Minutes - 04/22/2010 Spokane Valley Planning Commission Approved Minutes Council Chambers — City Hall, 11707 E. Sprague Ave. Apri122, 2010 L CALL TO ORDER Chair Carroll called the meeting to order at 6:03 pm. IL PLEDGE OF ALLEGIANCE Commissioners, staff and audience stood for the pledge of allegiance IIL ROLL CALL Commissioners Carroll, Hall, Mann, Sands, Sharpe and Woodard were present. Commissioner Eggleston was absent. Staff attending the meeting: Kathy McClung, Community Development Director; Scott Kuhta, Sr. Planner; Lori Barlow, Assoc. Planner, Micki Harnois, Assoc. Planner; Deanna Griffith, Administrative Assistant. IV. APPROVAL OF AGENDA It was moved by Commissioner Woodard, seconded and unanimously agreed to accept the Apri122, 2010 agenda as presented. V. APPROVAL OF MINUTES It was moved and seconded to approve as written the minutes from the Deo-10- 2009, Jan 14, 2010, Jan 28, 2010, Feb 11, 2010, and Feb 25, 2010 meetings. VL PUBLIC COMMENT There was no public comment. VIL COMMISSION REPORTS Commissioners Sands, Hall, Woodard and Carroll gave their reports. All have been following and or attending the City Council meetings. VIIL ADMINISTRATIVE REPORTS Director McClung reported she had provided the upcoming schedule for the revisit of the adopted Subarea Plan, which had been approved by Council. 04-22-2010 Planning Commission Minutes Page 1 of 3 IX. COMMISSION BUSINESS A. New Business: Public Hearing — Shoreline Master Program Shoreline Inventory and Characterization Report. Associate Planner Lori Barlow: Associate Planner Lori Barlow gave a presentation regarding the shoreline inventory/characterization report. Ms Barlow explained the process for the Commissioners and the basic information. Consultants from URS Corporation John Patrouch and Dept of Ecology representative, Doug Pineo assisted Ms Barlow in answering questions from Commissioners regarding the report. After reading the Commission rules regarding public hearings, Chair Carroll opened the public hearing at 7:08 p.m. — Seeing no one that wished to testify he closed the public testimony at 7:09 p.m Commissioner Sands made a motion to forward the Shoreline Inventory and Characterization Report to City Council for their acceptance by resolution. Motion was seconded. Commissioners continued to ask questions regarding the report and issues regarding buffers, no net loss, water rights, setbacks, Mr. Pineo, DOE, stated he has been involved in SMP updates around the area for more than 20 years and that this report is by far the best he has seen so far. The City has the advantage of using inventory information from the County and the City of Spokane but he has high praise for this inventory report and it is one of the best products he has seen to date. Motion carried Commission took a break at 7:20 p.m. returned at 7:28 p.m. B. Study Session — CTA-02-10 Code Text Amendments, Associate Planner Lori Barlow: Ms. Barlow presented to the Commission a preview of code amendments that will be coming forward for a public hearing at the Commission's next meeting. • Amendment to 17.20 clarifying the developer's responsibility to satisfy all code requirements. Federal law gives employees immunity while performing discretionary functions, however the City felt it could make it clear that in the end it is still the permit holders responsibility to meet all code requirements whether the City enforces it or not. • 21.40 In the critical areas ordinances adding for reasonable use exemption. These first two changes are being proposed based on a WA Cities Insurance Authority 2009 Annual Review and Audit comments. 04-22-2010 Planning Commission Minutes Page 2 of 3 • 21.30 amending the language to reflect the new date of the FEMA flood rate insurance study and maps. This amendment is being proposed to bring the code in line with the current dates of the federal maps. • Appendix A definitions amending the definition of kennel. Changing from 6 animals to 5. The Code discrepancy was brought to the City's attention by Nancy Hill, Director of SCRAPS. The City contracts with SCRAPS to provide animal control. The change in definition is being proposed for ease of enforcement by the SCRAPS Enforcement Officers. This change would have the City's definition match that of Spokane County which SCRAPS also enforces. There was considerable discussion regarding this topic. X. GOOD OF THE ORDER There was nothing for the good of the order.
