City Manager Jackson will continue discussion of the draft Legislative Agenda.
Please note that we are proposing to remove the Capital Funding Request from this agenda, but
will offer a letter of support to Spokane Valley Partners.

Transportation Funding Request to Replace Sullivan Road Bridge
The City of Spokane Valley respectfully requests $4 million to replace the southbound portion of Sullivan Road Bridge.
Sullivan Road Bridge is key to the economic vitality of the City and greater Spokane Valley region. It connects a primary
industrial area with the City's major retail and commercial areas. In 2010, an inspection found that the 1951 bridge was
structurally deficient. To address the immediate safety concerns, the City imposed weight restrictions. These limitations
cost businesses in the nearby industrial areas a significant amount of money. The City acted quickly to make short-term
repairs and the weight restrictions have since been lifted; however, the bridge remains structurally deficient and is
continually deteriorating. Unless Sullivan Road Bridge is replaced, there is a risk that the City would need to re-impose
weight restrictions or close the bridge. Either event would cause a significant financial burden to industrial industry. The
total cost of replacing the bridge is $19.75 million. The City has contributed $2.3 million, and received an additional
$13.5 million from the BRAC (Bridge Replacement Advisory Committee),FMSIB (Freight Mobility Strategic Investment
Board) and the TIB (Transportation Improvement Board). In light of the signi�cant economic impact of the bridge and
the need to take immediate action,the City requests that the state contribute $4 million to replace Sullivan Road Bridge.

Protect the Local-State Shared Revenues
The City of Spokane Valley encourages the state to preserve local state-shared revenues, and restore funding to those
accounts cut during the last legislative session. These funds include the Liquor Excise Tax Account, Liquor Revolving
Account, Streamlined Sales Tax Mitigation, Municipal Criminal Justice Assistance Account, and City-County Assistance
Account. In 2012, the Legislature eliminated local Liquor Excise Tax funding, and reduced the future City liquor profit
revenues. The City supports restoring this funding and maintaining funding to the other state-share revenue accounts.
Additional Lien Authority to Recoup Code Enforcement Costs
The City of Spokane Valley seeks legislation to provide cities with additional tools to recoup costs for enforcing code
compliance when a court order is issued and a city performs the abatement itself or through a contractor. The legislation
provides cities with the same tool that counties currently have to impose a lien on the property to recover the cost of
nuisance abatement.
Increase Threshold for Substantial Development Pe�nit under the Shoreline Management Act
The City of Spokane Valley recogniaes the importance of its local dock industry. The Shoreline Management Act requires
a permit to construct a dock that is a substantial development. Under current law, a substantial development includes any
dock with a total cost or fair market value exceeding $2,500 in salt water, or $10,000 in fresh water. The City supports
legislation that increases the threshold from $10,000 to $20,000.
The City supports the Association of Washington Cities'legislative agenda items that serve the best interests of
Spokane Vcrlley.

PREVIOUS COUNCIL ACTION TAKEN: Annually, the Mayor makes appointment
recommendations to place councilmembers on various regional boards and committees. Mayor Towey
made several recommendations for committee appointments, which were approved during the Council's
December 11, 2012 council meeting. However, at the end of that meeting, Councilmember Grassel
announces her resignation. Tonight's action is to re-assign her committee appointments as follows:

BACKGROUND: On November 27`h, WSDOT released the 2013 Quick Response Safety
Program call for projects. This program offers $25 million statewide for construction of safety
projects. The source of the funding is the federal Highway Safety Improvement Program from
SAFET-LU and MAP-21. This is very similar to the 2011 program that is funding $1.36 million in
safety improvements throughout our City.
The goals of the 2013 program are 1) reduce fatal and serious collisions on local roads and
streets, and 2) get safety projects on the ground quickly. The program funds onlv the
construction phase of a project, and they must be construction ready by July 2013. There is no
match requirement, but the City would need to fund the design work. Grant applications are due
January 4`h, 2013.
After further review of the program guidance and scoring, staff has developed a short-list of
projects that could be submitted. Several small projects can be combined into one citywide
safety program as we did with the 2011 program. The design work for many of these projects
can be done in-house, but others would require using City funds to pay for design or survey
work.
Citvwide Safetv Proiect II
• Regulatory/Warning Sign Replacement — Staff is currently working on the preliminary
engineering for the sign replacement work funded through the 2011 grant program. Many of
the City's regulatory and warning signs are over 10 years old and losing their nighttime
reflectivity. The 2011 funding will not replace all of the faded signs, so we could request
additional funds to continue that program. Preliminary design work would be completed in-
house with no additional cost to the City.
Applewav Trail
The Appleway Trail (University to Evergreen) did not make the short list for funding through the
state bicycle and pedestrian grant program. Staff has evaluated this project using the scoring
for the Quick Response Safety Grant and discussed it with WSDOT. Based on the benefit/cost
ratio associated with the project, they have recommended that we apply, although there is no
guarantee we will receive funding.
There are several benefits to trying for this funding.
1. If the City pay for the design at $150,000, and receives $1.8 million in construction
funding, we would essentially be paying a 7-8% match on the overall project. Other
funding sources, such as CMAQ or STP would require a 20% match.
2. Even if the City does not receive the Quick Response construction funds, the initiation of
the design process for the University to Evergreen segment will help it to score higher in
other calls for projects this spring.
3. The initiation of design on the University to Evergreen segment may also help the
Evergreen to Tschirley segment to score higher if we choose to apply for funding this
spring.
In order to meet the timeline of the project staff would need to immediately hire a consulting firm
to start the design work. This could be done from the consultant roster. We have estimated the
costs as follows:

Funding for the design could come from the REET fund.
RECOMMENDED ACTION OR MOTION: Council consensus to authorize staff to apply for this
Quick Response Safety Grant Program, and move forward with the design work for Appleway
Trail.
BUDGET/FINANCIAL IMPACTS: If the City is awarded this grant it will necessitate a future
2013 Budget Amendment that appropriates $1,972,000 including $1,822,000 in construction
costs and $150,000 of design costs. The amendment will also include grant revenue of
$1,822,000 to cover the construction portion of the project as well as the use of an additional
$150,000 of City real estate excise tax revenues to cover design costs.

BACKGROUND: On December 11, 2012, Councilmember Brenda Grassel resigned her position by
verbal notice, effective December 31, 2012. Pursuant to RCW 35A13.020, City Council has within
ninety (90) days of the vacancy, to appoint a qualified person to the vacant position. If this timeframe is
not met, the City's authority in this matter would cease and the County would appoint a qualified person
to fill the vacancy. The date to meet the ninety day deadline is March 21,2013.
The proposed draft timeline for this process is as follows:
December 21, 28, and January 4: publication of the notice of vacancy
January 2, 2013: council sends list to City Manager, of desired interview questions
January 8, 2013: council approves Procedure and list of candidate questions
January 11, 2013, 4:00 p.m. Deadline for applications to be received by the City clerk
January 15, 2013, 5:00 p.m.: Executive session to review applications
January 15, 2013, 6:00 p.m.: Determine list of those applicants to interview (open session)
January 29, 2013, 6:00 p.m.: Interviews of selected applicants (open session)
February 5, 2013, 5:00 p.m.: Executive session to discuss applicant interviews
February 5, 2013, 6:00 p.m.: Appointment of applicant(open session) —after which applicant is sworn in
and takes seat at the dias.
Once Council makes the appointment, the newly appointed Councilmember's term would begin
immediately and end once the November 2013 general election results are certified, which is expected to
be November 26, 2013.
OPTIONS: Proceed with the process as outlined or modified

CAD incidents indicate calls for service as well as self-initiated officer contacts. Hot spot maps are
attached showing November residential burglaries, traffic collisions, vehicle prowlings, and stolen
vehicles. Also attached are trend-line graphs for 2009, 2010, 2011 and 2012: Citations, Spokane
Valley Dispatched Calls, Self-Initiated Calls, Collisions, Persons Crimes, Property Crimes, and Sex
Crimes. Also included is the November Crimes By Cities stats report.
In 2011, we switched from UCR to NIBRS classification. As a result, certain crimes were broken
down to their violation parts for NIBRS and each part is now counted. Consequently, comparing
certain crimes before 2011 to crimes during or after 2011 is not possible using the graphs. The crimes
that are impacted by the NIBRS classification changes and should not be compared to prior graphs
include: Adult Rape, Assault, Forgery and Theft.
ADMINISTRATIVE:
The month began with Chief VanLeuven speaking to the attendees of the Citizens Academy about the
Spokane Valley Police Department and the most recent happenings in the city with respect to law
enforcement.

