PREVIOUS COUNCIL ACTION TAKEN: On December 22, 2020, Council approved Resolution
#20-016 which established the 2021 fees.
BACKGROUND:
Council approved Ordinance #21-008 adopting traffic fee studies for the Mirabeau and N. Pines
subareas on July 13, 2021. These studies outline transportation impact fees for these two areas,
which need to be added to the City's fee schedule in order to be collected. The proposed
amendment adds two tables of transportation impact fees to Schedule G of the fee resolution.
The changes to the fee schedule will be effective as of August 1, 2021.
OPTIONS: Move to approve the updated fee resolution changes as presented, with or without
further modifications.
RECOMMENDED ACTION OR MOTION: Move to approve Resolution #21-004 repealing and
replacing Resolution #20-016, and approving the Master Fee Schedule for 2021.
BUDGET/FINANCIAL IMPACTS:
Proposed impact fees are anticipated to generate up to $3.98 million of new revenue to be applied
to transportation system improvements identified in the Mirabeau & North Pines Road Subarea
Transportation Impact Fee Rate Study.

RESOLUTION NO. 21-004
A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, REPEALING AND REPLACING RESOLUTION 20-016, AND ADOPTING AND
AMENDING THE MASTER FEE SCHEDULE, AND OTHER MATTERS RELATING
THERETO.
WHEREAS, it is the general policy of the City to establish fees that are reflective of the cost of
services provided by the City; and
WHEREAS, the City uses a resolution to establish the schedule of fees for City programs, permits
and services, and periodically the fee resolution and fee schedule must be amended to incorporate new or
modified services; and
WHEREAS, Council desires to amend the resolution and accompanying fee schedule.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington, as follows:
Section 1. Adoption and Amendment. The Master Fee Schedule is hereby adopted and amended
as provided herein, and all such amendments are incorporated into the attached schedules. The Master Fee
Schedule shall be effective as adopted and amended from the effective date of this Resolution.
Section 2. Repeal. Resolution 20-016 is hereby repealed in its entirety.
Section 3. Effective Date. This Resolution shall be in full force and effect August 1, 2021.

Schedule A — Planning
Automatic Annual Adjustment
Unless otherwise specifically amended, Schedule A of this Master Fee Schedule shall be reviewed and
automatically adjusted annually to reflect (80%) of any change from September to September of the
Consumer Price Index for All Urban Consumers (CPI-U), West Region, 1982-84=100, published by the
United States Department of Labor, Bureau of Labor Statistics, or other comparable index if not published.
In no event shall the cumulative change in rates or charges be more than four percent (4%) per year. Unit

Automatic Annual Adjustment
Unless otherwise specifically amended, Schedule B of this Master Fee Schedule shall be reviewed and
automatically adjusted annually to reflect (80%) of any change from September to September of the

United States Department of Labor, Bureau of Labor Statistics, or other comparable index if not published.
Building permit fees shall not be included in the annual automatic adjustment because updates occur semi-
annually through the International Code Council (ICC) published updates. In no event shall the cumulative
change in rates or charges be more than four percent (4%) per year. Unit prices shall be rounded to the
nearest dollar. The automatic adjustment shall be effective January 1 of each year. No other fee schedules
shall be affected by such automatic adjustment.
Fee Payment
Plan review fees are collected at the time of application. Such fees may be adjusted during plan review.
Overages or under payments shall be appropriately adjusted at the time of permit issuance.
Plan review fees are separate from and additional to building permit fees. Permit fees and any other unpaid
fees shall be collected prior to issuance of the permit.
Fees for outside professional services required during the permit process shall be paid by the applicant.
Examples of outside professional services include review by contract reviewers, special inspection or
construction services, consultant services for special topics, surveying or other services required to
determine compliance with applicable codes.
Fee Refund Policy. Refunds authorized under this policy apply only to Schedule B.
PLAN REVIEW FEES
• Plan review fees are non-refundable once any plan review work has been started.
• Paid plan review fees may be refunded when an eligible request is received in writing.
• At a minimum, a $61.00 administrative fee shall be retained.
• If the paid plan review fee is less than $61.00, no refund is authorized.
• If the paid plan review fee is more than $61.00, the amount for refund shall be calculated
at the rate of 100% of the paid plan review fee minus $61.00.
PERMIT FEES
• Permit fees are non-refundable once work authorized by the permit has begun.
• Paid permit fees may be refunded when an eligible request is received in writing.
• At a minimum, a $61.00 administrative fee will be retained when fees are refunded.
• If the paid permit fee is less than $61.00, no refund is authorized.
• If the paid permit fee is more than $61.00, the refund shall be calculated at the rate of 95%
of the paid permit fee minus $61.00.
For any application taken or permit issued in error, a full refund of fees paid shall be made. No portion of
the paid fees shall be retained.

