BORDER EASEMENT
IN THE MATTER OF MIRABEAU PARKWAY, ROAD FILE NO. 2666, KNOW ALL MEN
BY THESE PRESENTS, that the Grantor, Inland Empire Paper Company, A Washington
Corporation, for and in consideration of Mutual Benefits, the receipt of which is hereby
acknowledged, grants to the public and to Spokane County, a political subdivision of the State of
Washington, a BORDER EASEMENT to use the following described real property situated in
the County of Spokane, and the State of Washington, to -wit:
AFFECTS ASSESSORS PARCEL NOS. 45105.9072 AND 45035.9091
That portion of the East Half (E %:) of Section 10 and the Southeast Quarter
(SE %) of Section 3, Township 25 North, Range 44 East, W.M., described as
follows and referenced, drawn and shown hatched on the Right of Way Plan for
CRP 2730, MIRABEAU PARKWAY, Pages 3 and 4, on file in the Office of the
County Engineer, attached to and made a part of this document:
A 14.00 foot wide strip of land lying coincident with the Westerly right of way
line of Mirabeau Parkway from Engineer's Station 33 +94.64 to Engineer's Station
38 +50; from Engineer's Station 38 +50 to Engineer's Station 42 +00, the Easement
area shall be 113.00 feet wide; from Engineer's Station 42+00 to Engineers
Station 56 +97.54 the width shall be 14.00 feet wide, said station being on the
West line of said East Half (E %:) of Section 10.
AND ALSO a 14.00 foot wide strip of land lying coincident with the said Easterly
right of way line of Mirabeau Parkway from Engineer's Station 33 +94.64 to
Engineer's Station 56 +97,54, said station being on the West line of said East Half
(E %2) of Section 3.6>
EXCEPT any portion lying within the right of way for Euclid Road.

Located in the East Half (E %) of section�IU and the Southeast Quarter (SE 1/4) of
Section 3, Township 25 North, Range 44 East, W.M., Spokane County,
Washington.
The Border Easement as shown hereon is hereby granted to Spokane County and its authorized
agents, and to the Public for Road purposes, including but not limited to curbs, sidewalks,
drainage, signage and other usage deemed necessary by the Spokane County Division of
Engineering for the safety and welfare of the Public. No fence or portion thereof will be
constructed within said Easement without permission of the Spokane County Division of
Engineering, nor will any objects be placed in said Easement that would obstruct the sight
distance necessary for safe and efficient vehicular movement. Any other Easements granted or
dedicated within this Border Easement area will be subordinate to the rights created by this
Easement and are subject to Spokane County Division of Engineering permit process prior to
usage.
The Easement and the agreements and duties provided for herein shall run with the land and shall
be binding on, and shall inure to the benefit of the parties referenced herein, their heirs,
successors and assigns.
The Grantor(s) or their successors in interest agree to and shall maintain in good repair the
sidewalks, driveways and landscaping to be installed in such property, and when so doing shall
not be considered agents of Spokane County.
Spokane County shall maintain all drainage inlets, grates, pipes, and drywells used for the
disposal of public road drainage.
