The expanded Preliminary Design phase is anticipated to encompass a 4-8 week period of performance and focuses on addressing tasks critical to the project schedule, while scope and fee for Final Design phase services are negotiated. The City of Spokane Valley (Spokane Valley) may make or approve changes within the general scope of this agreement. If such changes affect CH2M HILL's cost of, or time required for, performance of the services, an equitable adjustment will be made through an amendment to this agreement. Prior to performing the work, CH2M HILL will notify Spokane Valley in writing of the occurrence of a change and an estimate of the cost impact. Spokane Valley will review, and if approved, will provide written approval of the change. A ten percent contingency fund has been established for minor changes to the Scope of Work. Use of the contingency fund requires written authorization from Spokane Valley, prior to performing the work. Spokane Valley reserves the right to expand the scope of CH2M HILL's work on this project to include project communications services, construction inspection and construction management engineering services. These additional services are not included in this Scope of Work but may be added to the Agreement at a later date by written amendment. 2.0 Purpose The purpose of this scope of work is to expand the previously scoped Preliminary Design to include additional surveying and mapping, field investigations related to the Environmental Classification Summary (ECS), utility coordination, and a preliminary design study of a suspended pedestrian walkway beneath the existing Sullivan Road East Bridge. The boundary of the APE is identified under Task 5.1.1. Surveying tasks are as follows: • Research and compile existing survey and utility records. This task includes research of recorded surveys, plats, and property corner records together with research of Spokane County right -of -way records. Contact utility purveyors for available utility as -built drawings and plans. • Field locate pertinent controlling monumentation including property corners, section corners, and right -of -way centerline monuments. This task also includes monument analysis and resolution for determining right -of -way location. • Set additional horizontal and vertical control for project. • Surveying to include all surface and known/ locates subsurface features, including trees of 4 -inch caliper size and greater. • Place delineated wetlands on base mapping using GPS coordinates provided by the City. 1.2 Mapping Provide mapping as follows: • Topographic mapping data to obtain and show 1 -foot contour intervals. a) Provide topographic information to extend from the limits of the existing base mapping to the limits of the project Area of Potential Effect (APE). Prepare and provide monument reference drawings at an appropriate scale. Task 2: Project Management Provide overall project management and coordination with Spokane Valley. A total time of two months is assumed to be the duration for this work. Project management services include: Staff and subconsultant management Control budget and schedule Monthly progress reports and invoices (The progress report /invoice will identify the work performed for that period, major decisions, schedule, and budget status. Deliverables: Progress reports and invoices. Task 3: Client Coordination and Consultation Services Provide coordination and correspondence with Spokane Valley management and staff to support project progress and communications, including: • Bi- weekly project coordination meetings (to be held at the City Hall and CH2M HILL) • Regular telephone and electronic mail correspondence • Overall project guidance, decision - making assistance and /or recommendations • Action items review Deliverables: Meeting agendas and notes, running action items listing. Task 4: Stakeholder Coordination and Public Outreach 4.3 Utility Coordination A single coordination meeting will be organized and conducted to coordinate facilities that need to be relocated permanently to the northbound Sullivan Road bridge. Utility requirements will be ascertained to facilitate construction of the Sullivan Road crossing in conjunction with the City's stormwater management project in the Summer of 2012. Deliverable: Meeting agendas and notes. Task 5: Environmental Documentation and Permitting CH2M HILL will conduct the environmental evaluation and documentation required under the National Environmental Policy Act (NEPA) and the State Environmental Policy Act (SEPA) and will assist Spokane Valley to obtain the associated environmental permitting for this project as follows: SPK/SUPP_3_SRWBR FINAL DESIGN EXHIBIT A -1 SOW FINAL.DOCX 428859.SR 3OF9 SCOPE OF WORK FOR SULLIVAN ROAD WEST BRIDGE REPLACEMENT, CITY OF SPOKANE VALLEY, JUNE 2012 5.1 Environmental Classification Summary CH2M HILL will prepare the Local Agency Environmental Classification Summary (ECS), which will be submitted by Spokane Valley to the Highways and Local Programs Division of the Washington State Department of Transportation ( WSDOT), where it will be reviewed and approved before going to Federal Highways Administration (FHWA) for review and final approval. The ECS will include a project description, purpose and need for the project, and