Revisions to plans requested by the applicant or permit holder shall be charged the hourly rate with a
minimum of one hour. Revised plans submitted in response to reviewer correction letters are not subject
to the hourly assessment.

A RESOLUTION OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON, REPEALING AND REPLACING RESOLUTION 20-016, AND ADOPTING AND
AMENDING THE MASTER FEE SCHEDULE, AND OTHER MATTERS RELATING
THERETO.
WHEREAS, it is the general policy of the City to establish fees that are reflective of the cost of
services provided by the City; and
WHEREAS, the City uses a resolution to establish the schedule of fees for City programs, permits
and services, and periodically the fee resolution and fee schedule must be amended to incorporate new or
modified services; and
WHEREAS, Council desires to amend the resolution and accompanying fee schedule.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane
County, Washington, as follows:
Section 1. Adoption and Amendment. The Master Fee Schedule is hereby adopted and amended
as provided herein, and all such amendments are incorporated into the attached schedules. The Master Fee
Schedule shall be effective as adopted and amended from the effective date of this Resolution.
Section 2. Repeal. Resolution 20-016 is hereby repealed in its entirety.
Section 3. Effective Date. This Resolution shall be in full force and effect August 1, 2021.

Building permit fees shall not be included in the annual automatic adjustment because updates occur semi-
annually through the International Code Council (ICC) published updates. In no event shall the cumulative
change in rates or charges be more than four percent (4%) per year. Unit prices shall be rounded to the
nearest dollar. The automatic adjustment shall be effective January 1 of each year. No other fee schedules
shall be affected by such automatic adjustment.
Fee Payment
Plan review fees are collected at the time of application. Such fees may be adjusted during plan review.
Overages or under payments shall be appropriately adjusted at the time of permit issuance.
Plan review fees are separate from and additional to building permit fees. Permit fees and any other unpaid
fees shall be collected prior to issuance of the permit.
Fees for outside professional services required during the permit process shall be paid by the applicant.
Examples of outside professional services include review by contract reviewers, special inspection or
construction services, consultant services for special topics, surveying or other services required to
determine compliance with applicable codes.
Fee Refund Policy. Refunds authorized under this policy apply only to Schedule B.
PLAN REVIEW FEES
• Plan review fees are non-refundable once any plan review work has been started.
• Paid plan review fees may be refunded when an eligible request is received in writing.
• At a minimum, a $61.00 administrative fee shall be retained.
• If the paid plan review fee is less than $61.00, no refund is authorized.
• If the paid plan review fee is more than $61.00, the amount for refund shall be calculated
at the rate of 100% of the paid plan review fee minus $61.00.
PERMIT FEES
• Permit fees are non-refundable once work authorized by the permit has begun.
• Paid permit fees may be refunded when an eligible request is received in writing.
• At a minimum, a $61.00 administrative fee will be retained when fees are refunded.
• If the paid permit fee is less than $61.00, no refund is authorized.

