BACKGROUND: Council adopted the 2011 -2016 TIP based upon information staff had at that time relative to available funds and how these funds could be utilized for transportation projects. Since the adoption of the 2011 -2016 TIP, staff submitted applications for a federal Surface Transportation Program Enhancement (STP(E)) grant, a Transportation Improvement Board (TIB) Urban Sidewalk Program (USP) grant, a Freight Mobility Strategic Investment Board (FMSIB) grant, a federal Bridge Program (BR) grant and a Community Development Block Grant (CDBG) for the following projects that were selected for funding: • Spokane Valley — Millwood Trail (PE Only) (STP(E)) • 24 Sidewalk — (TIB -USP) • Sullivan West Bridge — (BR, FMSIB) • Green Haven STEP Paveback — (CDBG) • Broadway Ave. Overlay — (CDBG) • Sidewalk Infill Project — (CMAQ) • Mansfield Extension — (CMAQ) • Sprague /Sullivan ITS — (CMAQ) Additional proposed changes identified in the Amended 2011 TIP include the following: Broadway Avenue Safety Project was rescheduled from 2010 to 2011 due to delays from the temporary suspension of the design. • The Corbin, Cronk, South Greenacres and West Farms Sewer Paveback projects were not completed in 2010 and will carry over into 2011. • The Barker Road Bridge, Pines - Mansfield, Broadway Ave Reconstruction (Moore to Flora), Park Rd. /BNSF Barrier Curb, and Sprague ITS projects are carryovers from 2010. • The Pavement Management Program - Arterials & Local Access projects have been deleted from the 2011 TIP. The Pavement Management Program for arterials and local access streets is currently unfunded. • The Barker Road /BNSF Grade Separation (PE Only) was deleted due to unsuccessful funding application for FY2011 Federal Earmark. • The 2011 STEP Paveback projects (Green Haven and Mica View) have been added based on Council approval on February 8, 2011. • The Flashing Yellow Arrow Installation and Traffic Signal LED Replacement Projects are carryovers from 2010. • The Greenacres Trail (PE Only) was added after reallocation of Energy Efficiency & Conservation Block Grant (EECBG) funds that were previously awarded in 2009. Based on this information, it is recommended that the 2011 TIP be amended to reflect the deletion of the projects that did not receive funding, include those projects that were not completed in 2010 and have been carried over to the 2011 construction year, and those projects added to the 2011 construction year. Attached is a summary of the proposed changes. Adoption of the Amended 2011 TIP is currently scheduled for March 29 2011. OPTIONS: 1) Adopt the proposed Amended 2011 TIP, or 2) provide additional direction to staff. RECOMMENDED ACTION OR MOTION: Move to approve Resolution No. 11 -003 adopting the Amended 2011 TIP as presented. BUDGET /FINANCIAL IMPACTS: The 2011 budget will be administratively amended to reflect changes associated with this amended 2011 TIP. There are sufficient capital project funds in the 2011 budget to cover the local match for these projects. WHEREAS, the Spokane Valley City Council adopted by Resolution No. 10 -013, the 2011 -2016 Six -Year Transportation Improvement Program (TIP) with such program acting as a guide for the coordinated development of the City's transportation system; and WHEREAS, changes in certain funding sources and project schedules have occurred; and WHEREAS, the attached Amended 2011 TIP incorporates said changes for year 2011; and WHEREAS, pursuant to the State Environmental Policy Act, the adoption of the Six -Year TIP is a non - project action which has received proper and timely environmental review by the City; and WHEREAS, the amendments to the 2011 TIP are consistent with Spokane Valley's adopted Comprehensive Plan; and WHEREAS, this action constitutes an amendment to the City's Capital Facilities Plan under its Comprehensive Plan, and has been sent to the Washington State Department of Commerce for review pursuant to RCW 36.70A.106. NOW THEREFORE, be it resolved by the City Council of the City of Spokane Valley, Spokane County, Washington, as follows: The City Council hereby adopts the attached Amended 2011 TIP for the City of Spokane Valley for the purpose of guiding the design, development and construction of local and regional transportation improvements for the year 2011. The City Clerk is directed to file the Amended 2011 TIP with the Washington State Secretary of Transportation not more than 30 days after adoption of this Resolution. BACKGROUND: In 2009, the City of Spokane Valley applied for and received a grant of $400,000 from the U.S. Department of Energy for the design and construction of intelligent transportation system (ITS) improvements such as connecting traffic signals and installation of traffic cameras along Sprague Ave. The Transpo Group was selected in late 2009 through an RFQ process to design the improvements. The project was advertised for bids on March 4, 2011, with a