AGENDA ITEM TITLE: 2014 Annual Comprehensive Plan Amendment (CPA) Process
GOVERNING LEGISLATION: The Growth Management Act (GMA) RCW 36.70A.
PREVIOUS COUNCIL ACTION TAKEN: None.
2014 PROPOSED COMPREHENSIVE PLAN AMENDMENTS: City initiated text amendments
for 2013 will be limited to changes to Chapter 3: Transportation, Chapter 4: Capital Facilities,
Chapter 7: Economic Development, Chapter 9: Parks and Recreation, and Chapter 11: Bike
and Pedestrian Element. It is critical to update the Transportation and Capital Facilities
elements annually due to GMA requirements for concurrency and for certain funding sources,
such as Real Estate Excise Tax (REET). REET money can only be used for capital projects
that are identified in the City's Comprehensive Plan.
City initiated map amendments for 2013 include the reclassification of a City owned parcel
adjacent to the Centennial Trail north of the Mirabeau Trailhead. Staff proposed text
amendments include adding policies and goals to further support Infill development and a
review of land uses in the Light Industrial designation. To date, staff has scheduled two pre -
application meetings for privately initiated amendment requests, but no formal applications
received.
BACKGROUND: The GMA allows local jurisdictions to update comprehensive plans no more
than once each year. The City codified this process in Section 17.80.140 of the Spokane Valley
Municipal Code (SVMC). Consistent with state law and the SVMC, staff published notices in
September advising the public of the annual amendment process and that the City would be
accepting applications for the 2014 cycle through November 1, 2013. Notice was also posted in
the main reception area of City Hall, the Permit Center and at the Valley Library.
Comprehensive Plan Amendments are divided into two categories - map amendments and text
amendments (including charts, tables and graphics). Comprehensive Plan amendments may
be privately initiated or proposed by City staff. Most privately initiated amendments deal with
land use changes.

Street Vacation Application
This memorandum is to advise you of a new application that will be presented to the Planning
Commission and City Council in the coming months.
The City received a street vacation application on September 18, 2013 from Conard & Hill
Development, LLC requesting to vacate a portion of unimproved Alki Avenue (165 feet long by
15 feet wide) located approximately 175 feet east of the intersection of Alki Avenue and
McCabe Road.
The City's Assistant Traffic Engineer, Ryan Kipp, has approved the processing of this
application.
A resolution will be placed on the consent agenda for the October 22, 2013 regular City Council
meeting. The resolution will specify the proposal and the public hearing date before the
Planning Commission.

AGENDA ITEM TITLE: Spokane Valley Regional Decant Facility Phase 2 — 6 Sept 2013 Bid

PREVIOUS COUNCIL ACTION TAKEN: Awarded construction contract for Phase 1 June 11,
2013; Approved 2013 Budget Amendment May 28, 2013, Approved to award Final Design, April
16, 2013; and Approval of an Interlocal Agreement with WSDOT, January 29, 2013.
BACKGROUND: A bid package for the Spokane Valley Regional Decant Facility Phase 2 was
prepared for Fall/Winter 2013 construction and included an additive alternate bid to pave the
facility in the spring 2014. Phase 2 constructs necessary elements for dry weather operations
and foundation work to accommodate a future canopy. The project was advertised for bids on
August 16 and August 23. Bids were opened on Friday, September 6, 2013. The attached bid
tabulation shows the lowest responsive bidder 12% higher than the Engineer's Estimate. The
Engineer based his estimate on recent bid results from around the State.
Staff met with staff from the Department of Ecology and with WSDOT staff requesting additional
funding to award this bid, however, current available funds will not be enough to cover
remaining projected Phase 2 costs.
In discussions with the project team, contractors, and consultants it appears that market
conditions, the complexity and cost of certain design elements, risk of weather, time limitations,
and other factors all escalated unit prices as shown in the bid results.
After careful consideration, staff has decided to reject all bids from the September 6, 2013 bid
opening, look for additional cost savings or items to defer from the Phase 2 package for later
work, and republish the bid for construction of a Phase 2 later in 2014.

RECOMMENDED ACTION OR MOTION: None at this time
BUDGET /FINANCIAL IMPACTS: The current project budget is $980,000, with funding shares
from Ecology at $735,000, WSDOT $150,000, and the City $95,000. There is approximately
$640,000 budget remaining after the completion of phase 1.
