Council Agenda 01-10-12 Formal Format Meeting Page 2 of 2 CITY OF SPOKANE VALLEY Request for Council Action Meeting Date: January 10, 2012 Department Director Approval: ❑ Check all that apply: ❑ consent ❑ old business � new business ❑public hearing ❑information ❑ admin.report ❑ pending legislation AGENDA ITEM TITLE : Council Officer Selections GOVERNING LEGISLATION: City of Spokane Valley Resolution 10-020, Governance Manual Article I, Section 1.02—Council Meetings: Election of Officers Article I, of the Governance Manual describes the procedures for electing officers: Biennially, at the first meeting of the new Council, the members thereof shall choose a presiding officer from their number who shall have the title of Mayor. Following the election of the Mayor, there shall be an election for a Deputy Mayor. The term of the Deputy Mayor shall run concurrently with that of the Mayor. (RCW 35A.13.030). • The election for Mayor shall be conducted by the City Clerk. • The City Clerk calls for nominations. • Each member of the City Council shall be permitted to nominate not more than one (1)person; no member of the City Council is obligated to nominate a candidate. • Nominations do not require a second. • A nominee who wishes to decline the nomination shall so state at that time. • Nominations are then closed. • Except when there is only one nominee, election is by written ballot. • Each ballot shall contain the name of the Councilmember who cast it. • Election is determined by majority vote. • The City Clerk publicly announces the results of the election. • Ties shall be resolved in a contest by chance (the City Clerk will flip a coin) • Thereafter, the City Clerk records the individual votes by councilmembers in the meeting minutes. The election for Deputy Mayor shall be conducted by the Mayor-elect, and nominations shall be made in the manner previously described for the election of the Mayor. If Council is unable to agree on a Mayor by maj ority vote of inembers present, the Office of Mayor shall be temporarily filled by an Acting Mayor. The office of Acting Mayor shall be filled by the Councilmember who just previously served as Deputy Mayor, or if such person is not a member of the Council, the Councilmember with the next highest seniority. The Acting Mayor and Acting Deputy Mayor shall continue in office and exercise such authority as is described in RCW 35A.13 until the members of the Council agree on a Mayor, at which time the role of Acting Mayor and Acting Deputy Mayor shall cease and terminate. COMMISSION BUSINESS A. Unfinished Business: Continued Public Hearing – CTA-04-ll Proposed amendments to Title 22, Landscaping and Fencing. Assistant Planner Karen Kendall gave a brief recap of the questions which the Commissioners had previously requested clarification on, which were maintenance of the street trees along the public right-of-way (ROW) are the responsibility of the property except for a portion of Sprague and Appleway west of University and Appleway Blvd east of Tschirley. Tree staking was the other subject and Ms. Kendall stated the best information she was able to find was supplied at the last meeting from the University of Colorado which stated that staking is supported however only for a short period of time to stabilize the tree while it matures. 12-08-ll Planning Commission Minutes Page 1 of 2 B. New Business: Public Hearing for CTA-05-11, Proposed text amendment to Title 20, requirements for Boundary Line Adjustments Planning Tech Martin Palaniuk made a presentation to the Commissioners regarding the proposed language change to Title 20 of the Spokane Valley Municipal Code (SVMC) 20.80.030 (F) regarding the requirements for a record of survey for all Boundary Line Adjustments (BLA) . Mr Palaniuk explained that the proposed amendment would allow the Community Development Director discretion in requiring a record of survey for simple boundary line adjustments. The current code language requires a record of survey for all BLAs. Staff has determined that in less complicated situations a BLA can be accomplished without a record of survey. The Community Development Director would have the ability to wave the need for a record of survey when there would be two parcels or less, simple legal descriptions, no complicating easements or appurtenances, no owner disputes, or any setback issues. Chair Carroll opened the public hearing at 7:38 p.m. Anthony Lazanas, 10606 E Empire: Mr. Lazanas thanked staff for the work on this amendment and spoke in favor of this amendment. Chuck Simpson, 909 N Argonne Rd: Mr Simpson stated he was a licensed surveyor in the State of Washington and was speaking in support of the proposed amendment. Mr. Simpson shared several examples where a record of survey would not have been necessary in order to complete the BLA. Seeing no one else who wished to testify the chairman closed the public hearing at 7:45 p.m. The Commissioners deliberated and asked Mr. Palaniuk to explain the basic process of the BLA. Discussion surrounded when drawings would not be required, how counter staff would determine when a to defer the BLA to the