Resolution 08-018 Setting Public Hearing for STV 02-08 CITY OF SPOKANE VALLEY

RESOLUTION NO. 08-018
A RESOLUTION OF THE CI'T'Y OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, SETTING THE PUBLIC REARING DATE AND TIME FOR THE
PLANNING COMMISSION TO CONSIDER STREET VACATION REQUEST STV-02-
08 PURSUANT TO RCW 35.79.010.
WHEREAS, the applicant, Brent Elliott, on behalf of the owners David and Lisa Bowers, Larry
Heller, and Emily Poffenberger, requests a vacation of a portion of a 5th Avenue(40 feet wide by 390 feet
deep). The street is located south of 4th Avenue, north of 6'h Avenue and east of Progress Road,
between Parcels 45231.1510, 4523 I.1523, 45231.1524(north)and 45231.1512, 45231.1519(south),
WHEREAS, RCW 35.79.010 specifies that the legislative authority shall establish by resolution
the time when a Street Vacation application shall be considered by the legislative authority or a
committee thereof; and,
WHEREAS, the Spokane Valley Municipal Code 22.140 establishes regulations and procedures
for the processing of vacations of public streets(hereafter referred to as "Street Vacation"); and,
WHEREAS, Spokane Valley Municipal Code 22.140.120 specifies that the Planning
Commission shall conduct the public hearing required pursuant to RCW 35.79.010; and shall develop
and forward a recommendation for a requested Street Vacation to the City Council.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington, as follows:
Section 1. Establishment of Public Hearing Date and Time for STV-02-08. The required
public hearing for Street Vacation Request STV-02-08 shall be conducted before the Spokane Valley
Planning Commission, October 23, 2008 beginning at 6:00 p.m. in the City Council Chambers at the
City Hall of the City of Spokane Valley, 11707 East Sprague Avenue, Suite 101, Spokane Valley,
Washington 99206.
Section 2. Effective Date. This Resolution shall be in full force and effect upon adoption.
Adopted this 23rd day of September, 2008.
