground, explained about the stakeholder meetings, and as per the information on the October 28, 2008 Request for Council Action form, went over the pros and cons of the site options including site criteria; explained that the site options are: (1) located at the most southern end of Mirabeau site just south of the existing CenterPlace parking lot: (2) site of the original MasterPlan Location; and (3) On the north end of the site at Mirabeau Meadows Park, adjacent to the restrooms, near the stage and parking area. Mr. Stone also said a survey needs to be initiated prior to winter, and the data needs to be available in order to complete the design and construction over the winter in order to stay on schedule and have the park constructed by fall. Based on feedback received, the design team determined that option 2 was not sufficient for the new Playground as it is narrow, has insufficient. parking, areas of extreme grades, and is adjacent to a busy road; hence option two was removed as a potential site; and the final group consensus was to bring a recommendation of option 1 as the preferred site as it is adjacent to adequate parking, has a size which allows for expansion, can be done in phases, the location will complete and enhance the CenterPlace landscaping, will be visible to attract users, and more observable for security, and will help market CenterPlace. Aber brief discussion, there was Council consensus to proceed with Option 1: the south side location. Mayor Munson called for a recess at 8:02 p.m. and reconvened the meeting at 8:17 p.m. DELIBERATION: 7. Sprague/Applewav Revitalization Plan Book ill. City Actions — Scott Kuhta Community Development Director McClung stated firer she appreciates Council's discussions on ways to enhance Plan deliberation as staff has also pondered this issue; and that every session staff would like to begin with a brief written summary of what was accomplished and discussed during the previous deliberations; and said that she will take notes during the meetings so council can readily see the issues agreed upon, as well as those issues which need further information or clarification. Ms. McClung said last time, Council discussed nonconforming issues; and at the next meeting where the Plan is discussed, staff will bring examples of applying nonconformartce to specific properties as well as examples of what other cities do with nonconforming issues. Ms. McCl.: ig continued by explaining that tonight's goal is to make a decision concerning the one - way /two -way is..u., and if such decision can be reached tonight, this Council Regular Meeting: 10 -28-08 Page 9 of 11 Approved by Council: 11 -18 -08 will give staff a tremendous advantage as they work to adjust the plan in accordance with whatever decision is made. Senior Planner Kuhta went through a brief PowerPoint which reviewed the overall transportation policies in the comprehensive plan as he explained that the Subarea Plan must be consistent with the comprehensive plan; then he moved to the council approved Subarea Plan intent statements on transportation; he also mentioned the one revitalization strategy relative to the transportation issues, which is to "implement phased transportation, design street scape improvements to enhance mobility and access for motorists, bicyclists, and pedestrians, and in keeping with city and regional growth, while simultaneously supporting the land use and development pattern necessary to the upgrading of properties as envisioned by the Subarea Plan." Mr. Kuhta went over the four alternatives for transportation along the corridor, projecting out to the year 2030, all as seen in the transportation analysis report prepared by Gladding Jackson, and added that the growth numbers do not take into consideration any increased percentage in ridership, adding further that the number of vehicle miles traveled in the United States dropped four billion miles in August of this year compared to August of last year; and that the options are: (1) the no- build, (2) full, one -way couplet extension, (3) the hybrid where the road transitions from one -way to two -way at Dishman -Mica (or thereabouts); and (4) a full two -way cross street, which is the recommended system. Mr. K.uhta further explained that the heaviest part of the commute would be from Thierman to MuIlan, and he discussed the various levels of service based on the different options; and said that the hybrid option is one -way to Dishman -Mica, and somewhere along there, will be a transition to two -way, with the Thierman to MuIlan remaining one -way. Mayor Munson said that the numbers discussed in locating city center, aren't the same its the numbers displayed tonight; and in looking at traffic flow on Appleway, we were figuring 1500 cars, which equates more toward the Appleway that precedes the City Center; and he asked for clarification on the numbers. Public Works Director Kersten said that the numbers are trips that enter on the west side and move all the way through; in looking at the far side there are only twenty trips, so the 1940 trips that enter at 1 -90, only twenty of them go all the way through the system; but there are many more than tw my at the other site, so it does not account for all the other trips, and most trips don't go clear across the corridor but rather come up University, go down Sprague, head up Pines, so they are intermittent trips that catch the system, and this does not display the amount of traffic on the streets at one time, but is tlie amount of time that moves all the way through the system. Councilmember Wilhite said in relation to which option to choose, that she spoke with several auto row new car dealers, and Jeremko is both on the corner of Thierman and Sprague and the owner indicated he has access from two areas and therefore has no objection to remaining one -way; that the owner of the I-Ionda Dealership has no preference; but the one most landlocked is the Hyundai Dealer, and that his top choice would be one - way /two -way, but he sees some advantages when the area is signified as an auto - row gateway, and if we were to come with a plan to help bring some attention to that arca, he thought it would be a benefit for him and he would not strenuously object if the area remained one -way. Mr. Kuhta concurred that was the sane testimony given during, the Planning Commission public hearings, and that the Hyundai owner said that one -way or two -way doesn't matter as it is a destination; and said he felt the plan was visionary, and if you like Sprague the way it is then don't do anything. Mr. Kuhta stressed that of the total $42 million cost, $24 million is the Appleway Extension. There was also brief discussion concerning costs, including the possibility of acquiring state funds through grants. Mr. Worley also explained that concerning the lane changes, sidewalks and greenspace, the two -way option or the hybrid option include the narrowing of Sprague Avenue; so instead oldie current seven lanes, the curb would be brought in towards the center to create five lanes; and the area between the existing curb and the new curb would be that landscape area estimated in