director, how much time could be saved, and that our consultant reviews all legal descriptions and surveys turned into the City. Commissioner Sands made a motion to recommend approval of CTA-OS-11 to the City Council. This motion was approved unanimously. After review Commissioner Bates made a motion to approve the findings as presented. This motion was approved unanimously. X. BACKGROUND: The City of Spokane Valley received a Congestion Mitigation / Air Quality (CMAQ) Grant for design and construction of Intelligent Transportation Systems (ITS) improvements on Pines Road between Sprague Avenue and Trent Avenue. The Project will install fiber optic cable, traffic cameras and connect traffic signals to the Spokane Regional Transportation Management Center (SRTMC). The Transpo Group was chosen as the most qualified firm through an RFQ selection process. Staff has negotiated the attached scope of work for design services. The fee for the design work is $199,763. While discussing the scope of work during the December 27, 2011 meeting, a question was raised as to why the Pines Road intersections at Sprague, Mission and Mansfield are not included in the scope of work. The answer is that those three intersections with Pines Rd are already connected to the SRTMC via fiber optic cable. OPTIONS: 1) Approve the execution of a consultant agreement with the Transpo Group for design of the Pines ITS Project; 2) Provide additional direction to staff. RECOMMENDED ACTION OR MOTION: Move to authorize the City Manager, or designee, to execute a consultant agreement with the Transpo Group in the amount of $199,763 for design services on the Pines Road ITS Project. Stakeholders meetings will be negotiated separately if needed. 09257.PR 1 12/19/2011 Task 1 — Project Assessment 1.1 — Corridor Assessment & Design Plan Review The purpose of this subtask is to conduct a detailed inventory of conduits and junction boxes for the purpose to identify potential conflicts on the corridor and the interconnect routes. This task will also assess the capacity of the existing conduit runs from the cabinet to the nearest junction box and connection locations. Additional meetings with key stakeholders will occur per the City's request. These meetings are not covered by this Scope of Work. Transpo will develop a standard check list (form)that will be used to inventory and evaluate each intersection control cabinet. This inventory will become the basis for documenting the condition of the equipment and the need to replace any of the existing equipment. A key component of the decision is the availability of Right-of-Way and utility conflicts. Transpo will identify potential Right-of-Way and easement needs. Typically, the utility companies will provide as-builts or mark locations in the field. Transpo will contact the utility locator (811-Number)to obtain plans and field locate markings. After the completion of the utility locates, Transpo will conduct field reviews at locations where new ITS devices are proposed (CCTV camera poles and ITS cabinets)to identify any potential conflicts with the existing utilities. Transpo will identify any conflicts with the proposed design and will propose alternatives to the City. This subtask does not include any utility relocation design or surveying. 1.3— Environmental NEPA/SEPA Forms Transpo will assist in providing any necessary ITS related information in order to complete NEPA/SEPA forms. Developing any Environmental documents or review of documents is not considered part of this scope of work. If full environmental review is needed, Transpo will obtain a sub-consultant and prepare an amendment to this scope of services. 1.4— Right-of-Way Acquisition Analysis Transpo will utilize GIS maps, provided by the City, to identify locations where there may be potential Right- of-Way (R/W)conflicts. Where possible, Transpo will make recommendations and propose alternatives to avoid any R/W acquisition. Transpo will submit to the City a memo including the findings of the R/W review on or before the 50% design submittal. The scope of work may include coordination with property owners and assistance with acquisition of Right-of-Way and will be performed by a sub-consultant. Task 2 — ITS Equipment and Recommendation Purpose: Upon the completion of the Project Assessment, Transpo will use the inventory from Task 1 to develop a list of recommended ITS equipment and corridor improvements focusing on new fiber optic communications, CCTV cameras, and data collection stations. Transpo will lay out the concept of the design with alternatives for the City to review. The design concepts, building upon the general locations from the ITS Strategic Plan, will include detailed reviews of the communication network, data collection location and traffic monitoring cameras. Transpo will submit alternatives for the future fiber network infrastructure along the corridor(conventional trenching, micro-trenching, wireless connection or aerially). The submittal will include a comparison between the proposed alternatives. A meeting with the City will be conducted to finalize the ITS equipment