BACKGROUND: The proposed resolution provides the creation of parking restrictions along the
east side of Cherry Street north of the intersection with Mansfield Avenue pursuant to WAC-330-
270 and the International Fire Code section D103.6.2.
Prior to fall, 2020, Cherry Street ended in a cul-de-sac approximately 1,100 feet north of Mansfield
Avenue and was connected to the north as part of apartment developments in the fall of 2020.
In January, 2021, the City received a request from a school district official to evaluate Cherry
Street north of Mansfield Avenue with regard to roadway width and on -street parking. There was
concern that school buses had difficulty maneuvering along Cherry Street when vehicles were
parked on both sides of the street. A review of the parking codes was completed and found that
the width of Cherry Street exceeded the criteria provided in WAC 308-330-265. Further
investigation did not reveal any existing operational or safety deficiencies on the corridor and no
action was taken.
In April, 2021, the City received a request from a citizen related to the same segment of Cherry
Street. City staff completed another field review and completed a Parking Evaluation Checklist,
which did not identify any operational or safety concerns on the segment that would trigger a
parking restriction.
In July, 2021, the City received a request from the Spokane Valley Fire Department (SVFD) to
prohibit parking on one side of the street north of the intersection of Cherry Street and Mansfield
Avenue pursuant to International Fire Code (IFC) D103.6.2, which states "Fire lane signs as
specified in Section D103.6 shall be posted on one side of the fire apparatus access roads more
than 26 feet wide and less than 32 feet wide." The increase of on -street parking was identified to
be impacting emergency response. City staff verified the width of Cherry Street to range from
31'9" to 34'0" and concluded this is within the range specified by the IFC, and staff recommends
the placement of "No Parking — Fire Lane" signs as requested by SVFD.
OPTIONS: Move to adopt Resolution 21-005, or take other action deemed appropriate.
RECOMMENDED ACTION OR MOTION: Move to adopt Resolution No. 21-005, implementing
Cherry Street Parking Restrictions as proposed.
BUDGET/FINANCIAL IMPACTS: There is additional cost to the City if the parking restrictions
are implemented due to the installation of approximately 14 new signs along Cherry Street.

on one side of Cherry Street north of the intersection of Cherry Street and Mansfield Avenue to provide for
the safe and timely maneuvering of fire apparatus on response calls; and
WHEREAS, the City has adopted the International Fire Code (IFC), in which section D103.6.2 states that
"Fire lane signs as specified in Section D103.6 shall be posted on one side of the fire apparatus access roads
more than 26 feet wide and less than 32 feet wide." The City has performed a field review and determined
that the majority of the segment is at or below 32 feet wide and meets the criteria of section D103.6.2 of
the IFC; and
WHEREAS, the Council has authority pursuant to WAC-308-330-270, after an engineering and traffic
investigation by the traffic engineer to, among other traffic measures, prohibit, regulate, or limit stopping,
standing, or parking of vehicles on any highway at all times or during such times as shall be directed by
official traffic control devices. The City has performed a traffic engineering analysis and determined that
it is appropriate and necessary to prohibit parking along one side of Cherry Street north of Mansfield
Avenue to ensure adequate access by fire apparatus; and
WHEREAS, adoption of this Resolution is necessary to preserve health, safety, and welfare of the general
public.
NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane County,
Washington, that the following No Parking zones shall be established from the effective date of this
Resolution:
No Parking — Fire Lane on the east side of Cherry Street from the intersection of Mansfield Avenue to
1400 feet north of the intersection.
This Resolution shall be in full force and effect upon adoption.

Parking Evaluation Checklist
The purpose of this memorandum is to determine if a parking evaluation is needed in response to requested
parking revisions along Cherry St north of Mansfield Ave. Cherry St. is an unclassified local road with a 25 MPH
speed limit. Cherry St. has curves, curb on both sides of the roadway, no pavement markings, over 30 feet of
paved with, and an uphill grade from south to north. The study area can be seen in Figure 1.
The following are typical guidelines that the City of Spokane Valley uses to determine if there is a parking issue
within the study area based on City code, operations, or safety. If the conditions are met then a parking study may
be warranted based on engineering judgment.
Is the roadway less than 20 feet wide when measured from curb -to -curb?

