RESOLUTION 05-008
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SPOKANE VALLEY,
WASHINGTON, WAIVING THE BIDDING REQUIREMENTS FOR THE PURCHASE
AND INSTALLATION OF CERTAIN SWIMMING POOL EQUIPMENT.
WHEREAS, the City Council adopted Spokane Valley Municipal Code (SVMC) Section
3.40.040, which requires the City to engage in a competitive bidding process for purchases in excess of
$25,000; and
WHEREAS, the City Council adopted Spokane Valley Municipal Code Section 3.40.050 setting
forth limited circumstances under which it unnecessary to follow the bidding requirements in SVMC
3.40.040; and
WHEREAS, the City has been advised that equipment it seeks for the City swimming pools must
be specially manufactured, and is otherwise not generally available from other vendors, thus qualifying
for purchase under at least one exemption to the bidding requirements.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington, as follows:
Section 1. Pursuant to Spokane Valley Municipal Code 3.40.050(A), purchases in excess of
$25,000 are exempted from the bidding requirements of SVMC 3.40.040 if they are legitimately limited
to being provided by a single source, and under SVMC 3.40.050(B) if the purchase involves unique
facilities that may be specially manufactured or not otherwise generally available. The cost of the
proposed diving boards and installation is estimated at$73,228.00.
Section 2. The Spokane Valley Parks Director, Mike Jackson, has been.notified by the City
parks consultant, The ORB Organization, Inc. that the diving boards at the City swimming pools must be
either removed or replaced. If they are to be replaced, it must be with diving boards specially modified
due to the configuration of the diving wells in the pools. The City was informed by The ORB
Organization, Inc. that they are only aware of one vendor, Paragon, that can provide and install the type
of modified diving boards the City needs.
Section 3. Based upon the foregoing, the City Council does waive the requirement for
bidding on a contract. between the City of Spokane Valley and The ORB Organization, Inc. and/or
Paragon, and potentially a third party construction contractor, for the purchase and installation of
modified diving boards at the swimming pools owned by the City.