and installation locations before design proceeds forward. This task will use the assessment of the existing conduit runs to determine additional needs for conduit connection to existing signal cabinets and infrastructure within the project limits. Transpo will perform a field investigation including line of sight requirements for CCTV and mounting height using a bucket truck at the proposed mounting site. Arrangements for the use of a bucket truck and driver plus any required traffic control will be provided by the City. Deliverables: • Corridor recommendation document including maps • Images or video clips at each of the proposed CCTV camera locations showing the line of sight Task 3 — N Pines Rd/E Mission Ave Intersection Analysis The signal at N Pines Rd/E Mission Ave intersection currently operates on a split-phase basis. The City of Spokane Valley would like to improve the signal operation at this intersection by reducing queue length and average delay. Transpo will evaluate the signal operations of the intersection for the existing and future conditions and recommend potential improvements as necessary. Scenarios that will be evaluated for the future condition will include, but may not be limited to: • Reconfiguring existing signal phasing and intersection geometry to remove split phase requirement • Adding southbound right-turn lane 09257.PR 3 12/19/2011 Upon completion of the analysis, Transpo will prepare a Traffic Operation Memo summarizing existing and future Level Of Service (LOS), average delays, queue length, and volume-to-capacity (v/c) ratio for AM and PM peak hours. The memo will include a comparison between the different scenarios, prepared as part of this analysis, by listing the advantages and the disadvantages of each potential improvement. Additionally, the memo will include recommendations for improvements. Transpo will obtain the AM and PM Synchro network from the City and calculate the existing AM and PM peak hour Level Of Service (LOS), average delays, queue length, and volume-to-capacity (v/c) ratio. Future AM and PM peak hour traffic volumes at this intersection will be estimated by applying an average annual growth rate as determined by the City. This task does not include preparation of plans and specifications. If the City selects a recommended alternative that requires plans, Transpo will prepare an amendment to this scope. The design corridor improvements are to include new conduit route, new fiber optic communications, and CCTV camera installations. The project limits and proposed improvements are outlined below. Corridor Limits: From E Sprague Ave to E Trent Ave (SR 290)along the corridor of N Pines Rd (SR 27). The potential ITS improvements for this corridor include but are not limited to: A. Fiber Communication System for approximately 2.7 miles. Fiber infrastructure will be determined with the City after field investigation and using the City's ITS strategic plan. B. Trench conduit from along N Pines Rd between E Sprague Ave at the south and E Trent Ave (SR 290) at the north. It is assumed that existing conduit will be used at the I-90 interchange. C. Two Signal Controllers will be connected to the communication and Ethernet Switches. Intersections from South to North include: 1. E Broadway Ave & N Pines Rd (SR 27) 2. E Trent Ave (SR 290) & N Pines Rd (SR 27) D. Up to three CCTV Camera locations will be recommended and connected by Ethernet and be compatible with the existing system. Locations and the number of CCTV cameras will be determined with the City after field investigation and using the City's ITS strategic plan. E. Up to two count stations to be installed between E Sprague Ave and E Trent Ave (SR 290). Locations and number of the count stations will be determined with the City after field investigation and using the City's ITS strategic plan. F. Identify connection point and location of fiber termination cabinets. The following subtasks are proposed: 09257.PR 4 12/19/2011 4.1 - Data Collection and Basemap Development Transpo will work with the City of Spokane Valley to assess the conduit along the project corridor with the detailed inventory. Transpo will incorporate base map information available from the City—including both intersection/road projects and utility projects where spare conduits have been installed. Transpo staff will then walk the corridor with City staff to verify the location of the junction boxes accessing the spare conduit, if any. The base map will identify information required for the contractor to successfully locate the proposed improvements. This may include the location of existing right of way, roadside features (including curbs, sidewalks, planters strips, trees,junction boxes, etc.), and major traffic signal equipment. Existing as-builts and project data provided by the City will be used. Underground utilities will only be located in areas where construction work is anticipated to be required along the corridor, based on preliminary engineering. Deliverable: • Roll plot of base map—hard copy. 4.2 - 50% Engineering Design This subtask will focus on the development of a preliminary (50%) engineering design for the ITS elements described earlier. The base maps prepared in the previous task will be used to prepare the preliminary engineering drawings for the proposed ITS system project. The preliminary (50%)engineering drawings will show general location of existing and proposed equipment with construction notes and preliminary layout of restoration items such as roadway, sidewalk and landscaping. No wiring details and/or schedules will be prepared at this stage. 