Ordinance 05-014 Amends SVMC 7.05 Nuisance Regulations i C CITY OF SPOKANE VALLEY SPOKANE COUNTY,WASHINGTON ORDINANCE NO. 05-014 AN ORDINANCE. OF THE CITY OF SPOKANE VALLEY,SPOKANE COUNTY, WASHINGTON,AMENDING THE NUISANCE REGULATIONS TO PRECLUDE ADDITIONAL ACTIVITIES, AND PROVIDING PENALTIES FOR VIOLATIONS. WHEREAS, the City has the duty and authority to maintain and protect the health, safety and welfare of its citizens;and WHEREAS, certain conditions exist on private property that are detrimental to the public interest and interfere with the use and enjoyment of public and private property in the community;and WHEREAS, through nuisance regulations, the. City is able to prohibit and abate conditions that exist on property in an effort to improve the quality of life within the City; and WHEREAS, continuous andlor frequent yard sales from residential property can adversely affect neighboring properties. NOW, THEREFORE, the City Council of the City of Spokane Valley, Washington, ordains as follows: Section 1. Purpose and Intent. The purpose and intent of this Ordinance is to amend SVMC 7.05 to include certain yard sale activity as a public nuisance,and to provide penalties for such actions. Section 2. Amendment. Title 7, Section 05, Subsection 020, is hereby amended to add a definition for"yard sale"as follows: "Yard sale means a sale of secondhand miscellaneous household objects in a residentially-zoned area. This definition encompasses similar terms including, but not limited to, garage sale, rummage sale, blanket sale, moving sale, block sale and estate sale. Section 3. Amendment. Title 7, Section 05, Subsection 040 is hereby amended to add a new subsection (R) as follows: 7.05.040 Nuisances Prohibited No person, firm, or entity shall erect, contrive, cause, continue, maintain, or permit to exist any public nuisances within the City. Prohibited nuisances include, but are not limited to: (R) Yard sales. The holding or permitting of a yard sale on the same real property more than seven consecutive days, or more than two consecutive weekends. Section 4. Remainder of SVMC 7.05 Unchanged. The remaining provisions of SVMC 7.05 are unchanged by this amendment. Section 5. Severability. If any section,sentence,clause or phrase of this Ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance. This Ordinance shall be in full force and effect five(5) days after publication of this Ordinance or a summary thereof in the official newspaper of the City.