scheduled bid opening on March 25, 2011. After opening bids and tabulating the results, staff will present results at the Tuesday, March 29, 2011 Council meeting to award the contract to the lowest responsible bidder. The project will install fiber optic cable in existing conduit between University Rd and McDonald Rd, connecting four traffic signals to the Spokane Regional Transportation Management Center (SRTMC) and provide a communications path for a follow -on project to connect an additional five intersections to the SRTMC. There are also provisions for a traffic camera in this project. Connecting signals to a central system enables better signal operation and coordination. OPTIONS: 1) Award the Sprague Avenue ITS project to the lowest responsible bidder, or 2) Provide additional direction to staff. RECOMMENDED ACTION OR MOTION: Move to award the Sprague Avenue ITS Project bid to the lowest responsible bidder BUDGET /FINANCIAL IMPACTS: Total project estimate is $400,000, entirely from Federal EECBG funding. GOVERNING LEGISLATION: RCW 35A.13.020, RCW 42.12.070, City of Spokane Valley Governance Manual 2.04 PREVIOUS COUNCIL ACTION TAKEN: Council's process used to fill Council Position #3 vacancy. BACKGROUND: With the passing of former Councilmember McCaslin on March 13, 2011, pursuant to RCW 35A.13.020 City Council must fill the vacancy within ninety (90) days. If this timeframe is not met, the City's authority in this matter would cease and the County would appoint a qualified person to fill the vacancy. The date to meet the ninety day deadline is June 11, 2011. The proposed draft Timeline for the process is as follows: April 1, April 8, April 15, 2011: Publication of the notice of vacancy. Tuesday, April 19, 2011, 4:00 p.m. Applications must be received by the City Clerk April 26, 2011; 5:00 p.m. Executive Session to review applications April 26, 2011; 6:00 p.m. Determine list of those applicants to interview (in open session) May 10, 2011; 6:00 p.m. Interviews of selected applicants (in open session) May 17, 2011; 5:00 p.m. Executive Session to discuss applicant interviews May 17, 2011; 6:00 p.m. Appointment of applicant (in open session) At council's direction, a statement can be included in the notice of vacancy that those who have submitted an application for the previous vacancy of Council Position #3 need not re -apply but would need to inform the City Clerk of their desire to be considered for this vacancy. BUDGET /FINANCIAL IMPACTS: None STAFF CONTACT: Mike Jackson, Cary Driskell ATTACHMENTS Draft ad; Draft Procedure for filling vacancy SPOKANE VALLEY COUNCIL MEMBER POSITION VACANCY The Spokane Valley City Council is accepting applications from individuals interested in serving as an interim Councilmember to fill the vacancy of City Council Position 5. The person appointed to this interim position will serve from the date of appointment until the person elected in the November 2011 general election takes office on November 29, 2011, which is the date the election results are expected to be certified. State law requires that a councilmember be a resident of Spokane Valley for at least a year prior to appointment, and be a registered voter at the time of application. Position 45 term expires December 31, 2013. Council positions are at -large positions. The City of Spokane Valley is a non - charter code city, operates under a council- manager form of government, and is governed under the optional municipal code of the Revised Code of Washington (RCW) Title 35A. Under this form of government, legislative authority is concentrated in the elected City Council, which hires a professional administrator, a City Manager, to implement policies. The Council is comprised of seven members, all of whom have an equal vote, with the Mayor chosen every two years from among fellow Councilmembers. As the legislative body, the City Council establishes local laws and policies, and has general oversight and control over the City's finances, primarily through the budget process. Regular Council meetings are generally held every Tuesday beginning at 6:00 p.m., with the more formal meetings held the second and fourth Tuesdays, and study sessions held the first, third and fifth Tuesdays. Timeline /Procedure 1. Placing the Ad: The City will publish the vacancy and invite citizens of the City who are interested and qualified to sit as a Council member to apply on an application form provided by the City. Publication of the vacancy will be April 1, April 8 and April 15, 2011. Qualifications to sit as a Council member are set forth in RCW 35A.13.020, which refers to RCW 35A.12.030. 2. Application Deadline: All applications shall be received by the City Clerk no later than 4:00 p.m. on April 19, 2011. 