50% plans will be submitted for review and comment by the City. The cost estimate will be prepared and show list of bid items, unit costs, and quantities. If the City decides to implement improvements resulting from Task 3, the ITS design will account for these changes; however, signal design and roadway improvements such as channelization are not included in this scope of work. Deliverables: • Preliminary (50%) engineering ITS plan drawings • Engineer's 50% opinion of cost. • Five copies of the plans, 11 x17 size in pdf format. To be furnished by the City: • Coordination, review, and summary of Agency reviews to meet schedule 4.3 - 90% Engineering Design This subtask will develop 90% design documents including plans, specifications, and estimate for the ITS elements detailed in the 50% engineering design task above. The City comments from the 50% engineering design review will be incorporated into the 90% design. The 90% design shall include: equipment plans layout, construction notes, restoration of roadway, sidewalk, and landscaping, erosion control, wiring details, fiber optic splice diagrams, details sheets, details of non-standard design features, specifications, and estimate. Plans, specifications and cost estimate will be submitted for the City's review. Special Provisions: Contract documents, required FHWA Division 1, amendments, Division 2-9, standard drawing details, wage rates. Task 5 — Project Administration This task includes attendance and participation in project meetings, ongoing communication with the project team, monthly invoicing and progress report preparation and internal project management and oversight. Progress reports and invoices will inform the City regarding project budget status, work accomplished for the billing period, money spent for the billing period, and work to be completed for the next billing period. Any issues requiring the City's attention would also be raised. Oualitv Control. Transpo will follow our quality control (QC) process to ensure the plans have been independently reviewed prior to submittal. The process will include provisions for checking calculations, plans, specifications and design reports and ensure comments received from the City are incorporated in the plans as agreed upon. In absence of the City of Spokane Valley standards, Spokane County design standards will be used. In absence of Spokane County design standards, WSDOT standards will be used. • The intent of the basemapping is to show where physical improvements are located in the field so that the contractor can construct and estimate ITS design elements. It is understood that the basemapping is information from the city's GIS and As-Builts and not surveyed information. Therefore the accuracy of the information is only as good as the base files. • No corridor stationing is included as part of this work. Known monuments will be used for any installation of new structures. • North arrow shown on plan sheets will be shown pointed up or to the right. • Plans shall be in 11x17 size. Corridor plan sheets will have a scale of 1: 50'. Zoom in of intersections will be at a 1:20 scale. • It is assumed the installation of CCTV will be mounted on existing signal mast arms or signal luminaire arm. Where new poles are required the specifications will require the contractor to provide the structural design. No structural design is included in this scope. • It is assumed civil improvements such as sidewalk repair, landscaping, curb and gutter can be addressed using existing standard details. This scope of work does not include special details for these design elements. • Contract Schedule is based on a tight timeframe. Transpo will notify client of any potential delays in writing. Time delays from the client on receipt of information/assistance will affect this schedule. • No potholing is included in this scope of work. If additional work is amended to this scope at a later date requiring utility locates, the city will call to furnish required field locate services at locations specified by Transpo (general one-call locate service number. 