address environmental elements per the Local Programs Environmental Classification Summary Guidebook (Washington State Department of Transportation, Highways and Local Programs Division, January 3, 2012). Reference/ supporting reports (prepared by CH2M HILL or others as described below) will be attached to the ECS to document compliance with environmental issues. NEPA coordination and approvals will be needed from the following agencies: NEPA Approvals Approval Agencies Section 106 Approval Washington State Department of Archeological and Historical Preservation (DAHP), local tribes, local historical offices Washington State Department of Transportation (WSDOT), Section 4(f) Approval Federal Highways Administration (FHWA), Spokane Valley City Parks, and Washington State Department of Parks and Recreation Section 7 Approval United States Fish and Wildlife Service (USFWS) Deliverables: Draft and Final ECS 5.1.1 Section 106 /Cultural Resources Assessment CH2M HILL will perform the following cultural resources activities in compliance with Section 106 of the National Historic Preservation Act of 1966 (as amended): Area of Potential Effect: CH2M HILL will identify the Area of Potential Effect (APE) and prepare a map/ figure. • Tribal Site Meeting: Work includes one site meeting with Spokane Tribes' cultural resources staff (should it be requested); the meeting would take place after the APE is submitted to the Tribes and the purpose of the meeting would be to explain the project, to look at the APE boundary, to discuss the Section 106 process, and to solicit tribal input. Notification and Initiation of Section 106 Consultation: CH2M HILL will write the notification letter that will be sent to WSDOT from Spokane Valley requesting approval of the APE from Washington State Department of Archeology and Historic Preservation (DAHP) and the tribes, and providing notice for initiation of the consultation process with the tribes. WSDOT will forward the initiation of Section 106 consultation to FHWA for review and approval before WSDOT mails out to the tribes. Records Search: Conduct a records search of DAHP's website (WISSARD) to identify known archeological and historical findings and features. The survey will include subsurface testing (i.e., up to forty (40) shovel probes will be performed within three days of fieldwork). The field survey will be coordinated with the Spokane Tribes' archeological staff (should tribal staff want to participate). This works includes Inventory Form preparation for two known archaeological resources. If additional resources are discovered, they will also be recorded on Inventory Forms, and all resource findings will need to be submitted to the DAHP and Spokane Valley - County of Spokane Historic Preservation Office (SPK HPO), and evaluated for National Register of Historic Places eligibility. Such new discovery and related work will require a scope of work and budget adjustment by written amendment to the agreement between CH2M HILL and Spokane Valley. Evaluation of new sites may take additional fieldwork and reporting. Historical Evaluation: Verify current status of historic properties contained within the project area. This work includes Inventory Form preparation for the existing Sullivan Road West Bridge, which is over 50 years old. Work also includes preparation of two more additional forms (should they be needed) and if additional historical buildings or structures are found, they will also be recorded and documented on Inventory Forms, evaluated for National Register of Historic Places eligibility [NRHP- eligible historic properties become Section 4(f) properties]. Such additional effort would require a scope of work and budget adjustment by written amendment to the agreement between CH2M HILL and Spokane Valley. • Cultural Resources Report: Prepare a draft and final Cultural Resources Report. • Coordination with Section 4(f) Evaluation: Review the Draft Section 4(f) Evaluation prepared under Task 4.1.2 and recommend revisions, as appropriate, based on the results of the field verification, so that historical information in the Section 4(f) Evaluation is consistent with the historical information in the Cultural Resources Report. Deliverables: • Draft and final APE approval and Section 106 initiation consultation letter • Minutes of meetings (as necessary) • Draft and final Cultural Resources Report; final will be attached to the ECS 5.1.2 Section 4(0 Evaluation CH2M HILL will prepare the Section 4(f) Evaluation, which will address anticipated impacts to recreational and park lands (including the Centennial Trail, Sullivan Park, and adjacent state -owned recreational properties), and historic sites relevant to the Sullivan Road West Bridge Replacement project. As part of this analysis, the parkland boundaries will be identified from available records. It is assumed that a de minimis determination will be possible. Impacts to the park during construction (temporary impacts) will be described in the Section 4(f) Evaluation and in a Parkland Mitigation Plan. Permanent impacts to parkland and mitigation measures will be described that will show that parks features, attributes, and functions are maintained during and after construction to the same extent as before the bridge replacement