The following is the title and summary of Ordinance No. 17 passed by the City of Spokane
Valley City Council on the 7th day of January,2003.
AN ORDINANCE OF THE CITY OF SPOKANE VALLEY, SPOKANE COUNTY,
WASHINGTON,IMPOSING A ONE-QUARTER PERCENT EXCISE TAX ON REAL
ESTATE SALES,IMPOSING RESTRICTIONS ON USE OF THE TAX, PROVIDING
FOR COLLECTION AND REFUNDS AND ESTABLISHING A SPECIAL FUND
The introductory paragraphs state the City desires to impose a tax upon real estate transactions in
an amount of one-quarter of one percent and that this tax is a diversion of tax previously
collected by Spokane County.
Section 1 imposes a one-quarter of one percent real estate excise tax and provides that the
proceeds will be used in the City Capital Project Fund.
Section 2 authorizes the County Treasurer to collect the tax.
Section 3 provides the tax obligation belongs to the Seller.
Section 4 provides for a lien on real property for failure to pay the tax.
Section 5 states the duties of the County Treasurer.
Section 6 provides for the due date.
Section 7 provides for refunds.
Section 8 creates a special City fund to deposit the tax.
Section 9 provides for a penalty upon failure to pay the tax.
Section 10 establishes a severability clause in the event some portion of the Ordinance is held
invalid.
Section 11 states this Ordinance shall be in full force and effect five (5) days after publication of
the Ordinance Summary, and on the date of incorporation.