1-800-424-5555) • City will coordinate with project stakeholders and confirm design review period and timeframe can be met for all reviewers. Poe Asphalt Paving provided an excellent level of service during 2007, 2008, 2009, 2010 and 2011. The contract amount for Street and Stormwater Maintenance in 2011 was $1,545,119 and will remain at $1,545,119 for 2012 for those services. In 2010 Council approved a snow removal contract to Poe Asphalt Inc. in the amount of $700,000. We were able to complete a separate bid process last year for the majority of the snow plowing work involving graders and have conducted the same bid process this year. As a result, last year we only spent $132,291 with Poe which was primarily for drivers in the City snowplow trucks and two graders with wings. Additionally, since snow plowing is not considered a public work the hourly rates for snow plowing will be at 90% of the contract rate. We are requesting an increase in the contract amount of $140,000 for the snow removal operations which would come from the approved snow removal budget. This would bring Poe's total contract amount to $1,685,119. This does not increase the overall Street Fund budget for 2012. Council received an informational memo on November 27th, administration report on December 6tn additional information on December 13th and an additional administrative report on December 27tn Labor and equipment with the profit and overhead charge will result in a 0.3% increase from the 2011 costs. When materials are included the total costs of the work will decrease 6.8% from the 2011 costs. OPTIONS: Renew the contract, or provide staff with further direction. The contract was for one year with seven one-year renewal options which may be exercised by the City. AAA Sweeping provided a good level of service during 2007, 2008, 2009, 2010 and 2011. In 2011 the total approved contract amount was $490,199.94. The contract amount will remain at the same amount for 2012. AAA Sweeping had requested a 2% increase in their unit prices. The current CPI-U as of October is 3.5%. As a result of the newspaper article on December 31 st, AAA called the City January 3rd and offered to reduce the increase to 1% as requested by several councilmembers at the meeting on December 27th. I have adjusted their rates to reflect the 1% increase. OPTIONS: Renew the contract, or provide staff with further direction. RECOMMENDED ACTION OR MOTION: Move to approve the contract to AAA Sweeping in an amount not to exceed $490,199.94 and authorize the City Manager to sign the contract. No costs for the school shall be charged to the CITY. F. Eligible individuals (as determined by the SHERIFF) receiving traffic infraction citations within the city limits of the CITY, shall be given the option of participating in the Traffic School. Satisfactory completion of the class will result in the dismissal of the citation. Additionally, the Spokane CounTy District Court handling a traffic infraction case within the limits of the CITY, shall have the legal ability as provided for in RCW 46.83.050, as part of any sentence imposed following a conviction for any tr�c law violation, or as a condition on the suspension of sentence or deferral of any imposition of sentence, to order any person so convicted to attend the tr�c school for a number of days to be determined by the court, but not to exceed the maximum number of days which the violator could be required to serve in the city or county jail as a result of his or her conviction. If the comparative negligence of the PARTIES and their ofFcers and employees is a cause of such damage or injury, the liability, loss, cost, or expense sha11 be shared between the PARTIE5 in proportion to their relative degree of negligence and the right of indemnity shall apply to such proportion. � Where an officer or employee of a Party is acting under the direction and control of the other Party, the Party directing and controlling the officer or employee in the activity and/or omission giving rise to liability sha11 accept all liability for the other Parly's officer or employee's negligence. Each Party's duty to indemnify shall survive the termination or expiration of the Agreement. € Each Party waives, with respect to the other Party only, its immunity under RCW Title 51, Industrial Insurance. The PARTIES have specifically negotiated this provision. SECTION NO. 7: INSU RANCE During the term of the Agreement, the COUNTY sha11 maintain in force at its ovcm expense, each insurance noted below: a. Worker's Compensation Insurance in compliance with RCW 51.12.020, which � requires subject employers to provide workers' compensation coverage for a11 their � subject workers and Employer's Liability or Stop Ga.p Insurance in the amount of not less than$1,000,000; b. General Liability Insurance on an occurrence basis, with a combined single limit of not less than $1,000,000 each occurrence for bodily injury and property damage. It shall include contractual liability coverage for the indemnity provided under this Agreement. It shall provide that the CITY, its officers and employees are additional insureds but only with respect to the COiJNTY's services to be provided under this ` Agreement; and � � � c. Automobile Liability Insurance with a combined single limit, or the equivalent of !' not less than $1,000,000 each accident for bodily injury and property damage, including coverage for owned,hired and non-owned vehicles. � d. This is to cover damages caused by the error, omission, or negligent acts related to the professional services to be provided under this Agreement. When presented to the City at an earlier time, City administration requested