WHF:RHAS, Spokane Valle}' Municipal Code ]0,30.~60(D) contains provisions for appeals to administrative
determinations, however that section is not clear whether the pa}'meat of an appeal fee is a necessary
precondition of filing the appeal. This Ordinance seeks to make clear that the payment of the appeal fee must
be contemporaneous with filing an appeal; and
WHEREAS, the City of Spokane Valley Master fee Schedule, Schedule A Development, requires payment
of a fee for appeals to administrative decisions; and
WHEREAS, in complying with the requirements of its enacted laws and regulations, the Cit,~ finds from time
to time that amending its laws is necessary to better protect the health, safety, AND welfare of the ~encral
public and the environment.

ORDAINS AS FOLLOWS:
Sectir,n Spokane Valley Municipal Code, Section 1030.560(D) shall be amended to read as follows.
"Any person filing an appeal under this article who was issued a notice and order, or is the o.+~ner of the
land vfiere the violation occurred, shall do so by obtaining the appeal form from the City and filing the
completed appeal form along with the appropriate appeal fee specified in the Master fcc Schedule, within
20 days of service of the notice and order or stop work order. failure to appeal the notice and order or stop
work order within the applicable time limit_S shall render the notice and order or stop work order a final
determination that the conditions described in the notice and order existed and constituted a violation, and
that the named party is liable as a person responsible for a code violation. A cornplaina~~t who appeals the
determination of compliance by the City must file any such appeal within 20 days of service of the
determination of compliance."
Section 2. Severabilitv. If any section, sentence, clause or phrase of this Ordinance should be held to be
invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not
athect the validity or constitutionality of any other section, sentence, clause or phrase of this Ordinance..
Section 3. Effective Date. °t°his Ordinance shall be in full force and effect five days after publication of
the Ordinance Summary.
