Ordinance 05-002 Amends SVMC 6.05 Park Violations Penalties CITY OF SPOKANE VALLEY
SPOKANE COUNTY, WASHINGTON
ORDINANCE NO. 05-002
AN ORDINANCE AMENDING SPOKANE VALLEY CODE TITLE 6, SECTION 05
PERTAINING TO PENALTIES FOR VIOLATIONS OF CERTAIN PARKS REGULATIONS.
WHEREAS, the City of Spokane Valley adopted Municipal Code Section 6.05 to regulate certain
activities within the City park system; and
WHEREAS, the violation of various Park Regulations could result in the assessment of a Class 1
infraction with court costs and fees; and
WHEREAS, the City Council wishes to reduce the level of infraction to a class 3 infraction, with
court costs and fees; and
WHEREAS, adopting a different infraction level for Park Regulation violations is within the
police power of the city to protect the public's health, safety and welfare of its residents.
NO\V, THEREFORE, the City Council of the City of Spokane Valley, Washington, ordains as
follows:
Section 1. Amendment. Title 6, Section 05, Subsection 080, is hereby amended to change
the infraction level as follows:
Any_person violating any provision of SVMC 6.05.030, 6.05.040,6.05.050, 6.05.060. or 6.05.070
shall have committed a class 3 infraction.
Section 2. Remainder of SVMC 6.05 Unchanged. The remaining provisions of SVMC 6.05
are unchanged by this amendment.
Section 3. Severability. if any section, sentence, clause or phrase of this Ordinance should
be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or
phrase of this Ordinance.
Section 4. Effective Date. This Ordinance shall be in full force and effect five(5)days after
the date of publication of this Ordinance or a summary thereof in the official newspaper of the City.