3. Interview Selection Process: a. At 5:00 p.m. April 26, 2011, the City Council will meet and adjourn to executive session (closed session) to review and discuss all of the applications. b. At 6:00 p.m. April 26, 2011, the City Council will meet in open session to discuss and select applicants to interview. Selection will be by nomination and second. A vote will be taken and candidates receiving three or more votes will be interviewed. 4. Date of Interviews: The interviews will be conducted May 3, 2011, during the open council session. 5. Discussion of Applicants: At 5:00 p.m. May 10, 2011, the City Council will meet and adjourn to executive session (closed session) to discuss qualifications of the applicants. 6. Appointment: At 6:00 p.m. May 10, 2011, during its regular open session, Council will discuss applicant interviews and vote to fill the vacancy. 7. Each interview will be a maximum of 30 minutes. B. Interview Questions /Process 1. City Council members interested in submitting interview questions, will provide their top five questions (which they have rank ordered in tenns of importance) to the City Manager by April 12, 2011. 2. Staff will compile the list of City Council members' questions. Where questions are regarding the same topic, staff will combine them while attempting to capture the specificity of the individual question. 3. The draft Selection Procedure will be considered by motion on April 5, 2011. If such motion passes, applications will be accepted effective immediately. 4. Draft interview questions will be provided to City Council to discuss and finalize at the April 19, 2011 Council Meeting. 5. Following the April 26, 2011 Council meeting, the City Clerk will send the entire list of questions to each candidate to be interviewed. 6. Council will approve the final questions. Page 1 of 2 Position #5 7. Each Councilmember may ask each candidate up to three of the questions. S. Candidates will be interviewed in alphabetical order of last name. C. Voting Process to Appoint Interim Councilmember 1. A City Council member may nominate an applicant to fill the vacancy. A second is required. If no second is received, that applicant shall not be considered further unless no applicant receives a second, in which case all applicants who were nominated may be considered again. Once the nominations are given, the Mayor will close the nominations and Council will proceed to vote. 2. Any vote to approve an applicant shall be by voice or raised hand in the affirmative or negative. 3. The vacancy can only be filled if a majority of the City Council present affirmatively votes for the applicant, i.e. if five City Council members are present, this would require at least three out of five City Council members voting for an applicant. If a candidate receives a majority of votes, that candidate is the Interim Councilmember. 4. If no applicant receives a majority of votes from the City Council, then the three applicants receiving the most affirmative votes would be considered in a second round. In the possible case of a vote resulting in one applicant gaining the most votes (but not a majority of votes of all councilmembers), and a three -way tie of three other candidates, Council will proceed with a second vote. In a second round of consideration, the same process would be followed as before to determine if one applicant receives a majority of affirmative votes. With the end of SARP becoming a reality, we can and need to move on and I am convinced that now is the time for this council to not only move to create a business friendly city but that by doing our due diligence, we can attract some of the businesses fleeing California. How do you propose to address these issues? 1. Create a business friendly City. We need to attract manufacturers to this area and we can, we have so many things we can offer companies that we should be a destination city but because we live in the shadow of the West Side we are at a disadvantage in comparison to other states. We need to overcome this by crafting laws to reduce the costs of doing business such as reviewing the overzealous fire sprinkler codes we currently have and applying zoning laws to allow more flexibility. I propose having meetings with representatives of manufacturing companies like Kaiser, Honeywell, Purcell and Monaco as well as smaller companies to see what changes would be beneficial to them while balancing those proposed changes with environmental and social considerations. 2. Rebuilding unity and establishing an affordable and realistic vision for the City of Spokane Valley. After the disaster called SARP, we need to focus on where this city is headed in a mature and responsible way. We need to understand the realities of the current economic situation and create a climate to attract new businesses, while respecting private property rights and retaining the atmosphere that makes the Valley such a wonderful place to live. I would propose that we do so by creating a set of questions placed on the City web page that Spokane Valley residents could answer. For Instance: Do they want a city center/hall, if so, where would they like it to be? Are they willing to pay additional taxes to implement such a plan and if so, how much? The questionnaire could also have questions about the continuation of the Appleway Couplet and Sprague one -way vs. two -way. This might not be the most scientific method but it would show whether or not there was enough interest in these topics to conduct further information gathering. This would be a very open, inexpensive, and transparent way to find out voter interest. 