INTRODUCTION OF SPECIAL GUESTS AND PRESENTATIONS: n/a COMMITTEE,BOARD,LIAISON SUMMARY REPORTS: Councilmember Gothmann: reported that he attended the Spokane Valley Business Association meeting; since he could not attend the previous tour, he took a private tour of the Waste-to-Energy Plant; went to the Business Education Committee meeting of the Chamber of Commerce at Freeman High School and mentioned he saw the plans for the new expanded gym, which was partially funded with approximately $80,000 from private community funds; attended the Spokane Regional Health Department Videofest; went to the State of the City address by Mayor Verner, who announced the City of Spokane will be accelerating infrastructure to take advantage of the current lower bid rates; went to the Board of Health Executive Meeting and said he volunteered to be on that Board's budget committee where they will be discussing electronic cigarettes; went to the Greater Spokane Valley Chamber of Commerce breakfast; a meeting at the Greater Spokane Substance Abuse Council, and said they needed a councilmember on that Council as well and said he volunteered for that, and that they will be asking for a letter of support in the future concerning a grant they will be applying for which will benefit those in the Edgecliff area, adding that the Mayor should be receiving information concerning that support letter request soon, which will have no financial impact on our city; said he attended today's 911 meeting where the sheriffs office Council Regular Meeting 02-22-2011 Page 1 of 5 Approved by Council: DRAFT explained they are working with the City of Spokane to consolidate two dispatch centers; and said he was recently informed that Airway Heights council now has completely paperless agendas. Councilmember Grafos: said he attended the Association of Washington Cities Legislative Action Conference in Olympia, and his three issues of concern were: (1) the sprinkler system for the Spokane Valley food bank, (2) funding for the purchase of additional park land adjacent to Centennial Middle School; and (3) legislation to prevent cattle trucks from Canada and Idaho coming through our local streets; and said of those three issues,the funding for the additional park land is the least likely to receive funding. Deputy Mayor Schimmels: said he attended the Inland Pacific HUB meeting which he said is a Freight Mobility Group in this area and ties in with Kootenai County; went to the Spokane Regional Transportation Committee meeting; and traveled to Vancouver, Washington and sat in on a listening session. Councilmember Grassel: explained that she also attended the legislative session in Olympia where she had the opportunity to meet with several representatives and discuss our legislative agenda; and said they heard during the Governor's luncheon that they continue to work on the 2009-2011 supplemental budget, and by the end of July will be looking at cutting another$700 million. MAYOR'S REPORT: Mayor Towey stated that he also attended the legislative session in Olympia and reported that the state will likely have to cut$4.8 billion by April, and said he feels it was very productive for local elected officials to let the legislators know how we're doing and that what they do in Olympia affects us here; he attended the Mukogawa Fort Wright Institute's celebration of the new year. PUBLIC COMMENTS: Mayor Towey invited general public comments Steven Neill, 10820 E 18t''Avenue: said he went to the third of eight meetings last Thursday concerning updating the Shoreline Management Act language, which will be presented to this council; he said the environmental groups were well represented and that from what he saw, they were the most dominating voice participating; he said there were two things which stood out to him: (1)the introduction of language which would prohibit the creation of any more parking lots that could be used to allow convenient parking close to the Centennial Trail even on private property; and (2) the restriction of private trails leading to the Centennial Trail even on private property; he said he wanted to make sure council is aware of this language and said in his opinion, it is most certainly contradictory to the U.S. Constitution's Fifth Amendment which specifically states "no person shall be deprived of life, liberty or property without due process of law, nor shall private property be taken for public use without just compensation." He said he is not a lawyer, but the language seems to be a taking of an individual's right to use their property as they see fit; and said unless the City plans on giving recompense for this taking, he suggests the language be looked into. 1. Acting City Attorney Driskell explained the purpose of the ordinance, as noted in previous meetings, and said a typographical error on