A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, SETTING THE PUBLIC HEARING I')A`I"E AND °I":IME FOR TUE
PLANNING COMMISSION TO CONSIDER STREET VACATION REQUEST STV-02-
05 PURSUANT TO RCW 35.79.010.
WHEREAS, the City of Spokane Valley has received a Street Vacation request(City Reference
No. STV-02-05) from Fort Knox Investors, LLC, represented by Jeff Johnson, Kiemle & Hagood, West
601 Main Avenue, Suite 400, Spokane , WA 99201, the owner of Parcels No. 45803.0260, 45083.0503
and 45083.0504 and Kenneth Scholz, 2119 N. Locust Road, Spokane Valley, 99206, requesting the
vacation of an unimproved remainder of Knox Avenue west of Locust Road, a public right-of-way; and,
WHEREAS, RCW 35.79.010 specifies that the legislative authority shall establish by resolution
the time when a Street Vacation application shall be considered by the legislative authority or a
committee thereof; and,
WHEREAS, the Spokane Valley Municipal Code 10.05.220 establishing regulations and
procedures for the processing of vacations of public streets (hereafter referred to as "Street Vacation");
and,
WHEREAS, Spokane Valley Municipal Code 10.09.04.10 specifies that the Planning
Commission shall conduct the public hearing required pursuant to RCW 35.79.010; and shall develop
and forward a recommendation for a requested Street Vacation to the City Council.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington, as follows:
Section 1. Establishment of Public Hearing Date and Time for STV-02-05. The required
public hearing for Street Vacation Request STV-02-05 shall he conducted before the Spokane Valley
Planning Commission, April 28, 2005 beginning at 6:00 p.m. in the City Council Chambers at the City
Hall of the City of Spokane Valley, 11707 East Sprague Avenue, Suite 101, Spokane Valley, Washington
99206.
Section 2. Effective Date. This Resolution shall be in full force and effect April 12,2005.
Adopted this 12th day of April, 2005.
