Minutes - 03/23/2006 Spokane Valley Planning Commission Approved Minutes Council Chambers — City Hall 11707 E. Sprague Ave March 23, 2006 I. CALL TO ORDER Commissioner Kogle called the meeting to order at 6:00 pm. II. PLEDGE OF ALLEGIANCE The Commissioners, Staff and Audience stood and recited the Pledge of Allegiance III. ROLL CALL Commissioner Beaulac — Present Commissioner Kogle — Present Commissioner Blum — Absent, excused Ian Robertson — Present Commissioner John G. Carroll — Present Marcia Sands - Present David Crosby — Present Staff attending the meeting: Marina Sukup, Director of Community Development, Cary Driskell, Deputy City Attorney, Deanna Griffith, Administrative Assistant IV. APPROVAL OF AGENDA Commissioner Robertson moved that the March 23, 2006 agenda be amended to place new and old business in front of all other agenda items. Second by Commissioner Crosby. Motion passed unanimously. V. COMMISSION BUSINESS A. NEW BUSINESS: Public Hearing: Regarding the consideration of an ordinance amending SVMC 10.30.060 to provide a definition for ��off-road vehicle use" and to list which zones in the City in which off-road vehicle use will be prohibited. Deputy City Attorney Driskell briefed the Commissioners that they are proposing a definition for ��off-road vehicle" usage and in which zones they should be prohibited from, which is all residential zones. This is not intended to apply to toys. Would it help to add to the definition the fact that it must be operated by humans? The vehicle does not have to be licensed since all off-road vehicles do not need to be licensed. Commissioner Sands stated that she would like to make a disclosure. She stated she is a dirt bike rider, belongs to a dirt bike club called Panhandle Trail Riders Association and is a Tread Lightly Master Trainer a club that teaches responsible off-road usage. Deputy City Attorney Driskell asked Commissioner Sands considering her involvement in those groups did she feel she could consider this matter in an unbiased fashion, she indicated that she could. We have been living ne,xt to a back yard track for 2 years. We can not use our back yard, we have no family time outside, we can not have family gatherings, the noise is unbelievable not to mention the amount of dust that is created. This has affected our quality of life. They start the motorcycles up at first light and go until after dark. The noise is all day and it is not just them but they invite their friends over too, all summer and mild days in the winter. We are not looking forward to another summer of not being able to enjoy our yard or go outdoors. Please help us. Mrs. Halverson submitted pictures of the track that is ne,xt to her home. Written comments submitted by Becci Carlson supporting the changes states it is an e,xtreme noise problem. Ms Carson must rest for a health issue and can not do so due to the noise levels. Richard Schotzka, 19108 E. 2" Ave, lives directly behind a backyard off- road vehicle track. Only a chain link fence separates the yards. Thank you for considering this issue and thank you to Cary and his staff for all their assistance. He has been also following the state legislature which is also trying to define this subject and help people like him and his neighbors. You can not believe the noise and the disturbance it causes. We can not have any outdoor activities, no BBQs, no family time. This man just moved in, did not introduce himself to any of the neighbors and started tearing up his yard. It isn't just the noise and dirt, they start bon-fires and then just walk away and leave them burning. There is no peace, there are no quiet evenings. 20 minutes away there is an ORV park but they choose to ride in their back yard instead and annoy everyone else. Mike Edwards, 19205 E. 4 Ave., Mr. Edwards stated he lives two houses away from a backyard racetrack, been living there for 18 yrs. Been quiet all this time. This man moved in, with no consideration to any of his neighbors, tore up his yard and started in with the motorcycles. He brings in other people with motorcycles and causes other problems. This is a continuous thing, even in the winter. It is their whole back yard; the whole thing is a track. Really do appreciate the Commission working on the definition and consideration they are giving this subject. I live two houses away and it bothers me, I can not imagine what it is like for someone who lives right ne,xt to this. We are hoping to improve things for everyone and not make it a nuisance any more. Seeing no one else wishing to speak, Commissioner Kogle closed the public hearing at 6:20 pm. Commissioner Crosby made a motion to recommend to the City Council approval of the ordinance creating a definition for off-road vehicle usage and which zones it would be prohibited in. Second by Commissioner Robertson. Vote passed in favor unanimously. March 23, 2006 Planning Commission Page 2 of 4 Spokane Valley Planning Commission Minutes Public Hearing: Regarding an ordinance amending the sign code to include bus benches in the public right-of-way and the advertising on them. Deputy City Attorney Driskell explained to the Commission that this ordinance would allow bus benches and transit enclosures within the public right of way. It allows that public purpose is served by the benches but the sign code will be amended to address the advertising that would be allowed on them. There is also included in the packet a copy of a sample contract which states the maintenance, the amount allowed at one stop, the distances. The public hearing was opened at 6:27 and closed at the same seeing no one who wished to testify. Commissioner Sands made a motion to recommend to the City Council approval of this ordinance regarding the bus benches in the public right of way and the advertising on them. Second by Commissioner Carroll, passed unanimously. B. OLD BUSINESS: Public Hearing: Regarding an ordinance amending SVMC 10.309.060 by amending Chapter 14.623 Business Zone Matrix of the Interim Zoning Regulations relating to Plastic Injection Molding. Director Sukup said that the Commission had been briefed on this subject prior and that new definitions had been sent to them but that the ordinance had been amended to state that Thermoplastic Plastic Injection Molding process should be allowed in B-2 and B-3 zones and that the Thermoset and Solvent molding processes should be allowed in the Industrial zones only. Commissioner Crosby made the motion to take this subject off the table. Second by Commissioner Robertson, passed unanimously. Public hearing was opened at 6:31 and closed at the same with no one to testify. Commissioner Crosby thanked Mr. McCall for all of his assistance in this matter. Commissioner Beaulac moved to recommend approval to the City Council this amended ordinance in regard to plastic injection molding — thermoplastic being allowed in the B-2, B-3 zones. Second by Commissioner Robertson, passed unanimously. VI. APPROVAL OF MINUTES Commissioner Robertson moved that the March 9, 2006 minutes be approved as submitted. Commissioner Crosby seconded the motion. Motion passed unanimously. VII. COMMISSION REPORTS Commissioner Sands reported that she attended a Planning Ethics workshop. Carol Barrett was the speaker and it was a very good workshop. Discussed how ethics come into play and tools to deal with them. Commissioners Beaulac, Crosby, Robertson, Carroll and Kogle had nothing to report. IX. ADMINISTRATIVE REPORTS Director Sukup stated that the City Council had received an update on how the sign code compliance effort is going and that there were a handful of people there to express their distress with the code. The City Council stated that the sign code was a work in progress and that they would continue to look at it. Council also approved to begin negotiations for the Sprague/Appleway Sub-Area Plan contract. X. FOR THE GOOD OF THE ORDER Nothing for the good of the order. XI.