They began CPR and were able to get the victim breathing again prior to the medical emergency
team's arrival. Another 2012 Life-Saving Award was presented to Deputy Tom Walker. On
4/2/2012, Deputy Walker responded to a fire ca1L When he arrived at the location, he cleared the
residents of the apartment building and gave updated information to the responding firefighters.
Without his quick response and action, things could have ended very differently. Chief VanLeuven
accepted on behalf of the Spokane Valley Police Department a SCOPE Appreciation recognizing our
continued support of the mission and goals of the SCOPE Program in 2012. University SCOPE's
Most Valuable Volunteer of the Year 2012 was presented to Dot Burdette. West Valley SCOPE's
Most Valuable Volunteer of the Year 2012 was presented to June King.
Chief VanLeuven attended the semi-annual Washington Association of Sheriffs and Police Chiefs Fall
Conference at Lake Chelan in mid-November.
Chief VanLeuven attended a staff ineeting at the Department of Corrections in Spokane Valley where
he discussed cooperation between the two agencies reference property crimes occurring in specific
areas of Spokane Valley.
A Webinar was presented by the Association of Washington Cities in late November with the topic of
discussion being the Legalization of Marijuana in Washington State (I-502), and the effects of this
initiative on law enforcement, employer issues, and regulation/licensing/taxing of marijuana in the
state.
The Spokane Valley Property Crimes Unit organized a Vehicle Prowling Task Force in mid-
November to target areas in Spokane Valley where a large number of vehicle prowls were occurring.
The unit is made up of some of the detectives in the Property Crimes Unit as well as a few deputies
from the Patrol side of the house. During the last week of November, prowling emphasis logged the
following stats:
➢ 40 people contacted on foot, bicycles or in vehicles leaving target addresses;
➢ Multiple people arrested for 9 felony charges, and 8 misdemeanors;
➢ More were arrested on warrants and or released with charges to be filed by detectives at a later
time; charges included 2nd degree Possession of Stolen Property, Possession of Vehicle Theft
Tools, Possession of Burglar Tools, Vehicle Prowling, Possession of Controlled Substance.
➢ There were a total of 16 vehicle prowlings reported during the week from 11/27 to 12/2 (24
vehicle prowls the previous week). There was still only 1 prowling in District 6, 3 in District 5,
0 in District 3, 6 in District 4, 0 in District 2, and 5 in District l.
➢ Again, by comparison, the week before the emphasis started had 24 prowlings with many in
the eastern districts of the valley.
➢ Members of the task force will be going out with members of the Department of Corrections
the first week of December to arrest several of our targets who have active escape warrants.
COMMUNITY ORIENTED POLICING:
➢ S.C.O.P.E. had a quiet, but busy month in November. Volunteers spent many hours
shuttling Spokane Valley Police cars to the downtown garage for installation of new radios.
This saved numerous hours on the part of those assigned to the precinct.

S.C.O.P.E. Incident Response Team (SIRT)volunteers contributed 25 on-scene hours (including travel
time) in November, responding to crime scenes, motor vehicle accidents and providing traffic control.
Of those hours, 10 hours were for incidents in Spokane Valley. SIRT volunteers also contributed 10
hours to Special Events (Spokane Valley Christmas Tree Lighting). Total November volunteer hours
contributed by SIRT, including training, stand-by, response and special events is 506; year-to-date
total is 5,523 hours.

There were 32 reports of juveniles who ran away from their residence in Spokane Valley during the
month of November 2012, 4 of which remain unsettled. There were a couple juveniles who ran
numerous times during the month, causing the high number of juvenile runaway reports. Five of the
runaways were from group homes.
Abandoned vehicles tagged by S.C.O.P.E. volunteers for impoundment in Spokane Valley in October
totaled 14 and in November 17 with 6 vehicles each month eventually cited and towed. Thirteen
hulks were processed in October and 16 hulks processed in November. During the month of
November, a total of 67 vehicles were processed; the total for 2012 to date is 717.
OPERATIONS:
Neighbor's Call Helps Catch Burglar — In early November at approximately 1:25 p.m., Spokane
Valley Sheriff's deputies responded to a possible prowler call in the 11200 block of East Aloha Court
in Spokane Valley. A neighbor in the area who had reported being a victim of a recent burglary stated
he observed a male walking around a house looking in the windows and continued into the backyard
of the residence. Deputy Walker arrived at the location, contacting the witness and began checking for
the male. He found an unlocked door and no one appeared to be home at the residence. Deputy
Dodge arrived to assist in the search, but the male couldn't be located. The deputies began checking
the surrounding area and another neighbor contacted Deputy Walker. He told him he just observed the
possible suspect in the backyard of the residence. Deputy Walker ran to the backyard and observed
the suspect going over the fence. Additional deputies responded to the area to assist. Deputies located
the 21-year-old suspect several minutes later. During the investigation, it appears the suspect may
have been inside the residence next door while deputies checked the initial location. Witnesses
observed the suspect place some property under a deck in the backyard of a residence as he tried to run
and hide from deputies. The property was recovered and believed to have been stolen from the second
residence. The male suspect was transported to the Spokane Counry Jail where he was booked for