This segment has been observed and evaluated previously due to citizen concerns regarding buses
with no further action required.
According to the section D103.6.2 of the International Fire Code, Fire apparatus access roads more
than 26 feet wide to 32 feet wide shall be posted on one side of the road as afire lane. The City
received concerns from the fire department in regards to the study area citing difficulty in navigating
the roadway due to parked vehicles. The City conducted a follow-up field visit and measured
multiple widths throughout the concerned segment. The paved width is approximately 31'9" — 34'.
Therefore, signing no parking due to Fire is feasible.
In addition, the City of Spokane Valley's maintenance crew has concerns in regards to snow
plowing in the study area during, the winter due to steep grade, curves, and parked vehicles. Due to
citizen concerns, fire concerns, and snow plow maintenance concerns, the City has decided to
implement parking restrictions along Cherry Street from Mansfield Avenue through the former cul-
de-sac at the Winter Heights apartments.

BACKGROUND: On June 1, 2021, the Washington State TIB issued a Call for Projects for the
Urban Arterial Program (UAP) and the Sidewalk Program (SP). The UAP makes approximately
$68M available statewide and Spokane Valley is eligible to apply for funds from the northeast
region's allocation of about $7.7M. The SP makes approximately $5M available statewide and
Spokane Valley is eligible to apply for funds from the east region's allocation of about $1.1M.
TIB requires a minimum 20% match for any awarded grant funds and additional points can be
scored for matching levels between 20% and 40%. Applications are due August 13, 2020.
Awards will be announced on November 19, 2021.
TIB grant award results over the last three years provide insight into how projects have been
awarded in the past and how they may be awarded in the future. Generally, UAP project
awards range between $1M to $2M and the average award is approximately $1.2M. Twelve of
the 16 awarded projects provided an overmatch of at least 5% over the required TIB match of
20%. See Table 1 for a detailed breakdown of recent UAP awards.

At the July 6, 2021, administrative report on this topic, staff proposed three projects, shown in
Table 3. Staff has updated this Table 3 to reflect the recommended projects for submittal to TIB.
One major difference is present: After discussion with the TIB Program Manager at a July 8,
2021 meeting at City Hall, staff has opted to remove the UAP Argonne Concrete
Reconstruction, Indiana to Montgomery project from TIB consideration for the 2021 call for
projects. At that July 8 meeting, staff was informed that the project does not score well enough
to receive funding. This poor score is due to the recent pavement patches that our street
maintenance provided about five years ago, leaving the street in a "good enough" condition
such that it scores poorly when ranked against other projects. It was recommended that this
project be submitted in future years after the patches have started to fail.
There is opportunity for the City to submit a replacement project; however, any subsequent
project application will only dilute the City's focus on completing the Sullivan preservation
project. With the NHS funds that have recently been awarded to the project, the outstanding
funding need fits well into the typical TIB award range. Because of these factors, staff
recommends submitting only one UAP project in 2021.

RECOMMENDED ACTION OR MOTION: Move to authorize the City Manager or designee to

BUDGET/FINANCIAL IMPACTS: For the Sullivan Corridor project, the City has secured
outside grant funds worth $1,029,000 for preservation elements and $381,600 of stormwater

unfunded amounts, totaling $497,400, would come from REET or Stormwater funds.
Upon coordination with the City's Finance Dept., REET balances are sufficient to cover both
applications, if awarded.

