AN ORDINANCE 4C E OF TEE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, AMENDING SPOKANE. VALLEY MUNICIPAL CODE 2.25 .
CREATING TIIE OFFICE, ESTABLISHING DUTIES AND PROVIDING FOR
APPOTh'TMENT OF CITY ATTORNEY. •
W .REAS, R.CW 35A.13.090, Council may create such departments, as it finds necessary or
dvisable; and
WHEREAS, RCW 35A.13.0 O delegates the powers and duties of the City Manager to appoint
and remove at any time all department heads, officers, and employees; and
WHEREAS, the City Council desires to prescribe the powers and duties for the City attorney
pursuant to RCW 35A.13.080.
NOW, THEREFORE,E, the City Council of the City of Spokane Valley, Spokane County,
Washington, do ordain as follows=
Section 1. Intent, It is the intent of the City of Spokane Valley to bring City code
provisions into conformity with state Law requirements elating to the powers and duties of the City .
Manager.
Section 2.. Amendment to Spokane Valley Municipal Code 2.25. Spokane Valley
Municipal•Code Section 2.2.5 shall be amended to read as follows:
Section 2.25.010 Office Created, The City Council hereby creates the office of the City
Attorney. This office shall be filled by appointment by the City Manager.
Section 2.25.020 Duties. The City Attorney, or a designated representative, shall:

• A. Advise the City Manager, City Council and employees in all legal matters pertaining to
the business of the City of Spokane Valley,
. B. Represent the City of .Spokane Valley in all actions brought by or against the City of •
Spokane Valley itself and/or its officials and employees in their official capacity, and shall perform such
other duties as the City Manager andfor City Council may direct.
C. Attend all regular and special meetings of the City Council unless otherwise excused.
- D, Draft:, review and approve ordinances, resolutions, contracts and other legal instruments
and documents.
Perform such other duties as may be assigned or prescribed by the laws of the State of
Washington and the ordinances of the City of Spokane Valley,
Section 2.25.030 Qualifications, The City Council and the City Manager shall confer in •
order to establish qualifications for the positions of City Attorney with such qualifications approved by
Resolution of the Council_

Section 2.25.040. Contract. The City of Spokane Valley may also enter into contracts for
additional legal services upon such terms that as are reasonable and just.
Section 3. Severability. If any section, sentence,clause or phrase of this ordinance shall be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or -
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,clause or
phrase of this ordinance.
Section 4. Effective Date. This Ordinance shall be in full force and effect on the official
date of incorporation provided publication of this Ordinance or a summary thereof occurs in the official
newspaper of the City as provided by law.
