The right-of-way is unimproved and the abutting parcels are accessed from Sprague Avenue and Eastern Road. The street is located appro�mately 330 feet west of the intersection of ls`Avenue and Dyer Road and further located between Parcel# 35242.9004, 35242.0408 and state right-of- way on the west and east and Parcel#35242.0407 to the north. Please reference map above. Eastern Road was originally dedicated through the Taylors Resurvey Millers Park Plat. Located north of the proposed vacation, appro�mately 127 feet of Eastern Road was vacated by Spokane County at the intersection of Eastern Road and Sprague Avenue. Pursuant to Spokane Valley Municipal Code (SVMC) 22104.030 the Planning Commission must make findings on the following as part of their recommendation to City Council: 1. Whether a change of use or vacation of the street or alley will better serve the public; 2. Whether the street or alley is no longer required for public use or public access; 3. Whether the substitution of a new and different public way would be more useful to the public; 4. Whether conditions may change in the future as to provide a greater use or need than presently exists; and 5. Whether objections to the proposed vacation are made by owners of private property (exclusive of petitioners) abutting the street or alley or other governmental agencies or members of the general public. OPTIONS: Recommend approval, approve with conditions, or recommend denial. Spokane Valley Public Works Department: Appro�mately 50 feet of the right-of-way north of the intersection of ls`Avenue and Eastern Road is not being vacated to allow for the maneuvering of equipment for snow removal and road maintenance of the City's street. 12. Condition of street: Unimproved from is`Avenue north to Spokane Valley Fire Department property 13. Assignment of vacated portions of right-of-way: Pursuant to Section 22.140.0404.0 of the Spokane Valley Municipal Code (SVMC) one-half of a vacated street shall go to each abutting property owner. Washington State Department of Transportation submitted a letter dated Apri18,2011 waiving their interest in having one-half of the Eastern Road right-of-way. Conclusions: The criteria set forth in Section 22140.030 of the SVMC has been met based upon the�ndings set forth. FINDINGS AND RECOMMENDATIONS OF THE SPOKANE VALLEY PLANNING COMMISSION May,26,2011 The following findings have been prepared by Staff for the Planning Commission in the event there is concurrence with the recommended approval. Background: 1. An application for vacation was filed on January 18, 20ll. 2. A completed application for vacation was processed on March 25,2011 3. City Council adopted Resolution No. ll-004 on April 26, 2011 setting the date for a public hearing. 4. The Planning Commission held a public hearing on May 26, 20ll. 5. Following a hearing, the Planning Commission found that the notice and hearing requirements of the applicable Spokane Valley Municipal Code section 22.140.020 have been met. 6. None of the property owners abutting the property to be vacated filed a written objection to the proposed vacation with the City Clerk; and Findings: 1. The vacation of the street will better serve the public because it will allow for the full development of the properties (Parcel#35242.9004, 35242.0407 and 35242.0408) abutting to the north and east. 2. The portion of the street is no longer required for public use or public access. The street cannot access Sprague Avenue to the north and access is prohibited on Interstate 90 on the west. 3. Assignment of vacated portions of right-of-way: Pursuant to Section 22.140.0404.0 of the Spokane Valley Municipal Code (SVMC) one-half of a vacated street shall go to each abutting property owner.Washington State Department of Transportation submitted a letter dated April 8,2011 waiving their interest in having one-half of the Eastern Road right-of-way. Conclusions: The criteria set forth in Section 22140.030 of the SVMC has been met based upon the findings set forth. Recommendations: The Spokane Valley Planning Commission therefore recommends approval to the City Council of the vacation of a 30 feet of width by 83 feet in length of dedicated right-of-way for Eastern Road. This approval is subject to the following: 1. The completion of the street vacation(File#STV-01-11)including all conditions below shall be submitted to the City for review within ninety(90) days following the effective date of approval by the City Council. 2. The vacated property shall be transferred to Parcel No(s). 35242.9004 and 35242.0408 abutting the vacation on the east and west. 3. Following the City Council's passage of the ordinance approving the proposal to vacate the street, a record of survey of the area to be vacated,prepared by a registered surveyor in the State of Washington and including an exact metes and bounds legal description, and specifying if applicable any and all easements for construction, repair and maintenance of existing and future utilities and services, shall be submitted by the proponent to the Director of Community Development, or designee for review. 4. Following the City Council's passage of the ordinance approving the proposal to vacate the street, a Boundary Line Elimination must be done to aggregate (consolidate) the north,west and east parcels. These items can be included on the above mentioned record of survey. 5. The surveyor shall locate at least two monuments on the centerline of the vacated right-of-way with one located at the intersection of the centerline of the vacated right-of-way with each street or right-of-way in accordance with the standards established by the Spokane County Standards for Road and Sewer Construction. 6. All direct and indirect costs of title transfer of the vacated street from public to private ownership including but not limited to title company charges, copying fees, and recording fees are to be borne by the proponent. The City will not assume any financial responsibility for any direct or indirect costs for the transfer of title. 7. The zoning district designation of the properties adjoining each side of the street or alley to be vacated shall be automatically extended to the center of such vacation, and all area included in the vacation shall then and henceforth be subject to all regulations of the extended districts. The adopting ordinance shall specify this zoning district extension inclusive of the applicable zoning district designations. 8. The record of survey and certified copy of the ordinance vacating a street or alley or part thereof shall be recorded by the city clerk in the office of the Spokane County Auditor. 9. All conditions of City Council authorization shall be fully satisfied prior to any transfer of title by the City. HOW DOES A CHANGE OF USE OR VACATION OF THE STREET/ALLEY IMPROVE SERVICE TO THE PUBLIC? With this vacated portion of Eastern Road, the Spokane Valley Fire Department will have the space necessary to rebuild Fire Station #6 on the same site. This site was selected in the 1960's and has proven itself over the years and being an excellent location to serve the citizens from. The building has grown too small for today's fire equipment and is becoming too expensive to maintain. In 2002 the SVFD long range capital facility plan began the planning for its replacement. After evaluation of other possible sites it was determined that the current location was still the best available. 2. IS THE STREET OR ALLEY NO LONGER REQUIRED FOR PUBLIC USE OR PUBLIC ACCESS? EXPLAIN. The northern half of Eastern was vacated in the 1960's because the current Fire Station #6 incorporates that portion within the current building. The southern half terminates into the SVFD fence. So, the portion of the road that remains is a dead end with no turnaround. The portion that remains has no practical purpose for the public use except assisting in the reconstruction of the Fire Station. 3. In reviewing this request the Washington State Department of Transportation(WSDOT)has determined that we do not need additional right of way in this area. Consequently, we waive our interest in having one half of the Eastern Road right of way revert back to WSDOT. This would allow the full Eastern Road right of way to revert to Spokane Valley Fire Department. The waiving of our interest in this vacation is done with the understanding that we will not incur any fees associated with this roadway vacation. If this vacation is approved,please include in the ordinance language that the State of Washington has waived its right to receive one half of the vacated street. We also request that a copy of the ordinance be forwarded to WSDOT showing that the fee ownership for both sides of Eastern Road was transferred to Spokane Valley Fire Department.