GOVERNING LEGISLATION: Imposition of tax, set-up of LTAC and determination of qualified
expenditures is governed by RCW 67.28, as amended by Engrossed Substitute House Bill 1253
in 2013; and Spokane Valley Municipal Code 3.20.
PREVIOUS COUNCIL ACTION TAKEN: No action on the 2021 process leading to 2022
awards has been taken thus far. Council goals and priorities for using lodging tax revenues to
benefit tourism in Spokane Valley were last reviewed by Council on July 28, 2020.
BACKGROUND:
The Tax Rate:
In 2003, the City imposed an initial 2% lodging tax on all charges for furnishing lodging at hotels
and motels pursuant to RCW 67.28.180. This tax is taken as a credit against the 6.5% state
sales tax, so that the total tax a patron pays in retail sales tax and the hotel/motel tax combined
is equal to the retail sales tax in the jurisdiction — which for Spokane Valley is 8.9%. The
estimated revenues for the initial 2% lodging tax in the 2021 Budget is currently $346,000. This
amount is lower than historical collections due to the effects of the COVID-19 pandemic and
related economic shutdowns in 2020 and 2021. However, 2021 collections appear to be
recovering as the economy has continued to gradually reopen. This being the case, staff
expects to come forward later in the year with a proposed 2021 budget amendment to increase
the budgeted revenues. We are monitoring tax collections closely to refine the 2021 estimate
and establish an estimate for 2022.
On April 14, 2015, the City imposed an additional 1.3% lodging tax pursuant to RCW 67.28.181.
This tax is in addition to the existing 8.9% sales tax imposed in Spokane Valley, and when
combined with a 2.0% lodging tax imposed by the Spokane Public Facilities District, it causes
the total lodging tax rate in Spokane Valley to equal 12.0%. This additional lodging tax went
into effect July 1, 2015. The current estimate for this tax in the 2021 Budget is $213,000. As
discussed above with the 2% tax, staff believes the budgeted amount to be low based on the
recovery seen in the 2021 collections to date, and we anticipate a future proposed 2021 budget
amendment to increase the revenue estimate.

Lodging Tax Advisory Committee (LTAC)
The organizations to which the tax proceeds are distributed are ultimately determined by the
City Council which receives a recommendation from the LTAC. The LTAC is comprised of five
members who are appointed by the City Council, and by State law the Committee membership
must include:
• At least two representatives of businesses that are required to collect the tax,
• At least two people who are involved in activities that are authorized to be funded by the
tax, and
• One elected city official who serves as chairperson of the LTAC.
The LTAC makes its recommendations based upon a combination of written application
materials and a presentation that is made to them by each applicant.
State Rules Governing Use of the Initial 2% Lodging Tax
In 2013 the Washington State Legislature approved Engrossed Substitute House Bill (ESHB)
1253 which amended the lodging tax revenue, application process, selection process, and
reporting requirements. ESHB 1253 specifically retained the City's authority to use lodging tax
revenues to fund:
• Tourism marketing.
• The marketing and operations of special events and festivals.
• The operations and capital expenditures of tourism -related facilities owned or operated
by a municipality or public facility district.
• The operations (but not capital expenditures) of tourism -related facilities owned or
operated by non-profit organizations.

ESHB 1253 also established application and reporting procedures for cities with a population
greater than 5,000, that applicants must now submit their applications to the Lodging Tax
Advisory Committee. The application is required to estimate how the grant award requested will
result in increases in the number of people traveling to the City for business or pleasure in the
following categories:
• Away from their place of residence or business and staying overnight in paid
accommodations;
• To a place 50 miles or more one way from their place of residence or business for the
day or staying overnight; or
• From another country or state outside their place of residence or their business.
Through 2012, the City Council could, at its option, supersede the recommendation of the LTAC
and award lodging tax funds to applicants in the amount the Council collectively determined was
appropriate based upon their own goals and priorities for promoting conventions, festivals,
special events, and tourist travel, regardless of the LTAC recommendation. However, ESHB
1253 altered this authority and the options for City Council action have been viewed as primarily
being limited to either (1) approving some or all of the listed recipients and amounts
recommended by the LTAC, or (2) not approving any recipients and having the LTAC revise its
recommendation for further City Council action.
However, under RCW 67.28.1817, a municipality may propose "a change in the use of revenue
received under [RCW 67.28]," but must submit the proposal to the LTAC for review and
comment. Then, the LTAC must be given at least 45 days to review and provide comments
prior to final action by the municipality. This allows the City Council to conduct its own review of
the materials submitted, including the minutes and recommended amounts by the LTAC, to
come up with its own proposed distribution of the revenue for any of the applicants, which may
be the same or different from the LTAC recommendation. If it is different, the City must give the
LTAC 45 days to review and provide comments on the proposed revised distribution before
taking final action. The Council used this process in 2017 for the 2018 awards to ensure
transparency and the public confidence due to questions from the public that arose during the
LTAC review and recommendation process.
Council Goals and Priorities for Use of the Initial 2% Lodging Tax
In August 2013 Council for the first time adopted goals and priorities that it encouraged the
LTAC to consider when making award recommendations. Based upon subsequent discussions
between Council and Staff in the years of 2014 through 2020, these have evolved as follows:
1. Council desires to direct awards toward funding new and innovative projects, activities,
events or festivals that will distinguish Spokane Valley as a tourism destination and result in
increases to Spokane Valley tourism. As part of this goal, Council will use lodging taxes for
the purposes allowed in State law, which include:
a. Tourism marketing
b. The marketing and operations of special events and festivals
c. The operation and capital expenditures of tourism related facilities owned or operated by
a municipality or public facility district
d. The operation (but not capital expenditures) of tourism related facilities owned or
operated by non-profit organizations.
2. Council will emphasize the utilization of funds for capital expenditures to develop tourism
destination facilities or venues within the City of Spokane Valley as a means of drawing
additional visitors to the City (recognizing that this option is limited to facilities owned by a

