12-024.00 Skillings Connolly: On Call ROW Acquisition & Appraisal - Evergreen ProjectEXHIBIT A -2 TASK ORDER AGREEMENT D Prepared for: CITY OF SPOKANE VALLEY ON CALL RIGHT -OF -WAY ACQUISITION AND APPRAISAL SERVICES EVERGREEN ROAD PROJECT The general provisions and clauses of Contract 10 -008 shall be in full force and effect for this Task Order Agreement. Location of Task: 2409 and 2615 S. Evergreen Road Project Title: Evergreen Road Project Target Completion Date: April 1, 2012 Description of Work Skillings Connolly will attempt to acquire 2 partial acquisitions (Portions of Assessor Parcel Numbers 45263.0101 and 45263.0828) on the Evergreen Road Project using funds from this task order. Title reports, commitments, closing and escrow fees will be the responsibility of the City. Administrative Offer Summaries (AOS) for each partial acquisition will be completed and submitted by Skillings Connolly to the City of Spokane Valley for approval along with a Project Funding Estimate and will be funded from this task order. The City will return the approved valuations and Skillings Connolly will prepare and deliver the First Offer Letters to the landowners to begin negotiations. Skillings Connolly will make up to five contacts with each owner to secure the necessary property rights. In the event negotiations are not successful after 5 contacts, the City will be given the opportunity to participate in a 6 th meeting. Any additional contacts with landowners will be negotiated by a supplemental task order. Once a settlement has been reached, Skillings Connolly will obtain signed originals of the following documents: Warranty Deed, Real Property Voucher, Road Construction Agreement, Temporary Construction Permit, Real Estate Excise Tax Affidavit, and W -9 Taxpayer Identification Number and Certification Form. The City of Spokane Valley will supply Skillings and Connolly with a copy of the Evergreen Road Project R/W Plans, Construction Plans, Acquisition Legal Descriptions, and Individual Right -of -Way Exhibits. Final Deliverables to the City from Skillings Connolly for each parcel may include signed originals of: • Administrative Offer Summary • Warranty Deed • Real Property Voucher 0 Skillings Connolly, Inc. Skillings Connolly will provide signed Agent Diaries for these parcels. It is understood and agreed between the parties that the precise work effort required for obtaining the necessary right of way is unknown thus Skillings Connolly will proceed with valuation and negotiations to acquire the necessary property interests based on a total task budget of $10,000, with $5,644 allocated to acquisition and $4,356 to valuation of the parcels.. In the event it becomes apparent that the work effort may exceed the existing task budget, Skillings Connolly will notify the City and any extra work will be negotiated by a supplemental agreement. However, it is possible that the City may complete portions of the acquisition with City staff. Skillings Connolly will bill only for the hours associated with the appropriate tasks as will be determined by the City. Initiation of the project is dependent on Council approval. Note: This task order assumes there will be no relocations as part of this project. In the event relocations are determined to be necessary, they will be negotiated by supplemental agreement.
