AN ORll1NAi\"CE OF THE CITI' QF SPQKA~iT VALLEY, Sl'OKA\"E COUNTY,
WASHINGTON, ESTABLISHING LT1VTiTATTONS ON THE USE OF THE OFFICIAL
CITY LOGO OF THC CITY OF SFQKANE VALLEY, WASHINGTON.
WHETZE AS, the City Council established by Trademark, the City of Spokane Valley Logo, which depicts a
mountain and river with the name of the City of Spokane Valley. The Trademark was filed with the Secretary
of State for the State of 1'Jashington on June 23, 2003; and
WHEREAS, Secretary of State Sam Keed certified July I, 2003, that according to records on file in his of>tice,
the trademark "City of Spokane Valley +vith llesig*n," is now duly registered to the City of Spokane Valley, in
the State of Washington file #31689, issued June 23, 2003 and expiring June 23, 200; and
WHEREAS, pursuant to RCW 19.77.010, as registered owner of said logo, file City of Spokane Valley hers the
exclusive right to the use of the trademark; and
WHEREAS, it is the desire of the City Counci I to establish appropriate criteria to dcterm ine whether to grant
requests for use of the logo.
"OW, THEREFORE, the City Council of the City ol'SpokNnc V91lcy ordains as follows:
Section 1. Legislative findinQS. The City Council finds that the logo of the City of Spokane Valley is
a symbol of the authority of the City and is a valuable asset of its population. It is the intent of the City
Council to ensure that only appropriate uses are made of said City logo.
Section 2. T)efinition. Unless the context clearly requires otherwise, the definition in this section
applies throughout this chapter. "City Logo" or "logo" means that logo recorded under State of Washington
trademark #3 1689, +vith "Cit:y of Spokane Valley" and depicting a rnounlirin and river; as illustrated below:

Section 3. Official Use. Use of the City logo shall be for official purposes as specifically set forth
below.
A. The following uses halve been explicitly and expressly approved without the need for further City consent:
1. use of logo on any oftrcial City of Spokane Valley document, including but not limited to stationery,
letterhead, report and report covers, envelopes, memorandums; faxes, employee and elected officials' business
cards, name tags; and name plates;
2. use of logo on Student Advisory Council (SAC) stationer~~ and items of recognition;
3. use of logo by Spokane area Economic L7evelopment Council for their marketing rtlaterials; on their
+vebsite, and in their printed materials that are used in recruitment; expansion and retention efforts for
marketing for business attraction and development;
4. use of logo by thin Greater Spokane Valley Chamber of Commerce for City of Spokane Valley

promotion of the Mayor's State of the City Address; and for the City's general promotion through the
Chamber's map;
5. use of logo by those officially involved with and For the planning, promoting; and decorating
connected with the Mayor's 13a11, including but not limited to event wine glasses, napkins, tickets, im+itations,
and other promotional materials and decorations for the Ba11;
6. use of logo by Aurrfect Logos for ,apparel purchased by city employees and elected officials,
provided those purchases are transacted while those employees and elected officials are still serving in their
City capacities; and
7. use of logo by those. officially involved with and for the planning of Valleyfest and accompanying
parade; including but not limited to event decorations, promotional materials, adverrtisements, posters, and
temporary signs.
B. "1'hc logo may, with City approval, be used for other specific events that benefit the City of Spokane Valley
community and are not prohibited by Section C, below.
C. Approved use ofthe City logo shall also be in accordance ~~+ith the City of Spokane Valley Logo Style and
Standards Guide, which shall be approved by separate resolution.
p. The City logo shall not be used on or in connection with any advertising or promotion for any product,
business, organization, service, or article, whether offered for sale for profit or offere(I ~~+ithout charge, without
the express consent of the City Council. "Che logo shall not be used in conncct:ion with any election issue, or
campaign related thereto.
F. it is a violation of this chapter to use any symbol that imitates the logo or that is deceptively similar in
appearance of the logo, or in anp manner that would be an improper use of the logo itself.
Nothing in th is chapter shall prohibit the reproduction of the City Logo for illustrative purposes by the ne«5
media if the reproduction by the news media is incidental to the publication or the broadcast. Nothing in this
chapter shall prohibit a characterization of the city logo from being used in political cruloons.
Section 4. Penalt~~ for violation. Any person who violates this chapter shag I be subject to any and all
remedies available to the City under the law, including but not limited to a suit for (lamages andlor injunctive
relief.
Section 5. Permission for use. Any request for use of the City Logo shall be submitted in writing to
the City Clerk (or designee) in advance of the date needed. The Mayor (or designee), in consultation with the
City Manager (or desigmee), shall decide whether the requested use shall be approved b}+ the City. The City
Clerk (or desigrice) shall send written response to the requcstor within three (3) business days of the decision
b_v the Mayor.
Section 6. Severability. if any section; sentence, clause or phrase of this ordinance shall be held to
be invalid or unconstitutional by a court ofcompetent jurisdiction, such im+alidity or unconstitutionality shall
not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance.
Section 7. Effective llale. This Ordinance. shall he in full force and effect five days after
publication of this Ordinance or a summary thereof in the official newspaper of the City.