3. Maintaining and improving our roads. We do not want our roads to fail apart like Spokane's has so we must be diligent in maintaining them. However maintaining roads cost money thus we need to find ways to pay for them including looking at all non - essential budgetary items for ways to eliminate waste, possibly renegotiating union and non union salaries to bring them more into line with the private sector; and lastly, asking voters about raising the revenue required to support raising road construction costs. Shortly after, I put my name in to be one of the first City Council members but received many comments that people admired my interest and enthusiasm but 1 needed to finish college first. In 2004,1 graduated Eastern Washington University with a Bachelors of Science in Computer Science and went to work for Goodrich Aerospace in their IT Department. 1 have watched the City of Spokane Valley take shape with much excitement. Now that I have my degree, an accomplished career, and have started a family I am ready to pursue my passion for serving my community. While I haven't been as visible in the recent past I believe that; my previous involvement in gathering information from other Washington Cities during the incorporation drive, participating in the Boundary Review Boards Financial Feasibility Study for the potential City of Spokane Valley, listening / participating on the transition committees, completing the Certified Tourism Ambassador (CTA) training from the Spokane Regional Convention and Visitors Bureau, and serving on the Spokane County Fair & Expo Center Advisory Board for the last 6 years (chair for the last 5) give me the knowledge / skills to hit the ground running and be a contributing City Council member. How would you propose to address these issues? 1) Vision — The citizens of the City of Spokane Valley want direction and leadership. The indecision of the Sprague Appleway Revitalization Plan has put the focus on undoing the past instead of building our city's future. A clear, long -term vision needs to be formed and put into action. I would like to form goals and projects that aid in developing our city toward this vision. l see the City Council's role as more than policy making its leadership. As leaders of the city we need to communicate with citizens and start discussing ideas for improving our city and our way of life. As a city we have set the groundwork for the future by establishing a good financial foundation. The Council's current proposal of conducting a citizen survey is a great plan as we look toward the future. 2) teamwork -- When we work together everyone gains more. There are two facets of interaction that I would like to focus on. a. Internal --The City of Spokane Valley is one team. The Council and staff will only succeed with each other. Watching the interactions / discussions between staff and Council, I see a lack of trust. Maintaining good relationships, empowering people, and ensuring a positive environment will greatly enhance the productivity of the city. b. Regionally — I applaud your efforts in being good stewards of the tax payer's money. There are more factors in being a great city than the bottom dollar. As a citizen in the City of Spokane Valley, I want to live in a city that not only has good money management, but is enjoyable and well respected, We are the second largest city in the region; by size alone we cannot be ignored. We have the potential of being regional leaders. Unlike the other municipalities we have a unique opportunity. We have no past, no burned bridges. We can partner with the County, the City of Spokane, or even the smaller cities to create better outcomes for all citizens. Because we are young, we bring an unbiased, clean slate which is non - threatening and facilitates better discussions / decisions. We should take opportunities to be heard and take a more prominent role in the region. 