page 3 will be corrected. Mayor Towey invited public comment. Ronnel Routon, 1617 E Providence Avenue, Spokane, said that she is with Smart Smoke, one of the largest retailers of e-cigarettes in the Spokane area; and stressed the importance of council passing this ordinance; said they have been self- regulating for the last several years, and they include a list of all contents on all their products' labels; she said they feel it is important consumers know exactly what they are purchasing; and said they have elaborate identification devices to help ensure they are not selling to minors. There were no other public comments. In response to Councilmember Grassel's questions about the process to inform the business owners of the new regulations, Mr. Driskell said in addition to the ordinance summary being published in the newspaper, he will ask the Health District to send out notices to known businesses who sell these products, including giving them information about the mandatory signage. Proposed Resolution Adopting Comprehensive Emergency Management Plan(CEMP)—Mike Jackson It was moved by Deputy Mayor Schimmels and seconded to approve resolution 11-002 adopting the Spokane Comprehensive Emergency Management Plan. City Manager Jackson said that at the February 8, 2011 Council meeting, Chief VanLeuven and Emergency Management Program Administrator Lisa Jameson gave an overview of this plan, and tonight staff seeks approval of the resolution to adopt this Plan. Mr. Jackson said a complete copy of the Plan,which is over 400 pages in length, is on file with the Clerk as well as on the Department of Emergency's website. Chief VanLeuven said the plan is good for four years. Mayor Towey invited public comment. Dick Behm, 9405 E. Sprague: said he and others helped to develop this plan in 2004; that it is important and covers everything from wildfires to floods to what would happen in our area should a major earthquake occur in King County, thus forcing the evacuation of thousands of people who would likely if possible, come to this region. Motion Consideration: Fuel Tax Grant Distribution Agreement— Steve Worley It was moved by Deputy Mayor Schimmels and seconded to authorize the Mayor to sign the TIB's Fuel Tax Grant Distribution Agreement for the 24th Avenue—Adams Road to Sullivan Road Sidewalk Project." Senior Engineer Worley explained that last year staff came to council with requests for grant applications for some of the city's capital projects, and that one of those was the TIB (Transportation Improvement Board) projects, and said we were successful in getting this project, and that as part of the normal paperwork process when we are awarded a grant from TIB, the Fuel Tax Grant Distribution Agreement needs to be signed by the Mayor to get the project started. Councilmember Gothmann disclosed that he is part of the TIB Board and asked if that presented any conflict, and Attorney Driskell said he felt it did not since Mr. Gothmann is on that board as per his council appointment. Mayor Towey invited public comments. Alan Hinkle, 11916 E. Sprague Avenue asked clarifying questions concerning the area of the project, and he received clarification that it is on 24t'' Avenue and Adams. Arne Woodward, 2511 Best Road encouraged passage of this motion and said the area has a dangerous corner where the kids climb up on the bank, and said this will help alleviate that problem. Council Regular Meeting 02-22-2011 Page 3 of 5 Approved by Council: DRAFT PUBLIC COMMENTS: Mayor Towey invited general public comments Bruce Wakeman 7616 E Baldwin Avenue: explained that a couple weeks ago the Planning Commission discussed the ordinance for adult retail use and entertainment; that he looked up the State's definition of obscenity and found it to be pretty strong; said he e-mailed his comments to the Planning Commission and received a response that the e-mail could not be received because of objectionable content; said he is glad we have a good filter on our e-mails; said he feels there should be a high standard for the community at-large and the community should not be subjected to have to see the adult book stores and their advertising; that nationwide a Mr. Eric Holder, National Public Attorney, has not prosecuted any obscenity laws; that in 1973 the Supreme Court said obscenity is not protected speech under the First Amendment; said there is a movement to send the legislators a letter to ask Eric Holder to begin prosecution of the laws we have regarding obscenity; and to ask our state legislators to help clean up our communities. Mel Jones, 1404 N Hodges Road Greenacres: concerning the chickens in residential areas issue, that he supports chickens in residential areas; said an ordinance was adopted by Seattle which expanded the opportunity to people to grow their own food, and if grown