This Access Easement ( "Easement ") is made this .a�� day of 2011 by
NNN DEVELOPMENT LLC, a Washington limited liability company ( "Grantor "), for the benefit
of the CITY OF SPOKANE VALLEY, WASHINGTON ( "Grantee ").
RECITALS:
WHEREAS, Grantor is the owner of that certain real property located in the City
of Spokane Valley, Washington (the "Grantor Property ");
WHEREAS, Grantee requires Grantor to grant an Access Easement over the
Grantor Property for the purpose of installing and maintaining sidewalks, traffic signals and
related equipment; and
WHEREAS, Grantor wishes to grant to Grantee an access easement for on the
Grantor Property on the terms and conditions set forth below;
NOW, THEREFORE, in consideration of the premises and promises contained
herein, Grantor and Grantee agree as follows:
AGREEMENTS
1. Grant of Easement Grantor hereby grants and conveys to Grantee for
the benefit of the Grantee, a perpetual non - exclusive easement over and on the areas legally
described and depicted on Exhibit A (the "Easement Area ") for the purpose of providing and
permitting pedestrian ingress and egress over sidewalks and for the installation and
maintenance of the sidewalks, traffic signals and related equipment.. R. E. Excise Tax Exempt

2. Maintenance of the Easement Area Grantee shall at all times maintain
the Easement Area in good condition and repair.
3. Running With the Land /Binding Effect The easement granted herein
shall be appurtenant to and run with the land thereby benefited and burdened. This Easement
shall be binding upon and inure to the benefit of the Grantor and Grantee and their respective
successors and assigns.