the plan i : terms of streetscape; and said that sidewalks will be larger; that the current sidewalks on Sprague are sup- standard, so any improvements would at least bring those sidewalks up to standard, which is a six-foot wide sidewalk; ancl said while there are bike lanes planned for Appleway, there are none for Sprague as we ran out of room in trying to keep the sidewalks Council Regular Meeting: 10 -28 -08 Page 10 of I 1 Approved by Council: 11-!8-08 and landscape on that section. Mr. Kuhta mentioned the plan is for east/west bike lanes on both sides of Appleway; and sidewalk width is dependent upon which zone in which is rests. Mr. Worley also brought up about the corridor level of service, and if it included the intersection level of service; and that there are two ways of determining level of service: one is the intersection and how well it operates and how much delay there is in any direction at that intersection; and the corridor is from one end to the other, which includes the delay at every intersection. Mr. Worley added that concerning the idea that there is one -way all the way to MuIlan, that the. hybrid system on Sprague between Argonne and MuIlan is a two -way street; and provides an opportunity for people coming south on Argonne to turn left onto Sprague and not have to go all the way to Appleway and then cross back over. Mayor Munson suggested, since we have no indication we will get access to Appleway, that issue should be addressed later; and he suggested moving forward with changing Sprague between Argonne and Sullivan to two -ways, but not do so until development starts at City Center; and keep the lanes at four ways because of the delay of getting Appleway completed, to have two lanes in each direction; so to work on the section between Argonne and University and change that to two -ways, and have it in the plan so when development bei ins, the change can be made, and to keep Appleway in that same section four lanes total, with two lanes in each direction. Concerning specifically what is development at City Center, Mayor Munson said perhaps building city hall would be a start, but that would be something to be determined. Councilmember Taylor said that we will Finish this process with the zoning, and once it is enacted and development occurs within the particular zones, in terms of timing any change, it is a matter of as soon as the plan is adopted, we would be ready to move in that direction once the funding occurs. Deputy Mayor Denenny asked if we don't change those and people come in for development, how that would affect applications, and how would businesses decide egress and access. Mr. Kuhta said if you do the development prior to turning the roads, you would have to take into account where the future curbs would be and we would need to work with the businesses on the road design, curbs and sidewalks; and if the direction doesn't match, it would be troubling. Councilmcmher Gothmann suggested that the hybrid model be the one to a,:opt as the twenty year plan for the City; and the number of lanes can be discussed later. There was Council consensus, with no Councilmcmbers dissenting, to adopt Alternative Plan 13 — the Hybrid Model, and only address the two -way on the current couplet between Argonne and University. Sprague Avenue, Suite 106 Spokane Valley, Washington 99206 Dear Ms. Note: Per our phone conversation of the other day, we want to discuss with you the problem we have with the intersection of Pierce Rd. and Boone Avenue, Pierce Rd. runs North and South and Boone Avenue East and West as you well know. With stop signs on Pierce Rd. only 1 myself was in a very serious accident on December 26, 2007 at 2 :00 PM and was very lucky to come out of it unscathed as was the other driver. Both vehicles were heavily damaged and 1 feel something must be done about this traffic hazard before someone is killed, or severely injured. Because of the failure to not see the other vehicle in the blind spot in my windshield, 1 attempted to enter the intersection and he hit my vehicle. Pierce Rd, Spokane Valley, WA 99206 Re: Request for stop signs at Boone/Pierce Dear Mr. Mertens, The Public Works department has received your request for a 4 -way stop at the intersection of Boone and Pierce, .Stop signs are not installed through a petition or hearing process. Per city code that decision is made by the Traffic Engineer, and their installation must be justified by an engineering study. State law requires us to follow the Manual on Uniform Traffic Control Devices (MUT D) for decisions on intersection control. The MUT D states that "stop signs should not be used for speed control ", and provides guidelines for when stop signs should be installed, Due to a lack of traffic volume data we were unable to complete the full analysis. Since none of the other guidelines were met it is unlikely a 4 -way stop will be warranted. However, a follow -up study will be conducted this summer once we have seasonal staff to conduct traffic counts, You also requested collision history for the intersection so I've attached the data from Jan 2003 through Sep 7007, There was only one reported collision during that time period. Pierce Rd. And Boone Avenue. Since 1 built my house at 1310 N. Pierce Rd. in 1958, 50 years ago, 1 have seen a tremendous change in housing development and traffic change. When I included the signatures for 27 different families on N. Pierce and Boone Avenue They all had confirmed the need of a 4 -Way Stop as we have had 8 new houses go up - across the street from our house in the last 2 years. Many of them indicated how unsafe they felt the intersection to be. Knowing that the (MUTCD) requires the intersection controls, we did not want to indicate speed control as to defind blind conditions especially in winter months. Spokane Valley, WA 99206 Re: Intersection of Boone Avenue and Pierce Road Dear Mr. Mertens: Thank you for sharing your concern with the City of Spokane Valley. The City has considered your request and will not be installing a four -way stop at the corner of Boone Avenue and Pierce Road. I have outlined the reasoning for this decision below: 1. Four -way stop control is used where the volume of the intersecting roads are approximately equal. After collecting data, we found that the volume on Boone Avenue is over two times the volume on Pierce Road. 2. The intersection does not meet the criteria of the Manual on Uniform Traffic Control Devices (MUTCD) for a four -way stop application. Four -way stops can be used when there is an unusually high collision rate that could be corrected by the change, or when the rninimum vehicular volume entering the intersection averages at least 300 vehicles 'per hour over any eight hours of the day. Based on our data, the highest volume entering the intersection was 85 vehicles per hour. 3. Installing a four -way stop will create noise for the residents near the intersection due to vehicles accelerating and decelerating at the stop signs. However, based on the volumes and sight distance, thc intersection does meet the criteria for a two -way stop. If you have any questions, please call our office at 921 -1000.