there, can be sold there; and said that offers sustainable vision for the Seattle area and he is hopeful it could do likewise for Spokane Valley; and said he would like to see things included such as allowing the growing and selling of vegetables; and he urged council to consider the bigger vision to include more than chickens. ADMINISTRATIVE REPORTS: 5. Chickens in Residential Areas (CTA 01-11)— Christina Janssen Via her PowerPoint presentation, Assistant Planner Janssen explained the current regulations, the proposed amendment, and the regulations of several surrounding jurisdictions. Ms. Janssen also mentioned that City Code Enforcement Officers report that they typically receive one to two complaints per month regarding chickens, and more complaints about roosters; and said the proposal is to separate chickens from other small animals such as other fowl; and that these changes would be just for chickens. Councilmember Grassel asked about allowing chickens in front yards, and Ms. Janssen explained that the first twenty feet of a yard is considered the front yard, so it would not be allowed. There were no objections to moving forward for a first reading March 8. 6. Code Text Amendment,Adult Retail Uses—Lori Barlow Associate Planner Barlow went through her PowerPoint to explain the proposed amendment, and said the intent is to limit viewing of adult-themed films to occur within adult entertainment establishments which are appropriately regulated; she explained the differences between adult retail use establishments and adult entertainment establishments; and explained that the Planning Commission voted four to three to recommend the Commission's alternative definition for council's consideration. She said staff does not support the proposed Planning Commission alternative definition because it regulates based on the expectation of adverse impacts instead of the evidence of such impacts; and said if the City finds that the alternative proposed by staff does not achieve the desired result of limiting viewing of adult video in the nature of an arcade to the adult entertainment facilities, we can come back with a second amendment to address specific problems; and said it is felt the incremental approach should reduce risk for the city. Both definitions were provided for council's future consideration. Ms. Barlow said that staff received Mr. Wakeman's comments, and they will be included in the material provided to council at the first reading of the ordinance. There were no objections to moving forward for a first reading March 8. 7. Liberty Lake Sign - Mike Jackson City Manager Jackson said that we have been asked by Liberty Lake City Engineer Andrew Staples to consider sharing in the cost to erect a monument sign between the two cities, and that a rough estimate given July 2009 was $24,700; and that the estimate includes the use of solar lighting rather than connecting to an electrical grid. Mr. Jackson said that he, Mr. Kersten and Mr. Stone have discussed this,that there is no hurry and no sign plan yet; but Liberty Lake would like to know if we are interested in participating, and said he was looking for a consensus from council. Although the use of solar lighting was mentioned, it was suggested if we participate in such a sign, that it be wired for electricity,thus saving money should we later need or decide to use electricity. Landscaping, sign design, the idea of a sign similar to those at CenterPlace, and how many signs were all discussed and it was determined that staff will gather more data and bring this matter back to council at a later time. 8. Advance Agenda—Mayor Towey Councilmember Grassel announced she would not be in attendance at the March 8 council meeting. The City Council in 2010 adopted revisions to the Adult Entertainment provisions in SVMC 5.10 identifying this type of conduct as "adult entertainment," rather than "adult retail." On January 13, 2011, the Planning Commission conducted a public hearing and considered the language of the text amendment proposed by staff. The Planning Commission decided that stronger language should be considered which further restricted adult-oriented movie viewing to promotional clips in a visible location and directed staff to provide an alternative definition. On February 10, 2011 an alternative definition was provided to the Planning Commission for consideration. After much discussion the Commission voted 4-3 to recommend to the Council that the Planning Commission Alternative definition be considered. Staff does not support the proposed Planning Commission Alternative definition because it regulates based on the expectation of adverse impacts, rather than evidence of such impacts. If the City finds that the alternative proposed by staff does not achieve the desired result of limiting viewing of adult video in