felony Residential Burglary, three misdemeanor charges of Criminal Trespass, and a misdemeanor of
Obstructing a Peace Officer.
Suspect Found Hiding in a Trunk - Spokane Valley Sheriff's deputies working with the North Idaho
Violent Crimes Task Force developed information on a possible wanted 27-year-old suspect. The
suspect was wanted in Idaho for multiple felony charges and was believed to be in the area of Third
Avenue and Freya in Spokane. When the suspect was observed getting into a vehicle as a passenger,
Spokane Valley Sheriff's deputies,joined by units from the Spokane Police Department, conducted a
traffic stop near Sprague and Havana a few minutes after midnight in early November. During the
traffic stop, the suspect was not located inside the passenger compartment although he was observed
getting into the vehicle prior to the stop. It was determined he must have crawled into the trunk via the
backseat sometime after he entered the vehicle or just prior to the traffic stop. The trunk release
switch was activated from inside the vehicle however, the trunk did not open. Believing the male
suspect was holding the trunk closed, several orders to exit the vehicle and warnings a SPD K9 would
be used were given. The suspect eventually allowed the trunk to open and he was taken into custody.
He was transported and booked into the Spokane County Jail on a felony Fugitive from Justice charge.
This is a great example of our local law enforcement agencies working together to find and arrest
suspects as they work to keep our communities safe.
Combative Male Assaults Deputy — In early November, at about 10:00 a.m., Sheriffs Dispatch put
out a call of a male walking eastbound on the south shoulder of I-90 near Argonne Road. Deputy T.
Jones responded to the scene and located a 28-year-old male, walking east on I-90 near Evergreen
Road. Depury Jones saw that the male was walking near the eastbound lanes of travel, making it
extremely dangerous for himself as well as the motoring public. Deputy Jones contacted the male
suspect who became confrontational immediately. The male refused to obey Deputy Jones orders to
keep his hands out of the front of his pockets while waiting for additional deputies to arrive. Due to
the male failing to obey Depury Jones' orders and his strange, possibly drug-induced behavior, Depury
Jones ordered the male to the ground. When Deputy D. Schaum arrived on scene and attempted to
place handcuffs on him, the male spun sideways and struck Deputy Schaum on the side of the face. A
taser application was administered and deputies were able to take the male into custody. The male
suspect was booked into the Spokane County Jail on one felony count of 3rd Degree Assault, one
felony count of Possession of a Controlled Substance (methamphetamine) and a misdemeanor charge
of Obstructing.
Firearms Taken From Valley Residence — In early November, Spokane Valley Sheriffs Deputies
responded to the 2600 block of North Park Road reference a residential burglary. When the
homeowner arrived home from work, he found six firearms and jewelry missing. While the deputies
were conducting their investigation, they learned that the grandson of a neighboring residence may
have taken part in the burglary. Deputies spoke with the grandson, but did not develop enough
evidence to implicate him at that time. The next morning, Spokane Valley Sheriff s Deputies
responded to the area of Trent and Park Witnesses said two males appeared to be prowling the area
and appeared suspicious. When deputies arrived on scene, they located the grandson from the night
prior attempting to hide from them. The grandson was detained and interviewed by Spokane Valley
Detectives about the burglary the night prior. He told investigators he was at the burglary the night
prior along with a 25-year-old male and a 28-year-old male. The grandson said the younger male
suspect was with him in the morning prowling the area of Trent and Park, but fled the scene prior to
deputies arriving. The grandson said the younger male suspect fled the scene in a newer, silver or gray