municipality or public facility district). Council would like to move in the direction of allocating
a majority of lodging taxes toward this purpose.
3. Council recognizes that lodging nights are an important measure of a successful event or
marketing program and will place higher consideration on events or programs with a
demonstrable history of increasing overnight stays. Council may also take into consideration
to a lesser degree the economic impact of all major components of our tourism -based
economy including shopping, dining and overnight visits.
4. Council will take into consideration revenues derived from lodging sources within Spokane
Valley received by applicants from other municipal entities and agencies such as the
Spokane County Tourism Promotion Authority and Spokane Public Facilities District.
5. An award to any particular applicant cannot be greater than the dollar amount requested in
that applicant's application.

Additional 1.3% Lodging Tax
The 1.3% additional lodging tax imposed by the City via Ordinance #15-008 went into effect July
1, 2015, and we received our first remittance from the State in September 2015. The total
collected during 2020 for this tax was $283,720, and $213,000 is currently included in the 2021
Budget. As discussed above, we believe the budgeted amount is likely low due to recent
economic recovery and we expect to come forward with a proposed 2021 budget amendment to
increase the budgeted revenues.

Proceeds of this tax are to be used solely for capital expenditures for acquiring, constructing,
making improvements to or other related capital expenditures for large sporting venues, or
venues for tourism -related facilities that generate overnight guests at lodging facilities. The
ultimate commitment of these funds will follow an application and award process similar to that
employed with the initial 2.0% lodging tax where the LTAC will consider an application and
make a recommendation to the City Council which will have the final say on whether an award
is made.
The City will need to accumulate enough money prior to beginning such a project. Any project
developed by the City will need to go through the LTAC review process and will take into
account not just the cost of constructing a facility but also the cost of future operations. It is
noteworthy that the proceeds of the additional 1.3% lodging tax may only be used for the
construction of a facility and may not be used for operations.
OPTIONS: Discussion of Council goals and priorities for lodging taxes to be communicated to
the LTAC and applicants.
RECOMMENDED ACTION OR MOTION: This is a discussion item only but staff is:
1. Seeking consensus from the Council on the goals and priorities the LTAC should consider
when evaluating applications; this is scheduled to come before Council as a motion
consideration at the August 10 Council meeting; and
2. Communicating to Council that the 2022 Budget is again being developed to set aside
$30,000 of lodging tax revenues to enhance CenterPlace advertising expenses resulting in
an increase in that marketing budget from $30,000 to $60,000. The Council is able to make
this decision independent of any input from the LTAC because this represents a historical
use by the City that preceded the Legislature's adoption of ESHB 1253. If the City desired
the use of any additional lodging tax proceeds, it would be required to utilize the same
application process noted above that is required of all other agencies seeking funding.