the nature of an arcade to adult entertainment facilities, it can come back with a second amendment to address specific problems. "Adult arcade station" refers to the area in which an adult arcade device is located and from which the graphic picture, view, film, videotape or digital display of specified sexual activities or sexual conduct is to be viewed; and WHEREAS, "adult arcade device, " sometimes also known as "panoram," "review," "picture arcade," "adult arcade," or "peep show," means any device which for payment of a fee, membership fee or other charge, is used to exhibit or display a graphic picture, view, film, videotape, or digital display of specified sexual activities or sexual conduct; and WHEREAS, SVMC Appendix A defines "adult retail use establishment" as an establishment which, for money or any other form of consideration, devotes a significant or substantial portion of stock in trade,to the sale, exchange, rental, loan,trade,transfer, or viewing of adult-oriented merchandise; and WHEREAS, an adult retail establishment allows viewing of adult-oriented merchandise, which could include the viewing of a graphic film, videotape, or digital display of specified sexual activities or sexual conduct the establishment sells in return for money or any other form of consideration; and WHEREAS, the current Code may be interpreted to allow an adult retail use establishment to show adult- oriented graphic film, videotape, or digital display of specified sexual activities or sexual conduct that the establishment sells and still be within the definition of adult retail use; and WHEREAS, it was not the City's intent when it adopted the definition of"adult retail use establishment" to allow the on-premises viewing of adult-oriented graphic film, videotape, or other digital display of specified sexual activities or sexual conduct that the establishment sells, when that viewing is in return for money or any other form of consideration, because the adverse impacts of such viewing are properly regulated as an adult entertainment establishment; and WHEREAS, the City recently amended SVMC Chapter 5.10, which specifies that the viewing of adult- oriented graphic film, videotape, or digital display of specified sexual activities or sexual conduct that the Ordinance 11-005 Page 1 of 3 DRAFT establishment sells, when that viewing is in return for money or any other form of consideration, is an adult entertainment establishment use and not an adult retail use; and WHEREAS, the city does not intend to prevent any person or entity from exercising rights protected by the Washington and United States Constitutions; and WHEREAS, the following amendment is necessary to clarify the permissible uses of an adult retail use establishment,to prevent the adverse impacts associated with adult entertainment establishments that allow on- premises viewing for any consideration, and to enact a reasonable time, place or manner regulation that protects the health and safety of the City and its citizens. Such impacts are set forth in the legislative record to Spokane Valley Ordinance 10-006,which is incorporated herein by reference; and WHEREAS, after reviewing the Environmental Checklists, the City issued a Determination of Non- significance (DNS) for the proposal, published the DNS in the Valley News Herald, posted the DNS at City Hall, and mailed the DNS to all affected public agencies; and WHEREAS, the City provided a copy of the proposed amendment to Community Trade and Economic Development(CTED) initiating a 60 day comment period pursuant to RCW 36.70A.106; and WHEREAS, on December 9, 2010,the Planning Commission reviewed the proposed amendments; and WHEREAS, the Planning Commission received evidence, information, public testimony and a staff report and recommendation at a public hearing on January 13, 2010; and WHEREAS,the Planning Commission deliberated on February 10, 2011;the Planning Commission provided a recommendation; and WHEREAS, on February 22, 2011, City Council reviewed the proposed amendments; and WHEREAS, on March 8, 2011, City Council considered a first ordinance reading to adopt the proposed amendment. NOW THEREFORE, THE CITY COUNCIL SPECIFICALLY ORDAINS AS SET FORTH BELOW: Section One: Purpose. The purpose of this Ordinance is to amend the definition of "adult retail use establishment" found in Spokane Valley Municipal Code Appendix A in order to be clear that the City does not intend for an adult retail use establishment to allow their patrons to view adult-oriented graphic films, videotapes, or other digital display of specified sexual activities or sexual conduct within their retail use. If any section, sentence, clause or phrases of this Ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, clause, or phrase of this Ordinance. As noted, the subject is commonly known as 