to have revenue impact numbers over an extended period of time. Enough data now exists to conduct an analysis. The estimated cost to the City is $97,152 in lost revenue, of which $53,434 is City-retained revenue. The school does not appear to be competing with private businesses. While there is not available data to assess the impact on recidivism, survey forms and letters received indicate that participants have changed their driving habits and their perception of law enforcement has also changed for the better. Back�round The Traffic Safety School began in March 2008 and was offered to qualifying individuals who had received traffic infraction citations in the unincorporated areas of Spokane County. The school is entirely supported by fees paid for by participants. Completion of the class allows participants to have their citations dismissed. Is defensive driving through a private provider not an option and is there a reason for this? • An offender could motion the court for such an option, but I cari t say for sure if that ever happens. Often, however, as part of their request for a deferral, the Judge may stipulate they enroll in a defensive driving program through a private provider (i.e. AAA). Cost Impact 6.8% of people receiving traffic infraction citations in the unincorporated County complete the Traffic Safety course. Applying this percentage to the Spokane Valley infractions, approximately 704 infractions would be dismissed in a calendar year. According to the District Court, the average infraction fine is $150. If the people completing the course would have otherwise have paid the full fine, the loss in revenue would be $105,600. Many fines are currently reduced at the window or dismissed by the judge. The average revenue per infraction in 2010 for Spokane Valley was $138. At this rate, the loss would be $97,152. Of this amount, approximately 45% of the revenue goes to the state. The total loss of City-retained revenue is estimated to be 53,434. The costs related to the program are segregated from the Law Enforcement contract costs and are paid for solely by fees paid by the participants. According to the District Court and Prosecutor offices for the County, these cases would still count toward the City's usage as they are still processed by both departments even though the charges are dismissed. There would, therefore, be no offsetting savings from a reduced usage for these service contracts. BACKGROUND: In 2009, Park maintenance services were publically bid to award a new contract for 2010. Senske Lawn and Tree Care was the low bidder on the new 2010 contract and they completed their second year under the contract in 2011. The contract, approved by the City Council, was for one year with six one-year renewals based upon satisfactory performance. The existing agreement allows additional facilities to be added by mutual consent. The park maintenance contract is based upon maintenance standards and a described maintenance schedule. The original scope of work requires the contractor to provide all materials and supplies to complete the work as described. Additionally the contractor is required to be responsible for all support facilities, customer service and the levels of service that have been established for developed parks, medians and rights of way and undeveloped lands. The contract contains a detailed description of routine tasks (mowing, trimming, cleaning restrooms, cleaning picnic shelters,playground inspections, litter pick up, ball field maintenance, etc.); periodic/seasonal tasks (fertilizer applications, edging turf, aeration, irrigation activation/deactivation, snow removal, graffiti, etc.); facilitating special events and working with the public are required tasks. The maintenance standards established by staff include such standards as the height of mowed turf, number of fertilizer applications, daily restroom cleaning to specific specifications, etc. For 2012, a 1% contract increase has been negotiated for the existing contract. This increase is to cover the increasing cost of materials such as fuel, fertilizer, weed control and raw materials such as steel and copper along with such items as worker's compensation and insurance. Also for 2012, new maintenance responsibilities will be added to the contract in the form of Greenacres Park and a new picnic shelter at Terrace View Park both coming online. The cost increase for these two additional responsibilities was negotiated for $68,258.61. The negotiated increases for the addition of Greenacres Park and the Terrace View shelter are consistent with what we are currently paying for the same tasks and responsibilities in our current contract such as the cost of mowing per acre, restroom or shelter cleanup, litter control, playground inspections, etc. Therefore staff is recommending the cost for the 2012 Park Maintenance contract with Senske Lawn and Tree Care to be $680,801.26 which includes the maintenance of Greenacres Park beginning in June 2012 and the maintenance of the Terrace View Picnic shelter all year long. 2011 $606,477.88 Total cost 2012 $680,801.26 Total proposed