AGENDA ITEM TITLE: Pretrial Services Interlocal Agreement Addendum
GOVERNING LEGISLATION: Pretrial Services Agreement 06-016.
PREVIOUS COUNCIL ACTION TAKEN: Interlocal Agreement for Pretrial Services in the City of
Spokane Valley 06-016, adopted by Council on February 28, 2006.
BACKGROUND: From time to time the City conducts detailed reviews of the County services
provided to the City. In recent years a review was undertaken for Pretrial Services. Part of the
interest in conducting this review was due to the length of time since the last review.
Additionally, we wanted to ensure that the MacArthur Justice Grant, which included grant -
funded Pretrial Officer positions, was properly accounted for within our cost methodology. This
project was subsequently delayed on a number of occasions due to the challenge of fully
evaluating the impact of adding the City of Spokane as a MacArthur recipient of County pretrial
services, as well as scheduling challenges brought on by higher priority projects among both
parties.
With this review now concluded the key findings are summarized as follows:
1) During the course of the MacArthur Grant period (2017-2020), the City of Spokane
Valley did not subsidize the City of Spokane.
2) A new service, Misdemeanor Evaluations, was identified. This service is incorporated in
the attached draft Pretrial Services Addendum and is discussed in further detail in the
following paragraphs.
3) A County responsibility service, Felony Monitoring, was identified which was previously
unaccounted for. This service is incorporated into the existing cost methodology
beginning in 2015. The impact of including this service served to reduce the City's final,
outstanding 2015-2019 Pretrial settle and adjust obligation by $35,838. The parties have
determined that this County -only service can be accommodated within the framework of
the existing methodology and does not require formal modification of the Pretrial
Services Interlocal Agreement.
The purpose of this admin report is to present Council with a draft Pretrial Service Addendum
incorporating a new service —Misdemeanor Evaluations.
The Spokane County Office of Pretrial Services prepares first appearance evaluations for
misdemeanor defendants for the purposes of providing an impartial investigative report for the
District Court, prior to a defendant's first appearance, to assist the Court in making a prompt,
informed release or detention decision. Washington State Court Rules for Courts of Limited
Jurisdictions Court Rule 3.2 addresses various rules pertaining to the release of the accused
pending trial. Misdemeanor evaluations assist the Court in its compliance with this rule.
The proposed addendum would adopt this new service with an effective date of 2011 which is
when we were able to determine this service was added. We initially believed evaluations were
part of the indigent screening process but now believe evaluations are a distinct service that
requires authorization by Council. Staff recommends approving this service as it provides the
value of potentially reducing jail costs when it is safe to release defendants awaiting trial, and
protecting the community and reducing court costs by informing judges when it is not prudent to

2021 ADDENDUM TO THE INTERLOCAL AGREEMENT BETWEEN
SPOKANE VALLEY AND SPOKANE COUNTY RELATING TO THE
PROVISION OF PRETRIAL SERVICES AND OTHER MATTERS RELATED
THERETO
THIS ADDENDUM, is made and entered into by and between the City of Spokane
Valley (hereafter referred to as "City") and Spokane County (hereafter referred to as
"County"), hereafter jointly referred to as "the Parties"; and
WHEREAS, pursuant to chapter 39.34 RCW (Interlocal Cooperation Act), the
Parties have entered into numerous interlocal agreements whereby County is obligated to
provide services to City and its residents; and
WHEREAS, this Addendum applies to the "Interlocal Agreement for Pretrial
Services in the City of Spokane Valley (January 1, 2005-December 31, 2005) executed by
the City on March 1, 2006 and the County on March 14, 2006 ("the Agreement"); and
WHEREAS, Washington State Court Rules, Criminal Rules for Courts of Limited
Jurisdiction 3.2 (CrRLJ 3.2) addresses various rules pertaining to the release of the accused
pending trial; and
WHEREAS, the Spokane County District Court is assisted by the Office of Pretrial
Services to ensure the Court's compliance with CrRLJ 3.2; and
WHEREAS, the Office of Pretrial Services provides first appearance evaluations
for misdemeanor defendants for the purposes of providing an impartial investigative report
for the Court, prior to a defendant's first appearance, to assist the Court in making a prompt,
informed release or detention decision; and
WHEREAS, the Parties desire to amend the Agreement with retroactive application
for the period 2011-2014 during which time the City received misdemeanor evaluation
services, and encompasses a period that has been reconciled to actual costs; and
WHEREAS, the Parties desire to amend the Agreement with retroactive application
for the period 2015-2020 during which time the City received misdemeanor evaluation
services, and encompasses a period that has not been reconciled to actual costs; and
WHEREAS, the City desires to continue to utilize the Office of Pretrial Services to
provide misdemeanor first appearance evaluations to Spokane Valley defendants effective
beginning in 2021.
NOW THEREFORE, for and in consideration of the mutual promises set forth
hereinafter, and as provided for in the underlying agreement between the Parties, the Parties
do hereby agree as follows:

SECTION ONE: MISDEMEANOR FIRST APPEARANCE EVALUATIONS
SCOPE OF CHANGE - The scope and purpose of this Addendum to the Interlocal
Agreement for Pretrial Services in the City of Spokane Valley (January 1, 2005-December
31, 2005) is to incorporate misdemeanor first appearance evaluations (currently provided
for misdemeanor DUI and Domestic Violence cases) as a new service within the
Agreement.
The City's share of this new service will be captured by incorporating misdemeanor
evaluations within the existing usage metrics outlined in Exhibit 2. This Addendum applies
retroactively to the calendar years 2011-2014, which includes years that have been
reconciled to actual costs. The purpose of this retroactive application is to ensure that the
services that were reconciled to actual costs are for services officially authorized by the
Parties. This Addendum further applies retroactively to the calendar years 2015 - 2020,
which includes years that have not been reconciled to actual costs. The purpose of this
retroactive application is to recognize that the services were provided to the City during
this period. This Addendum is also effective beginning in 2021 and is subject to the
automatic annual renewal provisions contained within the Agreement.
Exhibit 1 of the Agreement shall be amended by adding the following highlighted language
as new paragraphs following the existing provisions:
Washington State Court Rules, Criminal Rules for Courts of Limited
Jurisdiction 3.2 (CrRLJ 3.2) addresses various rules pertaining to the
release of the accused pending trial.
COUNTY though the OPTS will prepare first appearance evaluations for
misdemeanor defendants for the purposes of providing an impartial
investigative report for the Court, prior to a defendant's first appearance,
to assist the Spokane County District Court in making a prompt, informed
release or detention decision.
SECTION TWO: DURATION - This Addendum shall be in full force and
effect on the Agreement for the remaining term of the Agreement, or any extension of that
Agreement.
SECTION THREE: REMAINDER OF INTERLOCAL AGREEMENT TO
REMAIN THE SAME - The remaining provisions of the Agreement will remain
unchanged by this Addendum.
THE PARTIES have caused this Addendum to be executed on the date immediately
above their signatures.

RCW 10.101.020(1) provides that a determination of indigency shall be made for all persons wishing the
appointment of counsel in criminal cases where the right to counsel attaches and that the Court shall
determine whether the person is indigent pursuant to the standards set forth in chapter 10.101 RCW.
COUNTY through the Office of Pretrial Services ("OPTS") will process indigene) applications fir CITY in
instances where the charge is for a violation of a state statute punishable as a misdemeanor or gross
misdemeanor offense committed by an adult within the jurisdiction of the CITY and/or where the charge is
for a violation of a City of Spokane Valley ordinance punishable as a misdemeanor or gross misdemeanor.
Pretrial Services shall be provided in the OPTS office, Spokane County Jail, or in the courtroom at the
request of a Spokane County District Court Judge. In the event the PARTIES request Services be provided
at a location other than those provided for herein, the PARTIES agree to meet and mutually negotiate any
and all increased/decreased costs to COUNTY in providing such Services at such additional location(s).
CITY further recognizes that a change in working location is a change in `working conditions." COUNTY
will need to negotiate changes in working locations with affected bargaining units.