17002 E. Euclid Ave., and is listed as county tax parcel 45121.9118. Based on public records, the property includes: Land- 2.96 acres (estimated at 129,000 square feet [SF]), industrially zoned, mostly level and at grade, irregular shape approximating a triangle, with about 425' of frontage on Euclid, adjacent to rail tracks on the east and south. Building- a 1 story detached Garco steel frame/steel clad industrial building, built in 1989, with approximately 4,500 SF of clear span warehouse and 1,600 SF of partitioned office space. Warehouse includes 4 automatic truck doors, concrete floor with drains,suspended gas heaters, insulated walls and roof, lighting, and compressor piping. (Note: waste oil heater is not included as real property). Office includes 3 entry doors,4 large rooms, 2 restrooms, utility rooms and hallway, with painted/paneled walls, dropped ceilings with recessed lighting, and carpet and sheet floor coverings. Gas fired HVAC, 2 furnace units. Site- paved parking and yard with about 19,300 SF of hard surface asphalt (about 16 parking spaces), storm water swales and landscaping, 100,000 SF of gravel surface yard, and a high chain link fence with 3 strand security wire and truck gates. 12 Existing Use and Highest and Best Use The property was vacant and available for sale or lease as of the date of inspection. I understand that the property was originally built in 1989 for Metro Hauling for use as a trucking business office / yard / shop. I also understand that the property was recently leased to Abe() Trucking for a storage and maintenance facility. The Highest and Best Use of the property is for continued use as an industrial facility, recognizing that the property tends to have wide appeal to trucking firms, contractors, heavy equipment dealers, and other similar users. The property also has potential for expansion since it has more than adequate land, and since the property is effectively a part of the 600 +/- acre Spokane Business and Industrial Park operated by Crown West Realty. • JZ Harris LLC Property at 17002 East Euclid Ave.,Spokane Valley Page 7 13 Summary of Analysis and Conclusions of Value Commercial and industrial real estate brokers refer to the subject real estate market as the `Industrial Park' or `Valley' market, and industrial use tends to be centered in the area between Sullivan Rd. and Barker Rd. north of the Spokane River, as well as in the `Montgomery corridor' area between Argonne Rd. and Pines Rd. The industrial area near Felts Field Airport and the Spokane County Fairgrounds is also considered to be a competitive market. The following industrial listings and sales have been considered as primary indicators for the subject property: • 17711 E.Euclid Ave.—This property includes 5.04 acres of land improved with a 7,000 SF steel building built in 2004,and is currently listed for sale at$990,000 by Cantu Commercial. This property is very similar to the subject, but has more land area,and is in a slightly poorer location. • 12822 E. Indiana Ave.--This property includes 2.37 acres of land improved with a 9,983 SF steel building built in the 1970's, and is currently listed for sale at$800,000 by Kiemle and Hagood Co. This is a larger, older building on a smaller site,with good freeway visbiiity. • 11624 E Montgomery Ave.--This property includes 1.38 acres of land improved with an 11,130 SF steel building built in 1978,and sold in August of 2007 for$740,000. • 1723 N. Dickey Rd.--This property includes 2.9 acres of land improved with a 6,300 SF steel building built in 1979,and sold in July of 2007 for$1,100,000. The prior sale of the subject property in October of 2007 at a price of$611,000 has also been considered, recognizing that the sale price did not include the perimeter chain link fencing and gates which have been added very recently at a cost estimated to be over $30,000. I understand that the 2007 sale had some elements of a distress sale on the part of the seller, and may not have been a market transaction. Land sales, land listings, and other sales of industrial property have also been considered for the Direct Sales Comparison section of this report- this includes the current listing of the land to the east of the subject which is for sale by Keller Williams Realty. Some land sales in the Industrial Park have reached the $4.00 per SF level, although it is more likely that the subject land has a current value in the $3.00 to $3.50 per SF range. The Income Capitalization Approach has been given some weight in the analysis, since the subject property is suitable for a long term lease, and since it is understood that a recent tenant leased the property for $5,500 per month. The Cost Approach (replacement cost less accrued depreciation plus land value) is less reliable in this situation, however it has been considered due to