3) Finding revenue to sustain the Street Fund —This isn't going to be easy. Like everyone else, 1 don't want any more taxes. So, there are only two options: find the money elsewhere within the budget or increase the tax base to generate more revenues (i.e. facilitate more businesses locating to the Spokane Valley thereby increasing sales tax revenues, promote tourism). While efforts have been made to stream line the permitting processes and regulatory oversight I think more needs to be done. BACKGROUND: The Greenacres Park Phase 1 Project was advertised for bids beginning February 25, 2011. Bids were opened Thursday, March 17, 2011. Five bids were received with all five bids being significantly lower than the Landscape Architect's estimate. The low responsible bid was submitted by Bouton Construction Company. This project is funded with $500,000 from the state and the balance from the Parks and Recreation Capital Fund. The Phase 1 cost estimate was $1,538,322.40 which included the base bid and five alternates. The low responsive bid was $937,973.00 for the base bid and the five alternates. Staff will be recommending awarding a contract for the base bid and alternates 1 -4. The alternates include: 1) installation of turf and irrigation for Phase 2 of the park; 2) add the sand and water play area; 3) add one small shelter; and 4) substitute concrete for asphalt on the perimeter path system. By accepting several of the alternates, several items included in Phase 2 will be completed in Phase 1 saving the City money down the road when Phase 2 is constructed. Construction items not included in the bid include: purchasing the restroom from a state contract at approximately $100,000, costs for completing street improvements which include widening the streets and moving utility line at approximately $90,000 and our existing consultant contract for design and project management. The City will be using the standard AIA contract A101 -2007 for this project. OPTIONS: 1) provide additional direction to staff. BACKGROUND: The City of Spokane Valley received a grant from the Transportation Improvement Board (TIB) Under the grant agreement TIB will fund 80 % of the project cost, up to a maximum of $1,566,850. The project will connect Indiana Ave east of Sullivan Road to the Mission /Flora intersection with a divided parkway including sidewalks, curbs, gutters, bike lanes, and drainage improvements. This project will help alleviate congestion along Broadway Ave and Sullivan Rd by completing a missing link and providing an east -west route immediately north of 1 -90. It is a system created by the County Information Services Department and is going to be retired in 2012. The City will need to find a system to replace the PLUS system. City and County staff have investigated several systems and it appears that the County is ready to procure its PLUS replacement. City staff has prepared the attached information for Council in advance of a more detailed admin report to be presented next month. OPTIONS: None at this time, information only on the partnering effort to date. RECOMMENDED ACTION OR MOTION: No action required. BUDGET /FINANCIAL IMPACTS: To be provided in admin report STAFF CONTACT: Mary Kate McGee, Building Official ATTACHMENTS: Permit Software Replacement Information Permit Software Replacement City staff was informed by County Information Services (ISD) staff in July 2010 that the PLUS system, currently used by both the City and the County for permit tracking, would be decommissioned in the first quarter of 2012. PLUS is a proprietary system developed by County ISD staff. The program used to design the system is 20 year old technology that has become obsolete, prompting the County to retire the current system in favor of a newer, vendor supported permit tracking system. The City has been using the County's PLUS system for most of the last seven years with the City's PLUS data residing on a server at the County. Over the last eight months, County and City staff have jointly reviewed six permitting systems, including the system used by the City of Spokane. System review included demonstrations by vendors, phone conversations with system clients, and two field trips to look at the most promising systems, Eden and Paladin. City staff applied a matrix system to compare systems to make sure we were comparing "apples to apples." County has reviewed and declined to pursue the Eden system, mostly on the basis of cost and concerns about on -going system support. City staff has similar concerns about system support. County and City staff agree that Paladin is the most promising system we have reviewed. The functionality, pricing (based on estimates at this time) and system support appear to meet the needs of the County and the City. County and City staff will be having follow -up demonstrations by the vendor at the end of March. The County plans to make a purchase decision within the next 30 days. At this time, the benefits of County /City partnering on permitting software appear to apply to long term operability of the permitting system software with the County GIS system, and for development of a web portal. The vendor is not offering any price modifications for the actual purchase and implementation of the software based on County /City partnership. The only potential financial benefit may be seen in the area of data conversion since County and City data is all PLUS data.