Nissan Altima with Montana license plates. He said he had not seen the older male suspect that
morning, but provided an address where he lived. Detectives responded to that residence near the
2100 block of West Fairview. When they arrived on scene, the older male suspect exited the residence
and left in a vehicle. Detectives attempted to initiate a traffic stop on him when he fled the scene and a
short vehicle pursuit ensued. The male suspect ran from his vehicle near the area of Euclid and A
Street and several units attempted unsuccessfully to locate him in the area. Detectives did locate a
female subject who remained in the vehicle the male suspect had run from. Later in the evening, the
Spokane Counry SWAT Team served a search warrant at the male suspect's residence. The male
suspect was not located but a stolen vehicle was located at the residence. Two of the stolen firearms
have been located since the burglary. Anyone with information is asked to call Crime Check at 509-
456-2233.
Robbery Victim Shot/Suspect Sought - Spokane County Sheriff's detectives are investigating a
robbery and shooting that occurred in early November in Spokane Valley. This incident was reported
by the male victim who called Spokane County 911 around 11:40 a.m. He stated he had been shot and
was on his way to the hospital for medical treatment. Spokane Valley Sheriff's deputies contacted the
victim at the hospital and a short time later, they located the scene where the shooting took place in the
area of South Bates Drive and Bates Court. The incident appears to have started when a 24-year-old
female suspect called the victim and asked to borrow some money. The victim agreed to meet her in
the area of lOth and Pines Avenue. The victim reportedly had his money in his hands when she
reached out and grabbed all of it. She left the scene in a Jeep vehicle driven by a male. The victim
began following the Jeep as he called the female. She agreed to stop and the Jeep pulled over in the
area of South Bates Drive and Bates Court, just east of Bowdish Rd. The female suspect and the
victim exited the vehicles and she pulled out what is believed to be a small caliber handgun and shot
the victim. She returned to the Jeep and the unidentified male drove away again. The victim sustained
a non-life threatening injury from one gunshot to the area of his shoulder. The female suspect and the
victim are known to each other and the investigation into this incident is ongoing. A few days later,
the female suspect was arrested and booked into the Spokane County Jail on charges of 1 st degree
Armed Robbery and 2nd Degree Assault with a Deadly Weapon.
Valley Residents Victimized By Vehicle Prowler — In mid-November at about 2:00 a.m., Spokane
Valley Sheriffs Deputy N. Bohanek responded to the area of 22nd Avenue and Skipworth Road to a
possible vehicle prowling call. A resident in the neighborhood heard glass breaking, looked outside
and saw a Jeep Grand Cherokee parked on Skipworth between 22nd and 23rd. The resident initially
saw two subjects in front of his home that he felt were responsible for the glass breakage. While
responding to the scene, Deputy Bohanek saw a male subject dressed in black walking northbound on
Skipworth Road. When the 21-year-old male suspect saw Depury Bohanek, he turned and walked in
the opposite direction. Deputy Bohanek located the Jeep Cherokee near 22nd and Skipworth. Deputy
Bohanek saw an open tool box on the grass next to the passenger side door of the Jeep and also saw
extensive damage to the steering column of the vehicle. Sheriffs Deputy P. Pfeifer arrived on scene,
located the male suspect in the area and detained him pursuant to Depury Bohanek's investigation.
Spokane County Sheriff s Dispatch had contacted the owner of the Jeep who stated she had been
asleep and her vehicle must have been stolen from her residence. Sheriff s Deputy B. Zlateff also
responded to the scene and located two additional vehicles that had been broken into. Deputy Bohanek
spoke with all three victims and determined personal items from all three victims were located inside
the Jeep. The male suspect eventually told Deputy Bohanek that he had been "rolling around" in the
vehicle with his brother and knew the vehicle was stolen. Deputy Bohanek was not able to find any

record of the name the suspect provided for his brother. The male suspect was booked into the
Spokane County Jail for the charges of Possession of a Stolen Motor Vehicle, Vehicle Prowling and
Theft.
Salvation Army Scam - Some individuals are going around Eastern Washington and North Idaho
claiming to be collecting scrap metal for The Salvation Army. This is a scam. The Salvation Army
does not go door to door asking for donations. Please do not give anything to anyone who comes to
your home or business claiming to be from The Salvation Army. Try to get their name, phone number
or license plate information and call Crime Check at 509-456-2233. So far the description has been a

71-Year-Old Man Missing - A resident of Spokane Valley was reported missing in late November.
He was last seen at his residence in Spokane Valley before he left to go to a local store driving a white
2012 Kia sedan. The male's family reported he had dementia. The Spokane Regional Air Support
Unit developed information on where the missing person might have been headed to, and searched the
area where he used to live near Mount Spokane. In what was a difficult search due to the large
wooded search area with little information to act on, the flight crew located the victim's vehicle stuck
on a small trail near Blanchard Creek Road. They landed at the closest clearing, and hiked in half a
mile to the car and determined that it was empty. After directing ground units to the car's location,
they re-launched and located the deceased victim in the woods a quarter mile away.