the significant increases in the cost of building materials as of the date of value. This technique supports a value conclusion in the $750,000 to $800,000 range. The data from all three approaches indicates a probable range of value from more than $675,000 to less than $800,000. From a positive point of view, the subject property is a flexible use industrial property located in one of the best industrial locations in the region. The building has a contemporary attached office, drive-through capability, has a clear span / high clearance roof, and was manufactured by a well-regarded local firm (Garco Systems). The property suffers internally due to several design and condition factors, including the need for cosmetic improvements to the carpet and interior finishes. Externally, the subject property, like all other industrial properties in the current market, is exposed to very weak economic conditions. Despite the poor economic conditions for the current market, the positive location and physical features of the subject property suggest a value conclusion in the upper part of the value range. For this reason, it has been estimated that the Market Value of the property as of February 16, 2011 is $760,000, according to the assumptions and limiting conditions cited in the report. The landscaping would consist of irrigated grass that would extend along the entire side of the parcel starting at the corner of Farr Road and go eastward to their property line. (See Attachment 2— Map of Affected Area) Two inches of top soil and hydroseed would be brought in and there would be some underground sprinkler piping to provide irrigation. The swale area to be affected measures approximately 50 feet by 327 feet. In the event the Council is in agreement with Appleway Court 202's proposal, Staff has identified granting a License to be the best way to deal with this issue and allow Appleway Court to landscape and maintain this turf area. A License to use property is essentially written permission to use it. The License would run for a period of 20 years and is revocable by the City. The Stormwater Department finds granting a License to be compatible with their needs. Staff has no objections to granting this License. OPTIONS: (1) Request changes or further information; (2) Grant License; (3) Do nothing. RECOMMENDED ACTION OR MOTION: Consensus to place on future agenda for motion consideration. In addition to maintaining the city's 438 miles of roadways,the department is responsible for inspecting and maintaining sixteen bridges in Spokane Valley. Our most rxent bridge inspection shows that the southbound Sullivan Road Bridge(The west- ernmost bridge of the two)across the Spokane River has begun to show signs oFdeterioration. The deterioration is typical in bridges of this age and includes.cracking in the girders as well as deterioron of the driving surface. Deicing agents used over the years have nlso resulted in a high chloride content in the bridge's concrete,which can contribute to further deterioration. While the sixty year old bridge is not currently at risk of failure.loads exceeding the ntatiimutn legal weight limit will cause the bridge to deteriorate more quickly and reduce its useful life. Tn nrnid the need to impose weight reairictlons tshich would negatively impact those in the industrial community and trucking industry that rely on the bridge,it is important that the legal Height limits be observed. The properties are known as Hanson Center East, Hanson Center West, Marketpointe 1 and Marketpointe II. Hanson Properties has a significant number of vested traffic trips that will expire on March 2015. These trips were created through agreements between Hanson and Spokane County prior to incorporation and were the result of significant infrastructure investment by the developer. Due to the current economic downturn, several of the parcels associated with the vested trips remain undeveloped. In order to foster economic development, Hanson has partnered with the City to propose a new development agreement. The developer agrees to contribute cash and property for future improvements to the Sullivan and Indiana intersection. The initial improvements would be constructed as part of the 2011 Sullivan/Indiana resurfacing project. Addition property will be dedicated to the City for the anticipated 2015 Sullivan Road West Bridge Replacement project. The improvements to the intersection will mitigate traffic impacts by the Hanson and others in the vicinity. In exchange, Hanson has requested that the expiration date of the trips be extended to March 2025 and that a number of new trips be vested. This presentation provides the background for the agreement that will be presented to council at a later date to be determined. OPTIONS: Pursue or not pursue the development agreement with Hanson.