project. The Section 4(f) Evaluation for the project will include two meetings involving CH2M HILL, Spokane Valley, the Washington State Parks and Recreation (State Parks), and Spokane Valley Parks and Recreation (City Parks) staff (managers of Sullivan Park, adjacent State recreational properties and the Centennial Trail). The first meeting will be to present the selected bridge replacement alternative, the reasons for its selection, and to solicit input on Section 4(f) mitigation measures. The second meeting will be to reach mutual agreement on the Section 4(f) mitigation measures as described in the Parkland Mitigation Plan. CH2M HILL will draft a letter to be signed by both State and City Parks agreeing to these Section 4(f) mitigation measures for both temporary and permanent impacts. Deliverables: • Draft and final of Section 4(f) de minimis evaluation that is relevant to the Sullivan Road West Bridge Replacement project; final will be attached to the ECS • Meeting minutes, as necessary • Parkland Mitigation Plan • Draft and final letter for State and City Parks to sign, agreeing with Section 4(f) conclusions. Final will be attached to the ECS. 5.1.3 Biological Evaluation CH2M HILL will conduct a Section 7 biological evaluation and prepare a biological assessment (BA) for protected species and habitats under the jurisdiction of U.S. Fish & Wildlife Service (USFWS). For this project, the only protected species is Bull Trout. Because it is anticipated that the construction will continue outside of the approved fish work window on the Spokane River, a mitigation plan and agreement for the protection of red -band trout will be prepared for Washington State Department of Fish and Wildlife (WDFW). This scope of work includes one joint meeting with WDFW, USFWS, Spokane Valley, and CH2M HILL to discuss the mitigation plan and compensatory mitigation proposed for the project. A search for bald eagle nests; and preliminary discussions with WDFW will be provided to verify that there are not any nests within a quarter -mile of the project site. If nests are identified, a plan for species protection during the nesting season would be made with WDFW and USFWS, and preparation of that plan would be outside of this scope of work. CH2M HILL will obtain updated species listings for plants and animals from USFWS and WDFW. If additional species of concern are identified as likely to be within the project area, a biological survey would need to be conducted to determine their presence within the project site, and this would require a scope of work and budget adjustment by written amendment to the agreement between CH2M HILL and Spokane Valley. Deliverables: • Species listings, to be attached to the ECS • Draft and final biological assessment to USFWS; final will be attached to the ECS • Draft and final Mitigation Plan to WDFW with compensatory mitigation proposed (does not need to be attached to ECS because it is not a NEPA requirement) SPK/SUPP_3_SRWBR FINAL DESIGN EXHIBIT A -1 SOW FINAL.DOCX 4288593R 6OF9 SCOPE OF WORK FOR SULLIVAN ROAD WEST BRIDGE REPLACEMENT, CITY OF SPOKANE VALLEY, JUNE 2012 5.1.4 Noise Analysis and Report CH2M HILL will prepare a Traffic Noise Study Report to adequately and accurately detail the findings of the traffic noise analysis and noise barrier analysis. The required documentation contained in the Traffic Noise Study Report is found in 23 C.F.R. § 772 and the WSDOT Noise Manual. The WSDOT Noise Manual is the prime document to be followed in development of the traffic noise study and report. A site visit of the project study area will be conducted to identify land uses and locate noise sensitive locations within project area. Physical features that affect noise propagation and features that may be altered during construction will be noted. Noise measurements will be conducted at up to four locations to validate the traffic noise model. Locations may be adjusted as needed in the field but are anticipated to include Sullivan Park, fishing/ river access spots and the Centennial Trail. All measurements will be conducted for a single 15- minute sampling period at each location during free -flow traffic conditions. At each measurement site, traffic counts will be collected concurrently with the noise measurements. A Type I sound level meter will be used. Spokane Valley will obtain permission for CH2M HILL to enter private property as required to conduct noise measurements. All noise sources will be noted. Traffic volumes counted during the noise measurement survey will be modeled using FHWA Traffic Noise Model (TNM) Version 2.5 and the resulting sound levels will be compared with the measured sound levels to validate the model. TNM 2.5 will be used to model three noise levels: existing, future no- build, and future build for a single alternative. Up to 20 noise - sensitive receptors will be identified with input from WSDOT. The receptors will exhibit land use characteristics similar to their surrounding area. Receptors will be located close to the proposed improvements. Design year (2013) noise levels will be compared to noise - abatement criteria to determine if the design year noise levels approach or exceed criteria thresholds. Design year noise levels will also be compared to existing noise levels to determine