cost* *total increase includes $6,064.77 for 1% increase, $8,304.68 for Terrace View Shelter and $59,953.93 for Greenacres Park. An informational display booth will be set up in the Center Court at Spokane Valley Mall during regular mall hours from 10:OOam to 9:OOpm. The booth will be staffed by staff inembers who have a good depth of knowledge within their department/division to answer questions and share information with citizens who stop by the booth. Laptop computers will be set up so use of the website to access information can be demonstrated, citizen action requests can be filed, comments can be taken, and online services can be provided at the booth, almost as if they were at City Hall itself. Informational brochures and handouts on a variety of city topics will also be available. The Spokane Valley Mall is making this opportunity available to us at no charge. They are very excited to be able to support our efforts to be involved in the community and have offered the assistance of their event and promotions coordinator to help us promote the event. Councilmembers who may be interested in signing up for a shift at the booth to help connect with citizens are welcome. BACKGROUND: The Office of the City Attorney from time to time reviews the City's Code to verify references to other Code sections and County Code sections are correct. When Code amendments are made, sections may be added, changed, or repealed. Therefore it is necessary to update the City's Code to reflect these changes. All changes proposed are of a housekeeping nature only and are not substantive. 1. Title 2: There is currently a discrepancy in how the Code references state law which potentially creates confusion. The Code references a definition of"family member" in the RCWs while only "family" is defined. For purposes of efficiency and clarity, the Code should be amended to only include the definition of"family." 2. Title 5.10.010 and 5.20.140: The references to the Revised Code of Washington in SVMC 5.10.010 are amended to accurately reflect the correct law and provide the definition of liquor. SVMC 5.20.140 is being repealed because other sections of the Code are inconsistent and reflect no such grace period. 3. Title 7: Section 7.20.180(B) will be amended to the correct reference for alarm registration fees and enforcement. Section 7.30.010(B) will be amended to reflect the correct County Code provision for the requirement of dog/cat vaccinations for rabies. 4. WHEREAS, the City of Spokane Valley previously adopted Spokane Valley Municipal Code Chapter 17.100 in order to enforce nuisance violations as set forth in Spokane Valley Municipal Code Chapter 7.05 and for violations of any provisions of the Uniform Development Code; and WHEREAS, since adoption of these provisions, the City has gained experience in how to better regulate and enforce such nuisance provisions; and WHEREAS, certain e�sting provisions within Spokane Valley Municipal Code Chapter 17.100 should be amended in order to better reflect the City's current practice of regulating and enforcing such nuisances. Such changes directly relate to the life,health, and safety of the City's citizens. NOW, THEREFORE, the City Council of the City of Spokane Valley, Washington ordains as follows: Section 1. Amendin� Spokane Vallev Municipal Code 17.100.030 Re�ardin� Enforcement, Authorit�, and Administration. Spokane Valley Municipal Code section 17.100.030 is hereby amended as follows: B.If it is determined that violations of this title ha�e occurred or are occurrin� and the�artv(sl responsible has previously been served with a notice and order pursuant to SVMC 17.100.130, or has previouslv entered into a volunta ,r��liance a�reement�ursuant to SVMC 17.100.100, then the Citv shall ha�e the authoritv to initiate a new com�liance action based on field observations by Cl , staff pursuant to SVMC 17.100.030(A). C�. The procedures set forth in this chapter are not exclusive. These procedures shall not in any manner limit or restrict the City from remedying or abating violations of this title in any other manner authorized by law. � D�. In addition to, or as an alternative to,utilizing the procedures set forth in this chapter, the City may seek legal or equitable relief to abate any conditions or enjoin any acts or practices which constitute a code violation. � E�. In addition to, or as an alternative to,utilizing the procedures set forth in this chapter, the City may assess or recover civil penalties accruing under this chapter by legal action filed in Spokane County district court or superior court by the office of the city attorney. � F€. The provisions of this chapter shall in no way adversely affect the rights of the owner, lessee, or occupant of any property to recover all costs and expenses incurred and required by this chapter from any person causing such violation. � G€. In administering the provisions for code compliance, the City shall have the authority to waive any one or more such provisions so as to avoid substantial injustice. Any determination of substantial injustice shall be made in writing supported by appropriate facts.
