WHEREAS, ihe Ciiy of Spokane Vailey wiil in-
I corporate on March 31, 2003;
WHEREAS, RCW 35A 13.090 reguires that
the City Cauncil make a provision for obtaining
legal counsel ior the City oi Spokane pursuant
to the recommendation of the City Manager;
WHEREAS, tfie City Council desires 1o pre-
scribe the pawers and duties far the City Attor-

WHEREAS, RCW 35A.13.090 requires that the City Council make a provision

NOW, THEREFORE, the City Council of the City of Spokane Valley, Spokane
County, Washington, do ordain as follows:
Section 1. O ice Created. The City Council hereby creates the office of the
City Attorney. This office shall be filled bY aPPointment bY the CitY Council uPon the
recommendation of the City Manager.
Section 2. Duties. The City Attorney, or a designated representative, shall:
A. Advise the City Manager, City Council and employees in all legal matters
pertaining to the business of the City of Spokane Valley.
B. Represent the City of Spokane Valley in all actions brought by or against
the City of Spokane Valley itself and/or its officials and employees in their official
capacity, and sha11 perfonn such other duties as the City Manager andlor City Council
may direct.
C. Attend all regular and special meetings of the City Council unless
otherwise excused by the City Council.
D. Draft, review and approve ordinances, resolutions, contracts and other
legal instruments and documents.
E. Perform such other duties as may be assigned or prescribed by the laws of
the State of Washington and the ordinances of the City of Spokane Valley.
Section 3. Qualifications. The City Council and City Manager shall confer
in order to establish qualifications for the position of City Attorney with such
qualifications approved by Resolution of the Council.
Section 4. Contract. The City of Spokane Valley may also enter into
contracts for additional legal services upon such terms that as are reasonable and just.

Section 5. Severabilitv. If any section, sentence, clause or phrase of this
ordinance shall be held to be invalid or unconstitutional by a court of competent
jurisdiction, such invalidity or unconstitutionality sha11 not affect the validity or
constitutionality of any other section, sentence, clause or phrase of this ordinance.
Section 6. Effective Date. This Ordinance shall be in full force and effect oi1
the official date of incorporation provided publication of this Ordinance or a summan,