if the projected noise levels are "substantially higher" per WSDOT's criteria and therefore an impact. At locations predicted to experience impacts, potential noise - abatement measures will be discussed qualitatively. A detailed, quantitative noise barrier analysis will not be performed. If a detailed quantitative barrier analysis is determined to be necessary, it would only be conducted after Spokane Valley approval of an amendment to the scope of services and budget. Deliverables: • Draft and Final Noise Analysis Report 5.1.5 Hazardous Materials CH2M HILL will prepare a hazardous materials evaluation of the properties adjacent to the bridge right -of -way to determine the potential for encountering hazardous materials sites during construction of the replacement bridge. A record search will be conducted on Ecology's website and historical maps reviewed for past historical uses of these properties. The findings of this evaluation will be presented in a hazardous materials technical memorandum based on an example report provided by WSDOT on March 12, 2012. Deliverables: SPK/SUPP_3_SRWBR FINAL DESIGN EXHIBIT A-1 SOW FINAL.DOCX 428859.SR 7OF9 SCOPE OF WORK FOR SULLIVAN ROAD WEST BRIDGE REPLACEMENT, CITY OF SPOKANE VALLEY, JUNE 2012 • Draft and final technical memorandum summarizing hazardous materials evaluation; final will be attached to ECS 5.3 Joint Aquatic Resources Permit Application (JARPA) 5.3.1 Prepare JARPA This work will be accomplished in a subsequent contract amendment for final design. 5.3.2 Coordinate JARPA Permit Process CH2M HILL will coordinate with the City and JARPA agencies in respect to permit requirements and provide information to the agencies as needed so that permits can be issued in a timely manner. Task 10: Final Bridge and Structures Design 10.10 Design Study of Pedestrian Walkway at Sullivan Road East Bridge Perform a design study of the proposed pedestrian walkway that will be located under the east side of the existing northbound Sullivan Road East Bridge. The walkway will be supported from the existing bridge to serve pedestrians and bicyclists. It will be a minimum of 8 feet wide. The study will consist of the following tasks: • Evaluate up to three (3) alternatives for the walkway, including a steel frame structure hung from the bridge; a suspension walkway hung from cables anchored to the bridge piers; and a walkway supported by cable stays anchored to the bridge piers. • Identify the advantages and disadvantages of each alternative from a structural, constructability, and maintenance perspective. • Develop comparative -level costs of each alternative. • Develop a structure layout of the preferred alternative to a preliminary level of design. Deliverables: • Technical memorandum that documents the evaluation of walkway alternatives. It is assumed that the memorandum will be up to four (4) pages long and will include preliminary drawings of the walkway (including plan, elevation, and typical section). Assumptions The scope and fee developed for the bridge and structures work element is based on the following assumptions: • All calculations, analyses, design, plans, specifications, and other project work will be prepared in English units. • All drawings will be prepared in AutoCAD format in accordance with Spokane Valley drafting standards. WSDOT General Special Provisions and project- specific Special Provisions will be included as necessary. • This scope of work does not include final structures design of the pedestrian walkway located under the Sullivan Road East Bridge. Final design of the walkway will be covered in a future amendment. 4.0 Project Delivery Schedule CH2M HILL will complete the work outlined in this Scope of Work within two months of receiving a Notice to Proceed from Spokane Valley. Each assignment will be individually negotiated with the CONSULTANT. The amount established for each assignment will be the maximum amount payable for that assignment unless modified in writing by the AGENCY. The AGENCY is not obligated to assign any specific number of tasks to the CONSULTANT, and the AGENCY'S and CONSULTANT'S obligations hereunder are limited to tasks assigned in writing. Task assignments may include but are not limited to, the following types of work: A. Supplemental Surveying and Mapping B. Project Management C. Client Coordination and Consultation Services D. Stakeholder Coordination and Public Outreach (Utility Coordination Only) E. NEPA ECS Documentation (Section 106, CRA, Section 4(f), Biological Evaluation, Noise F. Design Study of Suspended Pedestrian Walkway Task assignments made by the AGENCY shall be issued in writing by a Formal Task Assignment Document similar in format to page 2 of this exhibit. An assignment shall become effective when a formal Task Assignment Document is signed by the CONSULTANT and the AGENCY, except that emergency actions requiring a 24 -hour or less response can be handled by an oral authorization. Such oral authorization shall be followed up with a Formal Task Assignment Document within four working days, and any billing rates agreed to orally (for individuals, subconsultants, or organizations whose rates were not previously established in the AGREEMENT) shall be provisional and subject to final negotiation and acceptance by the AGENCY.
